The existing pond outlet structure at Orton Pond directs water through a 24" diameter pipe located under Plantation Road, which is then channeled to the rice fields at Orton Plantation. The existing pipe failed and an 18" PVC pipe was inserted within the pipe as a temporary fix. But the pipe needs to be replaced with a larger diameter pipe in order to efficiently manage irrigation flow to the system of rice fields. The applicant proposes replacing the existing outlet structure and pipe with a new outlet structure, 36" diameter pipe, and rip rap (to avoid scouring at the outfall). The proposed project will permanently impact 0.009 acre of wetlands and temporarily impact 0.01 acre of open water. Because the project area is located mostly within a DOT right -of -way, the area has not been officially delineated. An approximate wetland line has been located on the site plan. Because permanent impacts are minimal, no compensatory mitigation is proposed. Enclosed is the PCN form, site maps, and photos of the project area. The project area is located mostly within a maintained DOT right -of -way and includes the area where Orton Pond outlets into the existing rice fields. There is an existing pond outlet structure and 24" pipe that crosses under Plantation Road. 3b. List the total estimated acreage of all existing wetlands on the property: The project area footprint includes approximately 500 sf of open water at the existing pond outlet structure and approximately 375 sf of wetlands where the existing pipe discharges. 3c. Explain the purpose of the proposed project: The purpose of the project is to replace an existing 24" pipe and outlet structure with a new 36" pipe and outlet structure at Orton Pond. The existing pipe failed and an 18" PVC pipe was inserted within the pipe as a temporary fix. But the pipe needs to be replaced with a larger diameter pipe in order to efficiently manage irrigation flow to the system of rice fields. 3e. Describe the overall project in detail, including the type of equipment to be used: The applicant proposes to temporarily install silt fence and a water - filled coffer dam, then remove the existing pavement, pipe, and outlet structure. Once this is done, the new 36" pipe, outlet structure, and rip rap energy dissipater (25' x 15' x 12 ") will be installed. Then the paved road will be repaired and sloped to original conditions. The disturbed area will be seeded with a grass mixture and the coffer dam will be removed. The silt fence will be removed once the grass has established. 4. Jurisdictional Determinations 4a. A portion of this site is located within the Orton Pond Aquatic Habitat Significant Natural Heritage Area. Several rare species are known to occur within Orton Pond, including the magnificent rams -horn (Planorbella magnifica), American alligator (Alligator mississippiensis) and anhinga ( Anhinga anhinga). The site also supports two special habitats: an Osprey Nesting Area and a Wading Bird Rookery. The proposed project is a maintenance activity and no impacts to rare species are ex ected. 6. When any installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to remove and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the first part. That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the Division Engineer of the party of the first part. That the party of the second part agrees to have available at the encroaching site, at all times during construction, a copy of this agreement showing evidence of approval by the party of the first part.
