Dear Mr. Lanning:
The Division of Energy, Mineral and Land Resources (DEMLR) has reviewed your letter dated
November 13, 2020 regarding the October 2020 NPDES Storm Water Discharge Monitoring Report
for the subject facility. The letter states that SW006 is in Tier III status for Copper and Zinc and that
corrective actions have been implemented to bring SW006 into compliance. The monitoring report
provided shows"no qualifying flow for the month of October 2020"for SW006.
Part II, Section B of the above referenced permit lists several actions that DEMLR may require of
the permittee upon notification of Tier Three status. In order for DEMLR to evaluate if additional
action will be required of the permittee,the following information is being requested at this time:
1. A summary of analytical data for SW006 since the date of the first exceedance for Copper
and/or Zinc.
2. A summary of corrective actions which have been taken since the date of the first
exceedance for Copper and/or Zinc at SW0006.
3. Any documentation that has been maintained in association with the tiered response for
SW006 during this permit cycle.
