The responses to your comments are as follows: Comment 1) Show all stream impacts including all fill slopes, dissipators, and bank stabilization on the site plan. Response: Plans have been revised to show all stream impacts due to the construction of Oak Forest Road Extension and the proposed subdivision. The wetlands delineation has been included on the plan as well as approximate locations of proposed BMPs. The wetland determination letter dated August 4, 2007 has been included in the package for your reference. Comment 2) Indicate all buffer impacts on the site plan. Response: All buffer impacts have been labeled as Zone 1 and Zone 2. Comment 3) Indicate proposed lot layout as overlays on the site plan. Response: Building envelopes have been provided on the plan to indicate areas of potential development (grading). Comment 4) Locate all isolated ornon-isolated wetlands, streams and other waters of the State as overlays on the site plan, and provide intermittent/perennial stream determinations by DWQ showing all streams on the property. Response: Wetlands based on the wetlands determination letter dated August 4, 2007 have been shown on the site plan as requested. Response: Across section at the entrance to the culvert has been provided showing that the pipe will be buried approximately 20% (about 12") to provide for aquatic life passage. Comment 6) Locate any planned sewer lines on the site plan. Response: Proposed sanitary sewer locations have been located on the site plan. Comment 7)Provide the location of any proposed stormwater management practices as required by GC3631. Response: Approximate BMP locations have been shown on the site plan as requested. Comment 8) Please provide detail for the stormwater management practices as required by GC3631. Response: It was determined in meeting with Mr. John Dorney of your office on July 20, 2007 that the approximate location of the BMP would be the only requirement at this time. Please see attached memo dated September 17, 2007. Stormwater management plans will be submitted to City of Raleigh as a required component of site plan approval for each lot. Comment 9) Please specify the percent of project imperviousness area based on the estimated built-out conditions. Response: Please see memo mentioned above. Comment 10) Please indicate the diffuse flow provision measures on the site plan. Response: The diffuse flow will be handled during the site plan submittal process. Comment 11)Provide the US Army Corps of Engineers Nationwide permit No. Response: The US Army Corps of Engineers determined that there was no wetlands determination at the proposed Oak Forest Road Extension crossing, see attached Wetlands Determination Letter from the US Corps of Engineers dated August 4, 2007. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 .~ USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic-r-esour-ce -w-ilf-be- consider-ed-in- determining-acceptabi.Iit-y_.o_f__appropriate- .and__practicahle_ mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for, processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as ,incomplete. On July 20, 2007 the following met in the offices of DWQ on Crabtree Blvd. to discuss the subject project: John Dorney, DWQ Mary Jo Lee, CH Engineering Tom Hepler, CH Engineering Ed Bailey, Developer This meeting was afollow-up of a meeting held in DWQ office with Ian McMillan and Annette Lucas in which we were encouraged to coordinate with John Dorney. This project involves the extension of a City of Raleigh Street east across an un-named stream which flows from South to North into an in-line wet-pond which was designed as a mitigation measure for the implementation of the Triangle Towne Center. John Dorney was familiar with the Triangle Towne project and the purpose of the wet-pond. Apparently, the wet pond was a measure installed to compensate for wetlands which were destroyed with the shopping center's construction. It can be modified to be used for stormwater storage but credit cannot be taken for treatment of water quality. Water quality treatment should take place on-site. CH Engineering was directed to develop a schematic plan for stormwater treatment for quality for the entire subdivision. Description, general size and siting of potential BMP devices should be shown on a plan in order to treat and reduce the TSS and Nitrogen. It is understood that these individual devices would be reviewed by the City of Raleigh in accordance with DWQ along with measures opted to reduce runoff impact as a result of pre-post stormwater calculations. BMP worksheets would not be necessary at this stage but would be submitted at the site plan submission stage to the City of Raleigh. Page 2 CH Engineering indicated that field location of stream and wetlands were being performed by Eric Galamb. As soon as this is complete and has been confirmed by DENR and Corps of Engineers it should be mapped and incorporated onto the next plan submission to DWQ along with the BMP's proposed and the completed necessary forms. In the meeting in May, we were asked to investigate modifying the culvert such that its angle with the roadway falls between 75 degrees and 105 degrees, however it should be placed to follow the natural stream bottom. The length of stream impact cannot exceed 150 linear feet, otherwise a special permit must be pursued. If we do not hear from you, we plan to proceed with preparing the plans and documents per this memorandum for submission in pursuit of the Section 401 Water Quality Certification.
