Good afternoon Heath, This correspondence is in reference to the monitoring report and credit release request submitted for the RES Yadkin 05 UMBI - Cardinal Mitigation Site, Action ID SAW- 2020-00762. The purpose of this letter is to transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the monitoring report and to confirm the annual credit release. The review of the annual monitoring report followed procedures outlined in Section 332.8(o)(9) of the Mitigation Rule. The comments listed below were provided by the NCIRT during this process. While it is not necessary to provide a response to specific comments at this time, please be sure to address the issues raised in future monitoring report submittals. Andrew Friedman-Herring, NCDWR 1. Overall, the planted stem density and diversity looks good. The comment about stems being hard to see under the herbaceous vegetation is noted, and numbers will be watched closely for improvement in next years report when stems have additional height. 2. In terms of location of rotating plots, please make sure at least one plot is put in the 3.25 acre replanted area north of CT4 in the MY2 monitoring report. 3. The fact that there have been two driving encroachments and two mowing encroachments in the first year of monitoring is very concerning. Please make sure that a record of conversations with landowners is kept and included in the MY2 report. 4. Thank you for including a photo of the 0.04 acre mowing encroachment near veg plot 4. However, it was not mentioned in the written report anywhere, which only mentions one mowing encroachment. Additionally, no photos of the other three encroachments were included in the report. Please make sure all separate areas of encroachment are described in the narrative section of monitoring reports, and photos included in the appendix. 5. The geomorphology of the streams appears to be performing well. 6. The hydrology of the site, especially for flow gauges CT2 and CT6 is quite concerning. When looking at the gauge data, it appears that the flow dips below the downstream riffle elevation in the middle of the consecutive timeframe highlighted, and that the actual time period of consecutive flow is closer to 14 days for each gauge. Is there a reason that these dips were not considered to break the consecutive flow count? The fact that January and February are not included in the MY1 data is noted, and the flow data for MY2 will be watched closely. Steve Kichefski, USACE 1. Noted that the encroachment on CT4 has been replanted and additional easement markings were added at the point of entry. When supplemental planting is conducted on future sites, please include the approved planting list in the monitoring report, a statement on whether there was any deviation from this list and a general estimate of planting numbers/percentages . 2. Both driving encroachments on CT1 crossed the restored stream. What damage was done and are repairs needed? Please include photos of these encroachments and documentation of conversations to resolve encroachments in the MY2 report. 3. The CT2 ESP photos are appreciated. As discussed during the as-built visit, photo stations on more of the swales, treatment pools, and ESP’s would be beneficial to site assessment over the monitoring period. Especially the ones with larger drainage areas or destabilizing flows into the project area/streams. Please include these photo stations on the CCPV. 4. Bankfull events noted. 5. The high-water event photos and the pre-construction flow data are also appreciated. Agreed with NCDWR that gauge data appears to dip below the riffle elevation for both CT2 and CT6 during the consecutive flow count. Is this due to hourly versus daily recordings, please explain or adjust? Also, noted that there is no January and February data and we will look to future monitoring years for a better assessment of project flow. As stated during the as-built visit, keeping equipment functioning and capturing the project stream flow data/photos will be important for intermittent slate belt sites of this nature. It is noted that multiple flow cameras have gone missing, and we appreciate their timely replacement. Hopefully as vegetation becomes further established, they will be better concealed. 6. Make sure to include a note on future reporting of cross section 36 graph as a reminder that the as-built survey was considered incorrect. Was the difference between the as-built and MY1 a consistent elevation that can be adjusted uniformly across or is the data considered corrupt and MY1 the baseline moving forward? 7. Macrobenthic data noted. As future monitoring macrobenthic data is collected, please reference it to the preconstruction data collected. 8. A site visit post MY2 or MY3 report submittal but still during the wet season would be beneficial for site assessment due to its location in the slate belt, however early coordination would be needed to achieve this timeframe. Based on our review of the monitoring report and the results of the NCIRT review, we confirm that you have satisfied requirements included in the approved banking instrument and mitigation plan for this site. Accordingly, with this correspondence we confirm the release of credits as shown on the attached credit release schedule. Agreed with NCDWR that gauge data appears to dip below the riffle elevation for both CT2 and CT6 during the consecutive flow count. Is this due to hourly versus daily recordings, please explain or adjust? Also, noted that there is no January and February data and we will look to future monitoring years for a better assessment of project flow. As stated during the as-built visit, keeping equipment functioning and capturing the project stream flow data/photos will be important for intermittent slate belt sites of this nature. It is noted that multiple flow cameras have gone missing, and we appreciate their timely replacement. Hopefully as vegetation becomes further established, they will be better concealed. 6. Make sure to include a note on future reporting of cross section 36 graph as a reminder that the as-built survey was considered incorrect. Was the difference between the as-built and MY1 a consistent elevation that can be adjusted uniformly across or is the data considered corrupt and MY1 the baseline moving forward? 7. Macrobenthic data noted. As future monitoring macrobenthic data is collected, please reference it to the preconstruction data collected. 8. A site visit post MY2 or MY3 report submittal but still during the wet season would be beneficial for site assessment due to its location in the slate belt, however early coordination would be needed to achieve this timeframe.
