Department of Transportation 1548 Mail Service Center Raleigh, North Carolina, 27699-1548 Subject: Correction to Certification Pursuant to Section 401 of the Federal Clean Water Act for Proposed Widening of SR 1708 (Fire Tower Road) in Pitt County, TIP Project No. R- 3613B, State Project No. 8.2220901, Federal. Aid Project No. MASTP-1708(1). Dear Dr. Thorpe: This letter is a correction to the Water Quality Certification issued for the referenced project. This letter should be attached to the existing WQC for the referenced project and is valid solely for the correction of Condition 22 of the WQC. Condition 22 is corrected as follows: 22. Two copies of the final construction drawings shall be furnished to NCDWQ prior to the pre- construction meeting.. Written verification shall be provided that the final construction drawings comply with the attached permit drawings contained in the application dated February 23, 2006. All the authorized activities and conditions of the certification associated with the original Water Quality Certification dated March 31, 2006 and all other corresponding modifications still apply except where superceded by this certification. Should your project change, you must notify the DWQ and submit a new application for a WQC modification. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 1501inear feet, compensatory mitigation maybe required as described in 15A NCAC 2H .0506 (h) (6) and (7). You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
