Salisbury Street, Archdale Bldg. 9th Floor Raleigh, NC 27604 Re: BETHPAGE - Individual Permit Modification Request AMENDMENT — Wetland Impact Area Swap DWQ Project # 20090133 / USACE AID 2006 -32645 Durham, North Carolina RAP -12020 Dear Ms. Burdette: On behalf of, AVH BETHPAGE, LLC, ALF PAGE ROAD, LLC, and Tri- Properties, Inc. we are requesting an amendment to our original Individual Permit and subsequent modification request for the project known as BethPage. The amendment to the original modification request includes a request to exchange out one impacted wetland area for a previously permitted un- impacted wetland area and a revision to the preservation map. Modifcation Request & Proposed Impacts • Signed Agent Authorization Forms • Revised Figure 6: Overall Impact Map: Insets 1 & 2 • Original Figure 6: Overall Impact Map (2009): Inset 11 • Current Preservation Area Map (Exhibit A) • 2014 DRAFT Preservation Area Map (Exhibit A) WETLAND IMPACT SWAP REQUEST: Per our previous discussion on October 27, 2015, we learned of a discrepancy, on October 20, 2015, in the current BethPage site plan that was submitted to the City of Durham for The pang f#.1ll�� dams approval, and the site plan within the original Overall Impact Ma (Fig. 6 from comp ®ny, ln�, pp p p p \ g• ) 2009. Unfortunately, the current site plan which was approved by the City of Durham, didn't depict Wetland Area "B" (Fig 6: Inset 1), which is located Rai�s�r� � ourr�ah�, raG 2191-5 Rle-, im Parkww7 above the origin of Stream Q „ and just outside of the associated riparian buffer. The permittee's have already satisfied the original wetland mitigation requirement of 0.85 credits through payment to the Neu - Con Wetland and Stream Umbrellas Mitigation Bank (Cox Site II), per the attached Affidavit of Credit Sale dated December 29, 2014, which will offset this proposed wetland impact exchange and the remainder of permitted wetland impacts. At this time we are requesting an "After- The - Fact" modification to the Individual Permit for un- authorized riparian wetland impacts of 0.09 -acre located at Wetland Area `B" , in lieu of impacting the previously permitted Wetland Area "A" which totals 0.11 -acre and will be completely avoided. PRESERVATION AREA MAP: The Preservation Area Map (enclosed) has been revised to reflect the current site plan and account for the un- authorized impacts to Wetland Area `B ". In addition, the option agreement held by the Clean Water Management Trust Fund for the proposed stream restoration project on the western side of the project area has expired and is no longer a viable project according to previous correspondence with the Clean Water Management Trust Fund staff. For this reason the 2014 Preservation Area Map revisions were never recorded at Durham County. It is intended to record the current Preservation Area Map (enclosed) immediately after approval by the US Army Corps of Engineers ( USACE). The permittees will satisfy all permit conditions of the original USACE and DWQ Individual Permits and subsequent Permit Modification Approvals.
