The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: It's not clear from the construction sequence whether stream flow will be allowed to flow over and/or through the disturbed area associated with the dam removal. In particular, step 4 references breaching the entire length of the dam followed by step 5, which involves the installation of a temporary diversion pipe. It's not clear whether flow will be allowed to flow over the breach, or whether the breach invert elevation will be above the pond elevation and the siphon remain operable while the diversion pipe is installed. Please confirm no stream flow will be allowed flow over any disturbed area during the entire dam removal. [15A NCAC 02H .0506] CONSTRUCTTQN SEQUENCE 1_ Dewater pond over dam via siphons aa&oc pumps to lowest possible lenei; discharge to cement spilhvav south of culvert under dam. I install silt fencing per approved FCP (per Edscl Frigiaeering). 3_ As water level drops, slowly lower dam elevation to pond grade and place mvfill behind Sal fence to fill in easum edge o£pond. 4 When the t%Wer level in the pond has reached its lowest potrtt, breach entire length of dam and place fill behind the siltfence_ Allow scoter to flow into the old stream channel and grade the left stream bank at a 3:1 slope. Revegetate bank according to 0. 5. Construct 6" pipe to temporarth divert stream during restoration of the original stream channel beneath the eaithen dam 6. Remove fill from old stream channel under dam and grade stream banks at 3-1 slope according to the typical detaik Stream width should match widths of undisturbed sections irnrnediately upstream and doAvsueam of the project area_ If the ele%ution change is greater than 2"A in this stream section, ne recommend lying an engineer during this phase of construction. 7_ Seed, mulch, and place coin mazting over completed banks immediately folknving appropriate grade. Add 100 live stakes along the stream bank according to typical detail. 8. Remove 6" diversion pipe and smooth pond bed to desired grades bevond the limits of stream restoration work- 9- Seed and mulch in pond bed. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by March 22, 2024. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
