Dear Mr. Duncan;
Enclosed is a copy of the Pretreatment Compliance Inspection Report for the inspection of the City of Kings
Mountain's approved Industrial Pretreatment Program on January 14, 2020, by Mr. Wes Bell ofthis Office.
This report is being issued as a Notice of Violation due to the City's failures to properly implementthe Pretreatment
Program, violations of North Carolina General Statute (G.S.) 143-215.1, ISA North Carolina Administrative Code
(NCAC) 2H .0905, and the subject NPDES Permit. Specifically, the City failed to initiate enforcement within thirty
(30) days as stipulated in the Division approved Enforcement Response Plan (ERP) on C VG for limit and reporting
violations and KMI for reporting violations during the second half of 2019. In addition, the City failed to adhere to
all of the IUP sampling methods during both semi-annual monitoring periods at Cormetech in 2019. Pursuant to G.S.
143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any
person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-2IS. 1.
It is requested that a written response be submitted to this Office by March 6, 2020. addressing the City's actions
to prevent the recurrence of these violations. The response must also include the City's actions (including copies of
the letters) to address the rescissions of multiple enforcement actions on Cormetech during the 2019 monitoring events
as discussed further in Comments and Summary Sections of the attached report. In responding, please addressyourcomments to Mr. Bell.

Mooresville Regional Office staff has reviewed your Pretreatment Annual Report (PAR) for the reporting period of
Januarythrough December 2022. Based on the review, this letter is being issued as a Notice of Violation (NOV) due to
the City's failures to properly implement the Pretreatment Program, violations of North Carolina General Statute (G.S.)
143-215.1, ISA North Carolina Administrative Code (NCAC) 2H .0905, and the subject NPDES Permit. Specifically,
the City failed to initiate enforcement according to the Division approved Enforcement Response Plan (ERP) on Carolina
Finishing & Coating (IUP #033) and Kings Mountain International (IUP #031) for thallium monitoring violations during
the first half of 2022. In addition, the City failed to collect all ]UP required parameters for Buckeye (zinc), Carolina
Finishing & Coating (mercury and zinc), CP Partners (chloroform and zinc), Fab-Tec (BOD, TSS and zinc), Kings
Mountain International (chlorides), Utz Quality Foods (copper, TSS and zinc) during one of the semi-annual periods of
2022. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per
violation per day, may be assessed against any person who violates or fails to act in accordance with the terms, conditions,
or requirements of any permit issued pursuant to G.S. 143-215.1
The City has submitted corrected copies of the PAR for review by this Office prior to completing the evaluation.
After a review of the updated PAR, the City has completed the PAR in accordance with 15A NCAC 2H .0908(b)
requirements and guidelines set forth in the Comprehensive Guidance for North Carolina Pretreatment Programs. The
next PAR will be due March 1, 2024.

Listed below is one Significant Industrial User of The City of King's Mountain's
Wastewater Facility that were in Significant Non -Compliance (SNC) with the
national pretreatment regulations, 40CFR Part 403and State Pretreatment
Regulations, 15NCAC2H.0900 and local Pretreatment Regulations.
Ja uary-June 2023: Carolina Finishing and Coatings: Violations were for
xceeding permit limits for Cyanide. One sample exceed the Technical
Review Criteria (TRC) by 33. All other samples for 2023 have been in
compliance.
January -June 2023: Buckeye Fire Equipment: Violations were for exceeding
Total Phosphorus limitations. Technical Review Criteria was exceeded in
that 33 of Phosphorus samples were 1.4 times the Permit limit.
January -June 2023: Utz Quality Foods: Violations were for exceeding Total
Phosphorus, Silver and Copper. TRC Criteria was exceeded for all three
parameters. Utz Snacks is under a Consent Order to add treatment
` capabilities to further reduce these pollutants.

CONSENT ORDER AND COMPLIANCE SCHEDULE (revised 2/01/2024) Rev. 3
Pursuant to provisions of the Sewer Use Ordinance and the Industrial wastewater Pretreatment
Ordinances of the City of Kings Mountain, this Consent Order (Rev. 3) is made effective the 1st day of
February 2024, between Utz Quality Foods, LLC_ and the City of Kings Mountain.
Utz Quality Foods, LLC. and The City of Kings Mountain hereby stipulate and agree as follows:
1. Utz Quality Foods, LLC. holds City of Kings Mountain Pretreatment Permit No. 037
(hereinafter the "Permit", which shall refer to Utz Quality Foods, LLC. existing permit and
any subsequent renewals or modifications thereof) for the operations and regulations of ALL
discharges into the City's Collection System.
2. Achievement of these requirements will require resolution of existing problems in the present
treatment train and possibly, development of alternative solutions to alleviate noncompliance,
including but not limited to the construction of additional pretreatment facilities as well as the
preparation of plans and specifications as necessary.
3. Utz Quality Foods, LLC_ hereby agrees to do and perform all of the following:
a. Meet and comply with all terms and conditions of the Permit (except as modified by the
Order) provided, however, subject to the terms and conditions of the Consent Order, the
following shall apply:

b. Unless and until Compliance is achieved, Utz Quality Foods, LLC. will undertake activities
necessary to bring the Utz Quality Foods, LLC. into Compliance in accordance with the
following schedule:

c. Utz Quality Foods, LLC, shall perform each of the activities set forth in subparagraph (b) on
or before the dates established thereby unless such dates are extended by agreement of Utz
Quality Foods, LLC. and the City of Kings Mountain may request such extensions for good
cause, and the City will not unreasonably withhold its consent to such extensions.
d. Utz Quality Foods, LLC. shall submit a comprehensive written report for item (i) of
subparagraph (b) by or on the date specified above. The reports shall be in narrative form,
shall state in detail the activities undertaken since the last report to achieve compliance, and
shall indicate whether Utz Quality Foods, LLC. has met the due date for the relevant
milestone established in this Consent Order. If any report contains notice of failure to meet a
milestone date, the report shall also include a statement explaining the cause of the failure,
any remedial actions taken, and the probability of meeting the next milestone.
All reports required by the Consent Order shall be submitted to the City by Certified Mail,
Return Receipt Requested, addressed to

e. Assessment of Civil Penalty detailed below: Entered into this 1st day of February, 2024 and will become effective upon signature of both parties
(i) The City of Kings Mountain has assessed a Civil Penalty on January 6, 2023 for failing to (Utz Quality Foods, LLC. and The City of Kings Mountain)
submit the October 2022 monitoring report, in the amount of $500.
Utz Quality Foods, LLC. shall notify the City of any time limits are exceeded for the
parameters mentioned in 3(a) for the duration of time mentioned in item of subparagraph (b).
Any violation of the terms of this Consent Order shall subject Utz Quality Foods, LLC.to the
enforcement authority outlined in the Ordinance. Such action may include, but is not limited to
such fines, penalties and assessments as may be set forth in the Code of Ordinance of the
City of Kings Mountain, as amended from time to time.
In lieu of other penalties, the following stipulated penalties shall apply for violations of Utz
Quality Foods, LLC.'s limits or failure to meet a milestone date under this Consent Order, or
failure to achieve full compliance with Consent Order.

g. Once Compliance is achieved, this Consent Order shall terminate and all obligations
hereunder except any obligation to pay identified moneys to the City shall expire. Upon
termination of this Order, Utz Quality Foods, LLC. shall be subject to all terms of the Permit.
In the performance of the activities herein ordered to be done and performed, Utz Quality
Foods, LLC. must otherwise follow the applicable procedures, rules, regulations, ordinances,
and law of the City, the State and the Federal government. Nothing contained herein shall be
construed as a waiver thereof by the City.

I am writing to document the agreement reached during this morning's meeting between the City of
Kings Mountain (the "City') and CORMETECH regarding the limits for our wastewater pretreatment
permit. We agreed that the Permit limits in the most recent Permit modification dated November 7,
2023, as outlined in the table below, will remain effective until June 1, 2024.

CORMETECH will utilize the time between now and June 1, 2024, to consult with wastewater experts
and vendors to evaluate processes and/or chemical treatment additives that may facilitate the lowering
of the Permit limit for molybdenum. CORMETECH will update the City on this work as it progresses.
Unless otherwise impacted by the outcome of our evaluations, CORMETECH will agree to the
following effective June 1, 2024.
• Reduction of permitted discharge flow from 125,000 to 90,000 gallons per day.
• Maintenance of molybdenum and arsenic discharge limits as mass -based limits.
• Reduction of permitted molybdenum limit from 125 to 90 pounds per day.
• Maintenance of permitted arsenic limit at 3.2 pounds per day.
