This report is being issued as a Notice of Violation due to the City's failures to properly implementthe Pretreatment Program, violations of North Carolina General Statute (G.S.) 143-215.1, ISA North Carolina Administrative Code (NCAC) 2H .0905, and the subject NPDES Permit. Specifically, the City failed to initiate enforcement within thirty (30) days as stipulated in the Division approved Enforcement Response Plan (ERP) on C VG for limit and reporting violations and KMI for reporting violations during the second half of 2019. In addition, the City failed to adhere to all of the IUP sampling methods during both semi-annual monitoring periods at Cormetech in 2019. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-2IS. 1. It is requested that a written response be submitted to this Office by March 6, 2020. addressing the City's actions to prevent the recurrence of these violations. CONSENT ORDER AND COMPLIANCE SCHEDULE (revised 2/01/2024) Rev. 3 Pursuant to provisions of the Sewer Use Ordinance and the Industrial wastewater Pretreatment Ordinances of the City of Kings Mountain, this Consent Order (Rev. 3) is made effective the 1st day of February 2024, between Utz Quality Foods, LLC_ and the City of Kings Mountain. Utz Quality Foods, LLC. and The City of Kings Mountain hereby stipulate and agree as follows: 1. Utz Quality Foods, LLC. holds City of Kings Mountain Pretreatment Permit No. 037 (hereinafter the "Permit", which shall refer to Utz Quality Foods, LLC. existing permit and any subsequent renewals or modifications thereof) for the operations and regulations of ALL discharges into the City's Collection System. 2. Achievement of these requirements will require resolution of existing problems in the present treatment train and possibly, development of alternative solutions to alleviate noncompliance, including but not limited to the construction of additional pretreatment facilities as well as the preparation of plans and specifications as necessary. 3. Utz Quality Foods, LLC_ hereby agrees to do and perform all of the following: a. (v) Continue consent monitoring frequency of twice a August 13, 2023- week with permitted limits to ensure compliance. December 31, 2023 (vi) SOC limits expire- New Permit will be in effect. June 30, 2024 (vii) Achieve compliance with final (IUP #031), with all June 30, 2024 requirements in Permit No. 031. c. Utz Quality Foods, LLC, shall perform each of the activities set forth in subparagraph (b) on or before the dates established thereby unless such dates are extended by agreement of Utz Quality Foods, LLC. and the City of Kings Mountain may request such extensions for good cause, and the City will not unreasonably withhold its consent to such extensions. d. Utz Quality Foods, LLC. shall submit a comprehensive written report for item (i) of subparagraph (b) by or on the date specified above. The reports shall be in narrative form, shall state in detail the activities undertaken since the last report to achieve compliance, and shall indicate whether Utz Quality Foods, LLC. has met the due date for the relevant milestone established in this Consent Order. If any report contains notice of failure to meet a milestone date, the report shall also include a statement explaining the cause of the failure, any remedial actions taken, and the probability of meeting the next milestone. All reports required by the Consent Order shall be submitted to the City by Certified Mail, Return Receipt Requested, addressed to Utz Revised SOC Order e. Utz Quality Foods, LLC. shall notify the City of any time limits are exceeded for the parameters mentioned in 3(a) for the duration of time mentioned in item of subparagraph (b). Any violation of the terms of this Consent Order shall subject Utz Quality Foods, LLC.to the enforcement authority outlined in the Ordinance. Such action may include, but is not limited to such fines, penalties and assessments as may be set forth in the Code of Ordinance of the City of Kings Mountain, as amended from time to time. In lieu of other penalties, the following stipulated penalties shall apply for violations of Utz Quality Foods, LLC.'s limits or failure to meet a milestone date under this Consent Order, or failure to achieve full compliance with Consent Order. Unless otherwise impacted by the outcome of our evaluations, CORMETECH will agree to the following effective June 1, 2024. • Reduction of permitted discharge flow from 125,000 to 90,000 gallons per day. • Maintenance of molybdenum and arsenic discharge limits as mass -based limits. • Reduction of permitted molybdenum limit from 125 to 90 pounds per day. • Maintenance of permitted arsenic limit at 3.2 pounds per day.
