Dear Mr. Norman:
Division personnel have reviewed and approved your application for a permit modification
received on June 13, 2007. You requested that the monitoring frequency for Fecal Coliform, during the
summer months, be changed from daily to weekly monitoring. The Division agrees with this request and
has modified the permit accordingly. We are forwarding the attached NPDES discharge permit effluent
page with the requested change. You should replace your existing effluent page from your
current permit with this modified effluent page. This permit modification is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required. If you have any questions concerning this

Per your memo received in this Office on June 27, 2007, this Office has reviewed the request
from Mr. Dale Norman, Board Member, Lake Norman Woods Homeowners Association
(LNWHOA) regarding a change in the subject facilities effluent monitoring for fecal coliform
during the summer months (April through October) from daily to weekly. Mr. Norman indicated in
his request that it was a significant financial burden for the LNWHOA to collect the additional fecal
coliform samples when analytical testing over the past 5 years has not provided sufficient evidence
to support the need for the extra testing that was required in the most recent renewal of the subject
NPDES permit (only 4 fecal values exceeded the daily max limit in the past five years).
The LNWHOA (as well as 17 other owners of package WWT facilities discharging to Lake
Norman) were required to increase effluent fecal coliform monitoring beginning in 2000 as part of a
Division policy instituted to promote public confidence in the ability of these type plants to protect
WQ. This policy was created in part as a result of litigation between the Division and the Catawba
River Keeper of NPDES permit No. NC0074900. The decision of the ALJ (and later the NPDES
Committee) forced the Division to develop a policy that involves a more proactive stance towards
demonstrating effluent quality for facilities discharging into Class B waters during the months when
frequent bodily contact is expected. In a Division memo dated October 19, 2001 from Mike Myers
to Coleen Sullins, an evaluation was made of this new "policy" and its potential effect on the 18
affected Lake Norman dischargers. The minimum anticipated increase for each facility to conduct
the additional fecal monitoring was estimated to be = $6650 a year. This additional cost could be
absorbed by the larger utility companies who have the ability to pass these costs on to their
customers through rate increases, but for smaller facilities such the the 16-home LNWHOA, this can
be a significant expense. The October 19" memo also recommended that this policy be reevaluated
periodically and modifications made, if necessary.

Recommendations
The policy utilized to establish the increased fecal coliform monitoring was not based on
scientific evidence, but rather in response to a court decision that forced the Division to develop
ways to address public concern over the impact of these package WWTPs and the associated
recreational activities taking place in the receiving waters. The staff of this Office is unaware of
any analytical data presented to -date documenting a relationship between any package WWTP and
high fecal coliform levels in Class B waters. Furthermore, should elevated fecal coliform levels be
found in Class B water supply reservoirs (such as Lake Norman), the sources of the contamination
are far more likely to be failing septic systems, which dominate Lake Norman's shoreline, rather
than from any of the discharges from the small number of package WWTPs discharging directly to
the mainstem of the Catawba River. Such being the case, we recommend that the request to reduce
effluent fecal coliform monitoring from daily to weekly during the summer months be approved.

Dear Mr. Guerra:
As we discussed, Lake Norman Woods Homeowners Association owns a package
wastewater treatment plant located in Catawba County. The plant was built in 1987 to
serve a proposed development of 66 lots but later that was scaled back to only 35 lots.
We currently have 16 occupied homes and 4 under construction.
Presently, Statesville Analytical conducts our DMR testing and daily operation at the
plant. Our previous NPDES permit required our operator to test weekly for fecal
coliform and our August 1, 2005 renewal now requires daily fecal coliform testing during
the period April 15t until October 31 st. The cost involved with additional testing has
placed a tremendous financial burden on the homeowners association. We maintain the
plant with the uppermost standards and have experienced no major violations or spills. I
have included our fecal count test results from January 4, 2002 to May 27, 2007 for your
review. I am requesting a revision to our current permit by returning our permit
requirement to weekly fecal coliform testing on a year round basis. We will appreciate
