Notice of Violation PAR Pretreatment Annual Report POTIN' Publiclt Owned Treatment Works SIU Significant Industrial User Metropolitan Sewerage District of Buncombe County (MSD) NPDES Permit # NCO024911 Arcadia Farms LLC (5-078) Arcadia Farms LLC was issued six (6) Notices of Violations. During the first half of the year, Arcadia was issued three (3) Notices of Violations with Civil Penalties totaling five thousand dollars ($5,000.00). MSD Pretreatment Staff and Arcadia Staff had a phone meeting on August 2, 2023, followed by a site visit and meeting on September 1, 2023. MSD agreed to continue to issue Notices of Violations but hold the fines with two conditions. Arcadia was not to be in SNC and Arcadia was required to invest in either the mixing/filling of the or pretreatment to prevent continued violations. product Arcadia is working with Chrones Group and has committed nine million dollars ($9,000,000) to upgrading the mixing room. This project will greatly reduce the amount of product to the drain which will reduce the BOD. Included in the project is automation of the process, a new CIP skid, and silos to eliminate product to the drain at the end of production runs. Arcadia has hired a new EHS Manager. An Authorization to Construct was not necessary as the project is in the production area not pretreatment. Asheville Metal Finishing (S-003) Asheville Metal Finishing had a significant decrease in production and discharge days. Therefore, Asheville Metal Finishing did not sample as frequently as listed in the permit. Asheville Metal Finishing contacted MSD about the less frequent discharges. MSD informed Asheville Metal Finishing that they were not required to pull samples if they were not discharging. The permit requires one day of sampling during each week there is flow leaving the facility currently discharging for two weeks most months. Asheville Paint and Powder (S-005) Asheville Metal Finishing is Asheville Paint and Powder had a significant decrease in production and therefore discharge. Asheville Paint and Powder had a Zinc Violation in July. They started processing a part for Amazon, which they found was being sent to them with a zinc coating. They stopped processing the part for Amazon and the results returned to normaI . At the time of the inspection, multiple items that have been brought up before were noted. The items are accessibility to the pretreatment area and safety for their staff as well as ours when conducting sampling and inspections. A Notice of Concern was issued. A response is included, and work will begin soon on the items listed. Clement Pappas NC, LLC (S-081) Although Clement Pappas was issued a permit in the second half of 2022 and expected to begin discharging industrial wastewater to MSD in March of 20230 they did not discharge until early 2024. They only discharged for a short period in early 2024 and MSD collected samples at that time. a Day International Inc. (S-057) Day international Inc. had a Toluene Violation during the month of January. The second sample in January was less than detection level. Linamar Light Metals - MR (S-076) MSD did not receive the June Self -Monitoring Report from Linamar Light Metals and conducted an Unannounced Site Visit on August 14, 2023. Multiple items were found during the Site Visit. A letter was issued which included the items noted during the Site Visit as well as a requirement for a meeting with MSD. MSD issued the letter along with three separate Notices of Violations and Civil Penalties totaling $11,500 on September 14, 2023. Linamar is in SNC for Late Reporting as well as Failure to Submit the TTO or complete the TTO statement for the first half of 2023. Multiple Site Visits were conducted during 2023. Great Improvements have been made and they are continuing to improve into 2024. I have also included the inspection form that was completed in October. Site Visits both announced and unannounced will continue. Milkco, Inc. (5-036) Milkco, Inc. was issued a Notice of Violation and Civil Penalty for an Unauthorized Discharge of milk to the sewer. The Civil Penalty totaled two thousand four hundred thirty dollars ($2,430), nine hundred thirty dollars ($930) of which is reimbursement for mobilization of MSD personnel. Milkco, Inc. was issued Notices of Violations for both MSD sampling events. Each of the sampling events conducted by MSD had BOD over the TRC limit. One NOV was issued for a Self -Monitoring BOD Violation in December. 19 New Belgium Brewing (S-075) New Belgium Brewing was issued several bypass authorizations while they worked to clean their membrane filters. Prince Manufacturing [S-065) Prince Manufacturing had two Zinc results greater than 3ppm above the permitted limit. Prince failed to submit the required samples to the laboratory within a timely manner and was required to submit a report for the Zinc Violations as well as the failure to submit the samples to the laboratory. Prince failed to submit the reports and was issued another Notice of Violation for Failure to Respond. Prince received a Notice of Violation for Failure to Complete TTO Requirements during the first half of the year. The same concerns were noted during the most recent inspection on November 7, 2023. SIU Permit #S-005, requires Asheville Paint and Powder to properly operate and maintain the pretreatment facility as well as proper chemical storage. The building access is a hole which has been demolished out of a concrete wall. There are no steps down into the building, which is at least a two -foot drop. A trench is dug through the room without a grate to keep personnel from falling or tripping. There is a lack of adequate lighting, and an old ladder to access the tanks. A light has been added to the room since the previous inspection, however you must cross the room to access the switch. There is also no door to keep anyone or anything from entering the pretreatment area. The pretreatment room meets the Occupational Safety and Health Administration's (OSHA) definition of a confined space as listed below. Certain requirements must be met each time someone enters a confined space as well as the employees must be certified to enter confined spaces. • confined space: A space that has limited or restricted means of entry, is not designed for continuous occupancy, and is large enough and configured so that a person can enter the space and maneuver well enough to perform tasks. Because it is not practical to implement confined space requirements every time someone must enter the pretreatment area; MSD is requiring Asheville Paint and Powder to complete repairs of the pretreatment area. Previous emails notified Metropolitan Sewerage District (MSD) that two EHS department employees had resigned for other employment, MSD has concerns as to who is now responsible for operating and maintaining the wastewater treatment system at Linamar Light Metals, Generation Efficiency (Leff) has been contracted since the design of the facility and installation of the Vacudest System and accompanying equipment. Geff provides equipment service each year and delivers certain data each month to the EHS team at Linamar, Geff has previously worked with Linamar Light Metals to troubleshoot any issues and help with the calculations for the permits. During the initial meeting with Linamar Light Metals, it became apparent that multiple items were not properly maintained. The importance oFlzeeping up the contract with Geff and having an operator was stressed to upper management. During the month of May 2023, at least two of the Linamar Light Metals EHS staff resigned fz•ozn the company for other employment. Bergeron Preri•eahnent Coordinator October 11, 2023 Shannon Bergeron Metropolitan Sewage District of Buncombe County 2028 Riverside Drive Asheville, NC, 28804 RE: NBB Temporary Bypass Dear Shannon Bergeron, NEW BELGIUM,: BREWING During the annual pretreatment inspection on 04/27/2023, NBB inquired about the feasibility of a short term low level bypass to aid production until the new membranes were installed in the MBR. Since then, NBB has been working through the process and determining proper operations should this bypass be needed. Since the inspection, the plant has been operating quite well with little to no issues. The plant has also been able to handle the load from the brewery during the high production times, and the use of the membrane magic chemical to assist with membrane filtering has helped greatly. So it doesn't appear as though the bypass will be needed from now until when the new membranes are installed. However, if something comes up over the next 6 months, I would like the have the information regarding the bypass reviewed and approved. The reason for the bypass would be to help manage the higher flows from the brewery until the new membranes are installed. At times, NBB has experienced influent feed at a rate higher than the permeate discharge rate. Historically, high trans -membrane pressures (TMPs) in the MBR have contributed to the lower permeate discharge rate. The bypass process is similar to the one approved by MSD on 03/19/23 when a small amount of wastewater from the EQ basin was mixed with treated effluent at the final outlet. This bypass amount did not put NBB anywhere close to the effluent permit limits, raising BOD levels to 200-600 mg/I. This bypass process is relatively straightforward and involves very little work by NBB personnel. To activate the bypass, the bypass valve from the EQ->CSTR feed line is opened. Behind this valve is a 0.5" orifice, which reduces the flow of the bypass to 25 gal/min. This pipe is then tied to the permeate discharge line, which discharges to the final outlet. The activation of this bypass valve is done through the HMI only by PWTP personnel. A timer is activated on the bypass for 8 hours, at which time the valve will revert to the closed position.
