On behalf of Standard Pacific Homes, Raleigh we are requesting authorization from the USACE to
use NWP 29 for 0.04 acres of permanent wetland impacts, 136 if of permanent stream impacts, and
21 if of temporary stream impacts for construction of the proposed project. We are also requesting a
401 WQC from NCDWR for the above referenced impacts.
The project is ±27.44 acres in size and is located at 242o High House Road, east of the intersection
of NC Highway 55 and High House Road in Cary, Wake County (Latitude: 35.789754 °N; Longitude: -
78•867037 °W)• The project is located in the Cape Fear River basin and onsite waters drain to
Batchelor Branch. The Water Quality Classification for Batchelor Branch is WS -IV; NSW and the
Stream Index Number is: 16- 41 -6 -2. The cataloging unit forthe site is 03030002.
Proposed Proiect
The purpose of the proposed project is to construct a single- family residential subdivision to meet
the growing demand for housing in Cary. The proposed project consists of the construction of a 61-
lot subdivision and associated infrastructure (i.e. roads, utilities, stormwater management
components, etc.).
Project History
Onsite streams and wetlands were delineated by Withers and Ravenel in December 2013 and March
2015. An email providing concurrence of the delineation was issued by David Shaeffer of the USACE
on June 12, 2015 (SAW - 2015 - 01041). A copy of this email is provided as an attachment with this
submittal. We are requesting issuance of the Preliminary JD in conjunction with issuance of the NWP
29.

A stream buffer determination letter was issued by Eric Kulz of the Town of Cary on October 5, 2015
(TCRB 15 -004). Impacts to riparian buffers will be authorized through the Town of Cary as the
delegated authority. A copy of this letter is provided as an attachment with this submittal.
Proposed Impacts
The proposed impacts consist of 0.4 acres of permanent wetland impacts, 136 if of permanent
stream impacts, and 21 if of temporary stream impacts.
The proposed 0.4 acres of permanent wetland impacts (Impact #5, Map C) will occur from the
installation of stabilization fill for required sanitary sewer and storm sewer lines and associated
maintenance corridors. Due to topographic restraints, these lines must be placed in fill to provide
stabilization and necessary relief, subsurface protection, and maintenance access.
The proposed 136 if of permanent stream impact will occur from installation of a main thoroughfare
road throughout the project. The impacts will occur in two separate locations. Impact #2 will occur
from installation of a 79 if culverted perpendicular crossing. Impact #6 will occur from perpendicular
road construction at the uppermost reach of the stream. Impacts #1, #3 and #7 are temporary
impacts (21 if total) associated with the road construction, and will be restored to natural grade and
profile following construction.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and `waters' could be minimized through design.
Proposed permanent impacts have been minimized primarily to impacts necessary to construct a
road to access developable uplands, and impacts required for construction of necessary utilities.
Please note there are no proposed impacts for lot fill. Proposed crossings have been designed to
cross wetlands at the narrowest points where possible, and to cross streams at perpendicular
angles where possible.
Road 002 is a required thoroughfare, extending from an existing road connection on the western
property line to the eastern boundary, providing critical ingress and egress throughout the
development. The alignment of Road 002 is designed to provide access and avoid /minimize
impacts to streams and avoid /minimize impacts to wetlands where possible.
The construction of Road 002 will require two stream crossings. The westernmost crossing (Impacts
#1, #2, and #3; Stream & Wetland Impact Map A) is designed to cross the stream perpendicular.
Impact #2 will occur from installation of a 79 if culverted perpendicular crossing. Construction of the
crossing is also designed for rip rap stabilization armoring the banks, avoiding rip rap fill in the
stream channel. Impacts #1 and #3 are temporary impacts that will only be used if necessary to
temporarily divert the stream during culvert installation. These temporary impacts will be restored
to the original contours and elevation post- construction.
The crossing of Road 002 in the central portion of the project (Impacts #6 and #7; Stream & Wetland
Impact Map D) is designed to only impact the uppermost reach of the stream, reducing the total
impact footage to 57 if and avoiding a culverted crossing.

Impact #4 is non - electric utility crossings that will occur as a result of the installation of a sanitary
sewer aerial line. Impact #4 is not a stream or wet /and impact, but is shown for verification
purposes.
Impact #5 is a wetland impact only, necessary for the installation of stabilization fill for required
sanitary sewer and storm sewer lines and associated maintenance corridors. Due to topographic
restraints, these lines must be placed in fill to provide stabilization and necessary relief, as well as
maintenance access. The fill for these lines will impact the wetland area in the narrowest and
highest portion, minimizing the effect on overall wetland function. In addition, a culvert will be
installed perpendicular through the fill, allowing for a continued hydrologic connection between the
intermittent channel and non - impacted wetland upstream and the remaining wetland area
downstream. A rip rap dissipation pad will be installed at the outfall of the culvert, protecting the
downstream wetland from erosive velocities.
Mitigation
As a result of the permanent stream impacts being less than 150 If, and permanent wetland impacts
being less than o.10 acre, there is no proposed mitigation.
Stormwater Management Plan
The stormwater management plan consists of a wet detention pond designed for go% TSS removal.
The stormwater management plan will be reviewed by the Town of Cary, and will receive final
approval upon issuance of the 404/401 authorization.
The current request is for 0.04 acres of permanent wetland impacts, 136 if of permanent stream
impacts and 21 if of temporary stream impacts (see the attached maps and PCN for details).

W &R reviewed the NC Natural Heritage Program database, located at https: / /ncnhde .natureserve.org /content/map to
identify if there were any known occurrences of endangered species on or near the proposed project. The review of the
NHP data did not identify any occurrences of endangered species or critical habitat on the subject property or within 1.0
miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any
federally protected species known to occur in Wake County, except for the Northern Long Eared Bat.
Potential habitat for the northern Long -eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used
for roosting during the day. Since a large portion of the project area consists of mature forest over 3" DBH, there is
potential northern long eared bat habitat present. In an email from USFWS dated April 15, 2015, the USFWS has
specified that a project may result in an adverse effect on the NLEB if there will be cutting or destroying of mature forest
within 0.25 miles of an known roosting site, or if the project involves the cutting or destroying of known, occupied roost
trees during the pup season (June 1St — July 31St). The closest known active roost site is in Currituck County. Therefore,
the proposed project is not located within 0.25 miles of any known roost trees. Furthermore, clearing of mature forest
between June 1 st and July 31 st is not anticipated for construction of the proposed project. Therefore, W &R concludes that
the project "may affect, but is not likely to adversely affect" the northern long -eared bat.

This is to follow up with our site visit conducted May 21, 2015 at the High House Rd North Tract in Cary.
To recap, there were three streams and three wetlands located on -site. We verified the origin of each stream and
location of each wetland as follows:
* Stream 1 (Batchelor Branch), located along the northern portion of the property, is perennial coming onto the
property from the east;

* Stream 2, located in the central portion of the property, is intermittent starting at Flag S -1 and stops at Flag S -1A
(at the upper reach of Wetland B);
* Stream 3, located along the western portion of the property, is intermittent starting at Flag S -0, and confluences
with Stream 1 (Batchelor Branch);
* Wetland A is a small, linear riparian wetland located towards the eastern portion of the property, and is adjacent
and abutting to Stream 1;
* Wetland B is a larger wetland in the north central portion of the property, and encompasses the break of Stream 2
and is adjacent and abutting Stream 1;
Wetland C is a small, linear riparian wetland located west of Wetland B, and is adjacent and abutting Stream 1;
During the site visit, you concurred with each feature as flagged in the field.
As a follow up to our site visit, I have prepared the necessary Rapanos forms for the jurisdictional streams and wetlands,
and included these with this transmittal (both word and PDF formats). In addition, I have also attached a wetland
location exhibit showing the above - listed features. This exhibit reflects no changes from the original exhibit included
with the JD Request Packet.
Please review the attached delineation exhibit and provide an email response that the attached exhibit accurately
depicts the wetland delineation as approved during our May 21, 2015 site review.
