HomeMy WebLinkAboutApproved Mitigation Plan249 S&llwater Rd, Troutman NC No&ce of Buffer Viola&on response A@er buying 249 S&llwater Rd in May of 2023, we hired Rogers Construc&on LLC to clear the lot and take away the old trailer and trailer addi&on that were in buffer zone 2. This work was done by around the end of July 2023. In the mean&me, we also got rid of the garbage that the previous owners had le@ behind in the buffer zone 1 and 2. This consisted of, computer monitors and various electronic parts, car baPeries, heaps of scrap metal, car parts, etc. Most of this was near the shoreline and was likely affec&ng water quality as it roPed and leaked into the lake. We think that the condi&on of the buffer now is much bePer than where it was before we bought the property in May 2023 and the lake is benefi&ng from the cleaning that was done. The lot including buffer zones 1and 2 was completely infested with kudzu vines which had overtaken the lot. Most of the trees within the buffer zones had been killed or severely damaged by the kudzu vines. Once we had the trash removed from the buffer, we hired CuPer Landscaping to clean the brush, vines, and dead / fallen trees from the buffer. They ensured us that they only take what is allowed and handle all permiVng that is required. We shared details of this with Devynne Brown post being contacted about the viola&on. CuPer Landscaping representa&ve also reached out to Devynne to share details on what they did at the site. In order to get the 30’ buffer to a state that is compliant and acceptable, we are proposing to take the following ac&ons: 1. Silt fencing was placed on the lot on February 15th, 2024. 2. We have contracted with Dawson Landscaping to remove all remaining trash and debris from the area and level (without disturbing zone 1) to diffuse the water flow throughout the buffer. Once this is completed, 20 trees with a mix of Loblolly pine, maple, and American Hornbeam birch will be planted based on the aPached placement plan. 3. Post plan&ng of the trees, Dawson Landscaping will place natural mulch in the en&re 30’ buffer area. 4. Upon comple&on, we will no&fy Devynne and will also submit picture of the completed work and will do so every year for the proceeding 5 years from comple&ng to show the health and maintenance of the buffer and trees. Once this plan is approved and our shoreline stabiliza&on permit is issued, Lancaster Dock and Dredging will install the rip rap stone and complete the stabiliza&on work. As we have no control over the &ming of the approval from DEQ or the approval from Duke, it is hard to put a comple&on date on this, but we will work to compete the as soon as possible post all approvals to proceed. Lancaster has communicated they are ready to do the work as soon as the permit is fully approved. As observed by Devynne and Michael while on site at the lot, three trees that are under-washed will need to be removed as part of the shoreline stabiliza&on. Post the shoreline stabiliza&on work being completed by Lancaster, Dawson Landscaping will complete the above stated work withing 150 days.
