MOHR, PE — COO ONSLOW WATER AND SEWER AUTHORITY 228 GEORGETOWN ROAD JACKSONVILLE, NORTH CAROLINA 28540 Dear Mr. Mohr, NORTH CAROLINA Environmental Quality March 1, 2024 Subject: Permit No. WQ0029945 Summerhouse Wastewater Reclamation WWTP High -Rate Infiltration System Onslow County In response to your permit major modification request received on September 7, 2023, and subsequent additional information received on December 22, 2023, we are forwarding herewith Permit No. WQ0029945 dated March 1, 2024, to Onslow Water and Sewer Authority for the construction and operation of the proposed modifications, the continued operation and subsequent abandonment of select existing wastewater treatment facilities, and the continued operation of select existing wastewater treatment and high -rate infiltration facilities. Modifications to the subject permit are as follows: ➢ The Division has approved the proposed modifications to the existing wastewater treatment headworks, the replacement of the existing membrane bioreactor (MBR) and ultraviolet (UV) disinfection systems in Trains 1, 2, 3, and 4 with two standalone MBR tanks and two standalone UV disinfection channels, and the removal of the existing odor control facility. ➢ The Division has increased the permitted monthly average flow to 180,142 gallons per day (GPD) from 100,142 GPD. This is based on the partial Engineering Certification received on June 30, 2021, which certified the disposal capacity of Basin 1 to be 80,000 GPD. This permit is effective from the date of issuance through December 31, 2025, shall replace Permit No. WQ0029945 issued on January 23, 2020, and is subject to the conditions and limitations therein. The Permittee shall submit a renewal application no later than July 4, 2025. Please pay attention to the monitoring requirements listed in Attachments A and B for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information may result in future non-compliance. Mohr, PE March 1, 2024 Page 2 of 3 The Division has removed the following permit condition since the last permit issuance dated January 23, 2020: ➢ Old Condition 1.1 — The Division has removed this condition because the Permittee has completed this Compliance Schedule. ➢ Old Condition IL8 — The Division has removed this condition because the Permittee owns all infiltration sites. The following permit conditions are new or modified since the last permit issuance dated January 23, 2020: ➢ Condition 1.1 — Upon completion of construction and prior to operation of the permitted modifications, the Permittee shall submit an Engineering Certification from a North Carolina licensed Professional Engineer. The Permittee shall submit the Engineering Certification via the Non -Discharge online portal. ➢ Condition L3 — Prior to the operation of the modified facilities, the Permittee shall submit an amended Operation and Maintenance Plan. The Permittee shall submit the amended Operation and Maintenance Plan via the Non -Discharge online portal. ➢ Condition L4 — The Division has moved Old Condition VL5 from Section VI to Section I. ➢ Condition IL8 — The Division has revised the permitted setbacks to reflect the modified facility. ➢ Condition IIL6 — The Division has modified Old Condition IIL6 to include "The Permittee shall take caution to protect the integrity of the infiltrative area." ➢ Condition IIL14 — The Permittee shall provide and maintain on -site an automatically activated standby power source capable of powering all essential treatment units. If the Permittee employs a generator as an alternate power supply, the Permittee shall test it weekly. ➢ Conditions IIL16, IV.6, IV.9, IV.10, and V.2 — The Division has modified the recordkeeping duration in Old Conditions IIL15, IV.6, IV.9, IV.10, and V.2 from five years to eight years because the next permit renewal will be for eight years per 15A NCAC 02T .0111(e). ➢ Condition IV.2 — The Division has modified Old Condition IV.2 to include "Parameters measured on -site with in -line metering equipment are exempt from a Division -certified laboratory analysis." ➢ Conditions IV.5.e and IV.5.f — The Division has modified Old Condition IV.5.e to specify both "Continuous weekly, monthly, and year-to-date hydraulic (inches/acres) loadings." and "Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically limited in Attachment B." ➢ Condition IV.10.e —The Division has modified Old Condition IV.10 to include the "Date and results of the alternate power supply testing." in the maintenance log. ➢ Condition V1.10 —The Permittee shall pay an annual fee for each year of the term of this permit pursuant to the schedule in G.S. 143-215.31)(a). The Permittee shall continue to pay annual fees for any facility operating on an expired permit that the Division has not rescinded or revoked. Mr. David M. a backflow preventer and connection to a potable water line on Twining Rose Lane to serve the facility's non -potable water needs; an influent flowmeter measuring flow from the Kings Creek Crossing Pump Station and the Summerhouse Drive Pump Station within the Summerhouse development; four 530 gallon per minute (GPM) feed -forward pumps (and two uninstalled spares) moving wastewater from the four individual 4,000 gallon coarse -bubble aeration basins (to be repurposed from four 4,000 gallon membrane tanks upon certification of the modified facility) to the four individual 10,347 gallon chambers making up the two 20,695 gallon membrane bioreactor (MBR) tanks; four 399 cubic feet per minute (CFM) process air blowers (and one uninstalled spare) serving the four existing 27,000 gallon fine - bubble aeration basins and the four repurposed 4,000 gallon coarse -bubble aeration basins; two 20,695 gallon MBR tanks (with two 10,347 gallon chambers per tank) each consisting of two 193 GPM permeate pumps (and one installed spare), a flowmeter, six 48.9 GPM stacks of thirty microfiltration modules, a 399 CFM scour air blower (and one installed spare), two 530 GPM return activated sludge (RAS) pumps serving two of the four existing 13,000 gallon anoxic basins; a Micro-C supplemental carbon feed system located in the on -site chemical building; two 5,280 gallon per hour (GPH) BioStrainer® side stream filtration units (to be installed if the modified facility has issues with fats, oils, and grease); two ultraviolet (UV) disinfection channels each with a dedicated and standby bank of 16 lamps; two turbidimeters (one to monitor the effluent from Trains 1 and 2 and one to monitor the effluent from Trains 3 and 4); and all associated piping, valves, controls, and appurtenances; the continued operation and subsequent abandonment of the following existing wastewater treatment facilities: two mechanical fine screens with 5 min openings; two 211 gallon hydropneumatic tanks; a 26 GPM non - potable water pump located in the effluent pump station serving the headworks system; four drum screens with 2 min openings; a 151 GPM permeate pump, a flowmeter, four stacks of ten 15 gallon per day per square foot (GPD/ft2) microfiltration modules, a Membrane Operating System 313 CFM blower serving each of the four 4,000 gallon membrane tanks (to be repurposed as coarse -bubble aeration basins upon certification of the modified facility); a 268 CFM blower serving the biological process aeration for the four 44,000 gallon MBR basins; four UV disinfection chambers each with two lamps; an odor control facility; a turbidimeter; and all associated piping, valves, controls, and appurtenances; the WQ0029945 Version 3.1 Shell Version 230725 Page 1 of 12 continued operation of a wastewater treatment system consisting of. an auxiliary manual bar screen with one -inch spacings; a 2.4 million gallon per day (MGD) grit removal and dewatering system consisting of a Eutek HeadCell®, a GritCup'm, and a SpiraSnailTM; an influent flowmeter measuring flow from the Jenkins Street Pump Station; a 184,373 gallon aerated flow equalization basin with three 350 GPM variable - frequency drive pumps, two 315 CFM blowers, and a 6 hp mechanical mixer; a flow splitter box; four 44,000 gallon MBR basins (Trains 1, 2, 3, and 4) each consisting of a 13,000 gallon anoxic basin with a 486 GPM recirculation pump, a mechanical mixer, and a flowmeter, a 27,000 gallon fine -bubble aeration basin, a 4,000 gallon membrane tank (to be repurposed as a coarse -bubble aeration basin upon certification of the modified facility) with a 576 GPM mixed liquor suspended solids/waste activated sludge (MLSS/WAS) pump, a chemical clean -in -place (CIP) system consisting of a sodium hypochlorite feed system and a citric acid feed system located in the on -site chemical building; two 129,400 gallon aerobic digesters with a 300 GPM sludge pump, two 6 hp mechanical mixers, and three 460 CFM blowers; a back- up sodium hypochlorite feed and storage system for maintaining a chlorine residual and a total residual chlorine analyzer for monitoring and controlling residual chlorine concentrations; an automatically activated standby generator; an effluent flowmeter; and all associated piping, valves, controls, and appurtenances; and the continued operation of a 180,142 GPD high -rate infiltration system consisting of. a 9,547 gallon effluent pump station with duplex 400 GPM pumps and audible/visual high-water alarms; an on -site non -potable water hydropneumatic pressure maintenance system and distribution pipe network; an operator control building with an analytical laboratory; a 2.54 million gallon (MG) synthetically lined five-day upset pond; a 10.71 MG infiltration basin (Basin 1) with a 219,533 square foot (ft2) footprint; a 4.74 MG infiltration basin (Basin 2) with a 91,121 ft2 footprint; a groundwater control pump station with duplex 600 GPM pumps, audible/visual high-water alarms, and a flowmeter; a groundwater control pump station with duplex 300 GPM pumps, audible/visual high-water alarms, and a flowmeter; a 36 acre groundwater lowering effluent discharge pond (Spicer Lake); and all associated piping, valves, controls, and appurtenances to serve the Summerhouse Wastewater Reclamation WWTP, with no discharge of wastes to surface waters, pursuant to the application received on September 7, 2023, subsequent additional information received on December 22, 2023, and in conformity with the Division -approved plans and specifications considered a part of this permit. Please note that the Division has approved Alternative Design Criteria for the modified wastewater treatment facility pursuant to 15A NCAC 02T .0105(n). The Division has approved the following administrative code for Alternative Design Criteria: ➢ 15A NCAC 02T .0505(k) —The Permittee shall provide multiple pumps wherever pumps are used. The Permittee shall maintain two spare replacement feed -forward pumps on -site (one per MBR tank). This permit is effective from the date of issuance through December 31, 2025, shall replace Permit No. WQ0029945 issued on January 23, 2020, and is subject to the following conditions and limitations: WQ0029945 Version 3.1 Shell Version 230725 Page 2 of 12 I. SCHEDULES Upon completion of construction and prior to operation of the permitted modifications, the Permittee shall submit an Engineering Certification from a North Carolina licensed Professional Engineer certifying that the permitted facility has been constructed pursuant to G.S. 143-215.1, Administrative Code Title 15A Subchapter 02T, this permit, and the Division -approved plans and specifications. For phased and partially certified facilities, the Permittee shall retain the responsibility to track further construction approved under this permit and shall provide a final Engineering Certification upon project completion. The Permittee shall submit the Engineering Certification via the Non -Discharge online portal. [15A NCAC 02T .0116(a)] 2. The Permittee shall notify the Wilmington Regional Office, telephone number (910) 796-7215, at least two business days in advance of the initial operation of the constructed modifications so that the Division can conduct a startup inspection. [ 15A NCAC 02T .0108(b)(1)(A)1 3. Prior to the operation of the modified facilities, the Permittee shall submit an amended Operation and Maintenance Plan. The Permittee shall submit the amended Operation and Maintenance Plan via the Non -Discharge online portal. [15A NCAC 02T .0108(b)(1)(B), 02T .0707(a)1 4. If the permitted facilities change ownership or the Permittee changes its name, the Permittee shall submit a permit modification request on Division -approved forms within 90 days of the change of ownership. The Permittee shall comply with all terms and conditions of this permit until the Division transfers the permit to the successor -owner. [G.S. 143-215.I(d3)1 5. The Permittee shall request renewal of this permit on Division -approved forms no later than July 4, 2025. [15A NCAC 02T .0105(b), 02T .0109] IL PERFORMANCE STANDARDS The Permittee shall operate and maintain the subject wastewater treatment and high -rate infiltration facilities so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities do not perform as designed, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the infiltration areas to assimilate the effluent, the Permittee shall take immediate corrective actions, including Division - required actions, such as the construction of additional or replacement wastewater treatment or disposal facilities. [15A NCAC 02T .0108(b)(1)(A)1 2. This permit shall not relieve the Permittee of its responsibility for contravention of groundwater or surface water standards resulting from the operation of this facility. [15A NCAC 02T .0108(b)(1)(A)] 3. Effluent quality shall not exceed the limitations specified in Attachment A. [ 15A NCAC 02T .0705(b)] 4. The Permittee shall not infiltrate effluent in exceedance of the hydraulic rates specified in Attachment B. [ 15A NCAC 02T .0108(b)(1)(A)1 For high -rate infiltration sites originally permitted as reclaimed water irrigation fields prior to September 1, 2006, the Division has established the compliance and review boundaries at the property boundary. Any exceedance of groundwater standards at or beyond the compliance boundary shall require the Permittee to take corrective action. The Division shall note any Division -approved relocation of the compliance boundary in Attachment B. The Division shall consider multiple contiguous properties under common ownership and permitted for use as a disposal system as a single property regarding the determination of a compliance boundary. [15A NCAC 02H .0219(k)(1)(C)(i)(III), 02L .0106(e), 02L .0107(c), 02L .0107(fl, 02T .0105(h)] 6. The Permittee shall notify the Division of any sale or transfer of property affecting a compliance boundary (i.e., parcel subdivision). [15A NCAC 02L .0107(1)] WQ0029945 Version 3.1 Shell Version 230725 Page 3 of 12 7. The Permittee or any landowner who owns land within the compliance boundary shall not construct any water supply wells within the compliance boundary. [ 15A NCAC 02L .0107(i)] 8. The Permittee shall operate and maintain the permitted facilities pursuant to the following setbacks: a. The Division originally permitted the infiltration sites on May 23, 2006, with an application received on April 4, 2006. The setbacks for high -rate infiltration sites originally permitted or modified as a reclaimed water system with an application received from February 1, 1993, through August 31, 2006, are as follows (all distances in feet): i. Surface waters classified SA: 100 ii. Surface waters classified non -SA: 25 iii. Each water supply well: 100 iv. Each non -potable well: 10 [ 15A NCAC 02H .0219(k)] b. The Division originally permitted the 184,373 gallon aerated flow equalization basin, the four 2 mm drum screens (to be abandoned), the four 44,000 gallon MBR basins (to be partially abandoned), the two 129,400 gallon aerobic digesters, the four UV disinfection chambers (to be abandoned), and the 2.54 MG synthetically lined five-day upset pond on May 23, 2006, with an application received on April 4, 2006. The setbacks for treatment and storage units originally permitted or modified with an application received from February 1, 1993, through August 31, 2006, are as follows (all distances in feet): i. Each habitable residence or place of assembly under separate ownership: 1001 ii. Each private or public water supply source: 100 iii. Surface waters: 50 iv. Each well with exception of monitoring wells: 100 v. Each property line: 50 Z vi. Nitrification field: 20 Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. [ 15A NCAC 02H .0219(j)(5)] WQ0029945 Version 3.1 Shell Version 230725 Page 4 of 12 c. The Division originally permitted the two mechanical 5 mm fine screens, the auxiliary manual bar screen, and the grit removal and dewatering system on February 28, 2014, with an application received on November 22, 2013. The setbacks for treatment and storage units originally permitted or modified with an application received from September 1, 2006, through August 31, 2018, are as follows (all distances in feet): I. Each habitable residence or place of assembly under separate ownership: 100, ii. Each private or public water supply source: 100 iii. Surface waters: 50 iv. Each well with exception of monitoring wells: 100 v. Each property line: 50 ' Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. [ 15A NCAC 02T .0706(d)] d. The Division originally permitted the treatment and storage units, excluding those in Paragraphs b and c, on March 1, 2024, with an application received on September 7, 2023. The setbacks for treatment and storage units originally permitted or modified with an application received on or after September 1, 2018, are as follows (all distances in feet): I. Each habitable residence or place of assembly under separate ownership: 1001 ii. Each private or public water supply source: 100 iii. Surface waters: 50 iv. Each well with exception of monitoring wells: 100 v. Each property line: 50 2 1 Habitable residences or places of assembly under separate ownership constructed after the Division originally permitted or subsequently modified the facilities are exempt from this setback. 2 Setbacks to property lines are not applicable when the Permittee, or the entity from which the Permittee is leasing, owns both parcels separated by the property line. [ 15A NCAC 02T .0706(d), 02T .0706(fl, 02T .0706(g)] WQ0029945 Version 3.1 Shell Version 230725 Page 5 of 12 III. OPERATION AND MAINTENANCE 1. The Permittee shall operate and maintain the subject facilities as anon -discharge system. [15A NCAC 02T .0101] 2. The Permittee shall maintain an Operation and Maintenance Plan, which shall include: a. A description of the operation of the system in sufficient detail to show what operations are necessary for the system to function and who shall conduct the operations. b. A description of the anticipated maintenance of the system. c. Provisions for safety measures, including restriction of access to the site and equipment. d. Spill control provisions that include response to upsets and bypasses, including control, containment, and remediation; and contact information for personnel, emergency responders, and regulatory agencies. [ 15A NCAC 02T .0707(a)1 3. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, the Permittee shall designate and employ a certified Operator in Responsible Charge (ORC), and one or more certified operators as Back-up ORCs. The ORC or its Back-up shall operate and visit the facilities as required pursuant to 15A NCAC 08G .0204 and 08G .0205. [ 15A NCAC 02T .0117] 4. The Permittee shall test and calibrate the infiltration equipment once per permit cycle. [15A NCAC 02T .0707(d)1 5. The Permittee shall only infiltrate treated effluent from the Summerhouse Wastewater Reclamation WWTP onto the sites listed in Attachment B. [15A NCAC 02T .0701] 6. The Permittee shall not allow vehicles or heavy machinery on the infiltration area, except during equipment installation or maintenance activities. The Permittee shall take caution to protect the integrity of the infiltrative area. [ 15A NCAC 02T .0707(e)] 7. The Permittee shall prohibit public access to the wastewater treatment, storage, and infiltration facilities. [15A NCAC 02T .0705(p) 8. The Permittee shall dispose of or utilize generated residuals in a Division -approved manner. [15A NCAC 02T .0708, 02T .1101]. 9. The Permittee shall not divert or bypass untreated or partially treated wastewater from the subject facilities. [15A NCAC 02T .0705(i)] 10. The Permittee shall maintain a freeboard of not less than two feet in the two high -rate infiltration basins and the 2.54 MG synthetically lined five-day upset pond. [15A NCAC 02T .0705(c)] 11. The Permittee shall provide gauges to monitor freeboard levels in the two high -rate infiltration basins and the 2.54 MG synthetically lined five-day upset pond. These gauges shall have readily visible permanent markings, at inch or tenth of foot increments, indicating the following elevations: the maximum liquid level at the top of the temporary liquid storage volume, the minimum liquid level at the bottom of the temporary liquid storage volume, and the lowest point on top of the dam. The Permittee shall establish and maintain a protective vegetative cover on all berms, pipe runs, erosion control areas, surface water diversions, and earthen embankments (i.e., the outside toe of the embankment to the maximum allowable temporary storage elevation on the inside of the embankment). The Permittee shall remove all trees, shrubs, and other woody vegetation from earthen dikes and embankments. The Permittee shall keep all earthen embankments mowed or otherwise controlled and accessible. [ 15A NCAC 02T .0707(g)1 13. The Permittee shall test and calibrate metering equipment annually. [15A NCAC 02T .0707(d)] 14. The Permittee shall provide and maintain on -site an automatically activated standby power source capable of powering all essential treatment units. If the Permittee employs a generator as an alternate power supply, the Permittee shall test it weekly. [15A NCAC 02T .0705(k)] 15. If the effluent exceeds the limits for fecal coliform or turbidity, the Permittee shall route all effluent to the 2.54 MG synthetically lined five-day upset pond until the Permittee brings the effluent back into compliance. Prior to infiltration, the Permittee shall pump the wastewater in the 2.54 MG synthetically lined five-day upset pond to the treatment plant headworks for re -treatment or treat the effluent in the 2.54 MG synthetically lined five-day upset pond to the effluent standards in Attachment A. [15A NCAC 02T .0108(b)(1)(A)1 16. The Permittee shall clean the infiltration areas once per permit cycle to remove deposited materials that may impede the infiltration process. The Permittee shall maintain cleaning records at the facility for eight years and shall make them available to the Division upon request. Prior to each cleaning, the Permittee shall notify the Wilmington Regional Office, telephone number (910) 796-7215. [15A NCAC 02T .0707(h)] IV. MONITORING AND REPORTING 1. The Permittee shall conduct and report any Division -required monitoring, including the monitoring of groundwater, surface water or wetlands, waste, wastewater, residuals, soil, treatment processes, lagoon or storage ponds, and plant tissue, if necessary to evaluate this facility's impact on groundwater and surface water. [ 15A NCAC 02T .0108(c)1 2. A Division -certified laboratory shall conduct all analyses for the required parameters specified in Attachment A. Parameters measured on -site with in -line metering equipment are exempt from a Division -certified laboratory analysis. [15A NCAC 02H .0805] The Permittee shall continuously monitor flow through the treatment facility and report daily flow values on Form NDMR. Facilities with a permitted flow of less than 10,000 GPD may estimate its flow from water usage records provided the water source has a metering device. [15A NCAC 02T .0105 k , 02T .0108(c)1 4. The Permittee shall monitor the treated effluent at the frequencies and locations for the parameters specified in Attachment A. [ 15A NCAC 02T .0105(k), 02T .0108(c)] 5. The Permittee shall maintain records tracking the amount of effluent infiltrated, which shall include the following information for each infiltration site listed in Attachment B: a. Date of infiltration. b. Volume of effluent infiltrated. c. Site infiltrated. d. Length of site infiltration time. e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings. f Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically limited in Attachment B. g. The Permittee shall measure and record weekly to the nearest inch or tenth of a foot of freeboard (Le., the waste level to the lowest embankment elevation) in the two high -rate infiltration basins and the 2.54 MG synthetically lined five-day upset pond. The Permittee shall maintain the weekly freeboard records for eight years and shall make them available to the Division upon request. [ 15A NCAC 02T .0108(c)1 7. On or before the last day of the month following the previous month's sampling, the Permittee shall submit monitoring data (as specified in Conditions IV.3 and IVA) on Form NDMR for each PPI and operation and disposal records (as specified in Conditions IV.S and IV.6) on Form NDAR-2 for every site in Attachment B. If no activities occurred during the monitoring month, the Permittee shall still submit monitoring reports documenting the absence of the activity. The Permittee shall submit the reports via the Non -Discharge monitoring report portal_ [15A NCAC 02T .0105(1)] 8. Pursuant to G.S. 143-215.1C(a), the Permittee shall provide to its users and the Division an annual report summarizing the performance of the wastewater treatment and infiltration facility and the extent to which the facility has violated this permit, or federal or state laws, regulations, or rules related to the protection of water quality. The Permittee shall prepare this report on either a calendar or fiscal year basis and shall submit it no later than 60 days after the end of the calendar or fiscal year. The Permittee shall submit the annual report via the Non -Discharge online portal_ [G.S. 143-215.1C(a)] 9. The Permittee shall maintain records of all residuals removed from this facility. The Permittee shall maintain these records for eight years and shall make them available to the Division upon request. These records shall include: a. Name of the residuals hauler. b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality agreeing to accept the residuals. c. Residuals hauling date. d. Volume of residuals removed. The Permittee shall maintain this log for eight years and shall make it available to the Division upon request. This log shall include: a. Date of flow measurement device calibration. b. Date of infiltration equipment calibration. c. Visual observations of the plant and plant site. d. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections, cleanings, etc.). e. Date and results of the alternate power supply testing. f. Noncompliance Notification: The Permittee shall report to the Wilmington Regional Office, telephone number (910) 796-7215, within 24 hours of first knowledge of the following: a. Treatment of wastes abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, structural, etc.) that makes the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a discharge to surface waters. d. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations. e. Effluent breakout from the infiltration sites. Emergencies requiring reporting outside normal business hours shall call the Division's Emergency Response personnel at the telephone number (800) 858-0368. All noncompliance notifications shall file a written report to the Wilmington Regional Office within five days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to ensure the problem does not recur. [15A NCAC 02T .0108(b)(1)(A)1 V. INSPECTIONS 1. The Permittee shall perform inspections and maintenance to ensure proper operation of the wastewater treatment and infiltration facilities. 115A NCAC 02T .0707(i)1 2. The Permittee shall inspect the wastewater treatment and infiltration facilities to prevent malfunctions, facility deterioration, and operator errors that may result in discharges of wastes to the environment, threats to human health, or public nuisances. The Permittee shall maintain an inspection log that includes the date and time of inspection, observations made, and maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for eight years from the date of the inspection and shall make this log available to the Division upon request. [15A NCAC 02T .0707(i), 02T .0707(j)1 Division -authorized representatives may, upon presentation of credentials, enter and inspect any property, premises, or place related to the permitted wastewater treatment and infiltration facilities at any reasonable time for determining compliance with this permit. Division -authorized representatives may inspect or copy records maintained under the terms and conditions of this permit and may collect influent, treatment process water, effluent, residual, soil, plant tissue, groundwater, or surface water samples. This permit is effective only for the nature and volume of wastes described in the permit application and Division -approved plans and specifications. [G.S. 143-215.1(d)1 3. There are no variances to administrative codes or general statutes governing the construction or operation of the permitted facilities unless the Permittee specifically requested a variance in the application and the Division approved the variance as noted in this permit's facility description. This permit does not exempt the Permittee from complying with all statutes, rules, regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal) may require. Violation of any terms or conditions of this permit or 15A NCAC 02T. b. Obtaining a permit by misrepresentation or failure to disclose all relevant facts. c. The Permittee's refusal to allow authorized Department employees upon presentation of credentials: I. To enter the Permittee's premises where a system is located or where the Permittee keeps any Division -required records under the terms and conditions of this permit. ii. To have access to any permit -required documents and records. iii. To inspect any monitoring equipment or method as required in this permit. iv. To sample any pollutants. d. The Permittee's failure to pay the annual fee for administering and compliance monitoring. e. A Division determination that the conditions of this permit conflict with the North Carolina Administrative Code or General Statutes. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has been convicted of environmental crimes under G.S. 143-215.6B or under Federal law that would otherwise be prosecuted under G.S. 143-215.6B, and the Permittee or any parent, subsidiary, or other affiliate of the Permittee has abandoned or exhausted all appeals of this conviction. b. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has previously abandoned a wastewater treatment facility without properly closing the facility in accordance with its permit or 15A NCAC 02T. c. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid a civil penalty, and the Permittee or any parent, subsidiary, or other affiliate of the Permittee has abandoned or exhausted all appeals of this penalty. d. The Permittee or any parent, subsidiary, or other affiliate of the Permittee is currently not compliant with any compliance schedule in a permit, settlement agreement, or order. e. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid an annual fee pursuant to 15A NCAC 02T .0105(e)(2). [ 15A NCAC 02T .0120(b), 02T .0120(d)] 9.
