Director DWR # 20240303 Wilkes County Kevin Hining, Environmental Supervisor NCDOT Division 11 PO Box 250 North Wilkesboro, NC 28659 NORTH CAROLINA Environmental Quality March 1, 2024 Subject: REQUEST FOR ADDITIONAL INFORMATION NCDOT TIP# R-5759: NC 115 Widening, Wilkes County Dear Mr. Hining: On February 23, 2024, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is in need of additional information in order to complete processing. The application is on Hold, until all of the following information is received: 1. For linear transportation projects, NC DWR requires mitigation for permanent impacts to a perennial stream that equals to 300 linear feet or more. Stream SG (Sites 4 and 5) has permanent impacts that meet that threshold. Therefore, DWR requires a mitigation plan or coverage by the Division of Mitigation Services (DMS) for those impacts. 2. Site 4 Outlet: The pipe outlet at this site enters the stream at an extremely sharp angle. DWR has concerns about the velocity causing instability of the channel at this outlet. Has the NCDOT considered the possibility of using a junction box and pipe stub, in order to reach the channel at a more gradual angle, in order to assure a more stable flow? If not, does the NCDOT have calculations to show that the riprap outlet as proposed is enough to handle both the velocity and volume of this pipe outlet? The Division is concerned that the significant drainage area, strormwater plus flows of two perennial streams into this pipe system combined may be higher than the outlet protection can handle. 3. Site 4 Inlet: The stream at this site hits a sharp curve immediately before entering the pipe system. Has NCDOT considered adding bank stabilization to the curve at the inlet, in order to ensure stability here? 4. The permit plans set do not include the standard NCDOT Stormwater Management Plan (SMP). Please provide a copy of the SMP for our review. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending the above requested information to the Transportation Permitting Branch, by submitting all of the above requested information through this link: hgps:Hedocs.deq.nc.aov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
