RETURN OF APPLICATION
Dear Mr. Stronski:
On September 12, 2007, the Division of Water Quality (DWQ) received your After-the-Fact application dated
September 4; 2007, to fill or otherwise impact 255 linear feet of perennial stream, to construct the proposed
residential development. On October 10, 2007, the DWQ sent you a "Request For More Information" letter stating,
"Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to
me and to Lauren Cobb of the DWQ Raleigh Regional Office. If you will not be able to provide the requested
information within that timeframe, please provide written confirmation that you intend to provide the requested
information, and include a specific timetable delineating when the requested materials will be provided. If we do
not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will
consider the project as returned." Based on information received from your agent on November 9, 2007, it appears
that it may be some time before the requested information may be available and for these reasons your permit
application is hereby considered returned. Once you have redesigned your project to address. the problems and
inadequacies with your application as it was submitted, you will need to reapply for DWQ approval. This includes
submitting a complete application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any
work done within waters of the state would be a violation of North Carolina General tutes and Administrative
