This is the project/application that resulted in that site visit on Nov. 6, 2023, and the review of Alternative Buffer
Mitigation options. The project engineers have been working with the Town of Apex (TOA) and its new road
crossing design. The project engineer thought that the TOA was good with the updated road crossing design, but
now there are communications that they are not and they have to go through another round of TOA review and
comment. That should be going in soon, but the TOA has I think a month to review. This new application in the
system is a modification request of one stream crossing, that was previously approved in July 2022. Is it possible
for the NCDWR to put this application "on hold" for a few weeks until the road crossing plan is approved by the
TOA? We don't want to have to request another modification in the near future, so I was thinking since the
application hasn't been approved to date, that we may have a little time to get this resolved. Once resolved by the
project engineer and the Town, I will update the PCN to the updated impacts (if the TOA approves that design) and
get that back over to you for review and ultimate "anticipated" approval.
I have attached a comparison plan view for your reference, and I have copied the project engineer and the
applicant so that they can stay informed on this situation.
Also note that the application was submitted on 12/5/2023 so with regard to the Programmatic Agreement (PA)
between the USACE and the NCDWR, the RPOT, that should be 04/03/2024.
