Hi Kelsea,
It appears from your email and our conversation that the water will not be comingling with chemicals or waste, you have
completed a water withdrawal registration, and have a plan for sediments that accumulate in the tank.
The dewatering/return flow to the Neuse will need to be monitored and executed in a controlled manner that will not
cause a water quality standard violation, scouring, or erosive forces.
Nothing further should be required from our office, but if you find that a standard violation occurs or anticipated plans
change, please notify our office.

Pero ur phone conversation this morning and the em a it correspondence below from Ms. Amaya,
we are proposing the following:
Pump ingthe River Water from the Neu se River (We have completed the Water With drawa I Registration
with Mr.
Barr), into a Clean Tank, using this River Water to Pressure Test theta nk.
The water wi [[not come in contact with any Waste nor Chem ica Is, as mentioned this is for pressure
testing only.
We propose to discharge the water with sampling back into the Neuse River as follows:
Our Discharge will be at minimum 2 LF off of the bottom of the tank allowing any Sediment / Suspended
Solids to drop out.
The Discharge will be hard piped to the Neuse River and a 90 Degree Bend going back into the Flow of the
Neuse River, keeping the Discharge Outlet away from the banks and the bottom of the River to prevent
any Scouring / Erosion of the Banks and Turbidity from the bottom of the River.
This water will be sampled prior to beginning of the discharge and periodically throughout the process.
Upon completion, any Sediment / Suspended Solids that has dropped out in the bottom of the tank will
be treated as Sediment Removal from our EPSC measures onsite.
As mentioned, we are looking to Ensure that we do not need to get any additional permits or have any
additional requirements we need to meet prior to preforming this task, with your approval.

Good afternoon, Kelsea,
Thanks for reaching out! Sorry for the delayed response as I was out of the office the beginning of this week.
In summary, the project already has an approved E&SC plan and an NCG010000 Permit through our DEMLR Office so for
those permits you would just need to meet requirements to safely discharge the clean, uncontaminated water from the
site without causing erosion or sediment damage to the Nuese River or adjacent properties. Water quality standards will
need to be met before discharging back into the Neuse River.
Next, if you are withdrawing more than 100,000 gallons of surface water from the Neuse River, then you will need to
reach out directly to John Barr (919) 707-9021 to complete a Water Withdrawal Registration.
I received a response from the Division of Water Resources with the information below. Please note, they provided this
information without knowledge of the project specifics, so these are general considerations for the clewatering and
discharging activities that you proposed. My recommendation would be to reach out to Zach Thomas with the Division
of Water Resources directly at (919) 791-4255 to provide project specific information to ensure no additional permits or
inspections are needed from their team.

These items are select statues and rules that are potentialIV relevant to this activitV
0 15A NCAC 02H.0106 FILING APPLICATIONS
• (f) The following discharges are deemed to be permitted pursuant to G.S. 143-215.1(c) provided that no
water quality standards are contravened, or expected to be contravened, and it shall not be necessary
for the Division to issue separate permits for these activities:
0 (5) flushing and hydrostatic testing water associated with utility distribution systems;
• Note: If water has contact with waste, it shall remain subject to NPDES permit requirements until the
waste or residuals of concern are disposed in accordance with applicable standards:
15A NCAC 02H .0106 (g) A wastewater trea tmen t facility or treatment unit that is taken out of service
but contains waste or residuals that could be discharged to surface waters or otherwise present an
environmental or public health risk under foreseeable circumstances, including severe weather events,
shall remain subject to NPDES permit requirements until the waste or residuals of concern are disposed
in accordance with applicable standards and the permit is rescinded by the Director.
15A NCAC 0213.0200 — Water Quality Standards
0 Surface water quality standards require that conditions of waters be suitable for all best uses provided
for in state rule and that activities must not cause water pollution that precludes any best use on a
short-term or long-term basis. Ensuring that in -stream structures are installed properly will ensure that
conditions of waters are suitable for all best uses provided for in state rule.
0 Activities should not cause negative impacts on fish propagation, eggs/larval survival. Excessive silt and
sediment loads can have numerous detrimental effects on aquatic resources including destruction of
spawning habitat, suffocation of eggs, and clogging of gills of aquatic species.
DEMLR/Stormwater Permits
0 One acre or greater of land disturbance requires and erosion and sediment control plan from DEMLR
and compliance with the NDPES construction stormwater permit for construction (NCG010000.) Your
clewatering efforts will need to be complaint/consistent with these requisites as well. (if you have
question regarding land disturbance you should contact DEMLR at (919) 791-4200.)
Water Withdrawal Information/Registration

• North Carolina General Statute § 143-215.22H (15A NCAC 02E .0301) requires surface water and ground
water withdrawers who meet conditions established by the General Assembly to register their water
withdrawals and surface water transfers with the State and update those registrations at least every five
years. Agricultural water users that withdraw one million gallons of water a day or more and non-
agricultural water users that withdraw one hundred thousand gallons of water a day are required to
register. Administrative rules that became effective in March 2007 (15A NCAC 02E.0600) stipulate that
registrants must also report their water usage annually to the Department of Environmental Quality.

These items are heloful information on dewatering and recommendations for the facilitv to consider to avoid causing
otential standard violations:
0 Dewatering:
• Dewatering at high flow rates and at concentrated locations can cause severe stream bed scour causing
water quality impacts, turbidity, and sediment impacts.
• It is recommended that Dewatering hydrostatic test waters should be accomplished such that water
diffuse flows overland on soils that house well developed structure (not earthen fill), with well -
established thick vegetation cover. Water should be clewatered in such a manner as to avoid
concentrated flow, thereby avoiding velocities or sheer stresses that erodes, forms gullies or rills. These
efforts are intended to avoid clewatering in a manner that may result in turbidity violations and/or
sediment impacts to stream. Avoiding the high velocities and concentrated flow, will also avoid
streamside vegetation impacts and possible Neuse Riparian Buffer violations.
Duration and Timing of activity:
• Care should be taken with respect to water use volumes during low flow conditions. Large water volume
use could result in impacts to the stream, especially during extreme low flow conditions (consider this
especially during the hot growing season)
• Consideration should be given as to whether water to be clewatered (discharged back into the stream
channel) could cause a thermal pollution concern. (e.g. Is the water sitting in piping or confined open
basins that are heating up in the sun which may cause impacts to aquatic life if released.)

During the last inspection @ Sams Branch we discussed the next inspection occurring
in a couple of months, this of course was in December. I just wanted to check in and
