Dear Mr. Stogner:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit
is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
This facility is discharging total residual chlorine (TRC) at high levels. High TRC could be
contributing to toxicity in the stream. The Division urges AquaSource Utility, Inc. to
consider installation of dechlorination equipment at this facility. An acceptable level of TRC
in the effluent is 28 µg/L.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be
required.

Mr. Weaver,
Thank you for returning my call regarding NC WWTP permits. As discussed by
phone, I have received several WWTP permits (Listed below) formally issued
to Rayco Utility which are now issued to AquaSource, Inc. Unfortunately
these are incorrect. AquaSource, Inc. is a shareholders company does not
own any water and/or wastewater facilities. AquaSource Utility, Inc. is the
subsidiary company which actually purchased Rayco Utility. AquaSource
Utility, Inc. should be the listed permit holder/Owner for these facilities,
not AquaSource, Inc. As we desire to have all related paper work correct,
please issue a minor permit revision for the following permits correctly
listing AquaSource Utility, Inc. as the permit holder/owner. We are taking
steps on this end to prevent additional errors.

It should be noted that Quarry Hills NCO022446 is one of the effected
permits. However, a formal request was submitted to Mr. Shannon Langley of
the NCDENR on October 5, 2000 to rescind the NC permit as the facility is no
longer in service and is undergoing demolition. Any related flow has been
diverted to the Sweptsonville WWTP.

adequate land available for future expansion and upgrading.
8. Topography (relationship to flood plain included): The WWTP is within 50 feet of
Ramah Creek, but appears to be located at sufficient elevation for protection from a 100
year flood.
9. Location of Nearest Dwelling: A residence is within 400 feet of the WWTP. There is an
undeveloped lot next to the WWTP. During the site visit several new homes were under
construction.

waste stream (see recommendations in Part IV).

PART IV - EVALUATION AND RECOMMENDATIONS
The permittee has applied for permit renewal. The WWTP serves the Willowbrook
Subdivision in northern Mecklenberg County. There have been no substantial changes to the
WWTP since the last staff report.
The wastewater treatment system discharges to the headwaters of Ramah Creek. The
discharge point is within 2,000 feet of the transition from dotted to solid blue line on the subject
USGS topo map. As such, the base flow in the creek at the discharge point is fairly small
(uncertain of exact calculated flow because the projected 7Q10/30Q2 form is not in the MRO
,ZA file). During the field visit, Mr. Schwartz estimated that the effluent flow from the WWTP
c4L accounted for approximately 1/20 to 115 of the flow in the creek at the discharge point. The
WWTP most likely accounts for even more of the total creek flow during drought conditions.
The previous permits for this facility did not possess a limit for total residual chlorine (TRC).
Upon reviewing the DMRs for the facility, the effluent TRC levels have averaged 555 ug/l
during the previous 12 months including 1,400 ug/l during January 1999. These effluent levels
are 30 to 80 times the freshwater standard for chlorine (17 ug/1) as established in 15A NCAC 2B.
On account of the limited base creek flow, the present effluent TRC levels could impair

biological activity in Ramah Creek. This Office recommends that the effects of TRC on Ramah
Creek be evaluated and a limit for TRC be established (if necessary).
Upon evaluation of the impacts of TRC to Ramah Creek, this Office recommends that
the permit be renewed as requested.

Mr. Stogner now works as an employee of AquaSource in a role where he is closely involved in the
day to day operations but no longer serves in a capacity as a responsible party. He now reports
directly to our Regional Manager, Glenn LaBrecque. We believe Mr. Stogner will provide valuable
assistance in the position of industrial and construction manager. His knowledge of operations will
be utilized in coordinating the efforts of our operators.
We hope that your staff and particularly the regional staff will understand that it is optional whom
they choose to contact. However, we would hope that they would continue to contact Mr. Stogner or
others within the previous Rayco staff for the recurring and routine interactions that are a course of
normal day to day operations such as to coordinate an inspection, discuss a minor matter, or direct
questions. If for any reason your staff prefers, they may always directly contact Regional Manger
Glenn LaBrecque, or me.
We would expect that if there are any significant problems or concerns, any Notices of ViQlation, any
enforcement actions, or any other "official" communications, those would be addr ssedaiecy[o
