Hi Ginny,
I just finished discussing this project with Todd. We appreciate the review of the BMPs and we plan to defer to you guys
since BMPs are your area of expertise. Just to confirm, you have proposed a stability performance standard to be
determined by the IRT at closeout. I assume this is simply demonstrating that the structures are stable - no undermining
or loss of components. You have also proposed a vegetation performance standard for the constructed wetland (70%
survival of planted stems at year 5). Todd did not feel that we should require a performance standard related to water
quality for this project. Monitoring will be on an semi - annual basis and include vegetation (plots ?) - species and counts. I
believe I understood from our conversation last week that if they do not have sediment or other issues during the 5
years of monitoring, then the BMPs should not require long -term management? Smaller BMPs that represent a fraction
of an overall project are not as great a concern to the Corps as a large "stand- alone" BMP project so as long as they are
stable, we are not inclined to require long term monitoring /funding (30 years). However, your response indicated
annual monitoring after 5 years. Do you and Sue feel that long term monitoring on an annual basis should be required
for this project? We discussed adding a condition to the permit that makes them aware they could lose credits or be
required to extend monitoring if the BMPs do not perform as expected (issues with sediment, structures, vegetation).
Please let me know your thoughts.

Andrea,
I thought I had sent you this so this may be a second time. This is our counter response to DMS on the Browns Summit
project. The design of the BMP is acceptable. Some suggested adjustments on monitoring and success criteria of been
made. Not sure if you wanted to schedule a meeting with Jeff Schaeffer, I will be out of the office the last two weeks of
Oct. Sue should be involved too in any potential discussions with DMS. Let us know if you have any questions.
