Based on the results contained in that report, it appears the constituents found in the groundwater sample from the bore pit are below the 2L standards, except 1-Methylnapthylene. The result was 3.6 micrograms with the 2L groundwater standards at 1 microgram. There were no constituents found in the surface water samples from Mill Creek. The soil sample result, submitted as sample ‘B1-A, SS-17, 3’-5.5’, which contained 3800 mg/kg of diesel petroleum, appears to be a surface spill with no further migration into the groundwater or surface water. Based on the presented information, no stream impacts or exceedances of surface water standards are expected from the pumping and discharging of groundwater from the structure pits/shafts to Mill Creek. I have forwarded the report you sent me yesterday to Ron Taraban, Supervisor for the Division of Waste Management- UST Section, Mooresville Regional Office and Dan Graham, Hydrogeologist for Lincoln County. Based on the conversations I had with Mr. Taraban and Mr. Graham, I expect some limited involvement from their Section. Mr. Graham can be more clear with DWM’s specific expectations. It is my understanding he is going to issue a letter stating the need for proper soil disposal, which DOT was already planning. He is copied on this email for ease of communication. Mr. Taraban is the issuer for on-site soil remediation permits and is in this office. With the current information, and although this is a NW3 permit and no written concurrence is required, I would like to attend the precon as well as observe the groundwater discharge from any pits/shafts constructed on site. Please be advised that all contaminated soil must be properly disposed of and not stockpiled on site, either in the right of way or streamside. Please contact Mr. Taraban for an on-site disposal permit for the adjacent farm should that be the desired method of disposal. If the soil is to be hauled off and properly disposed of at another site, it must be stored in a leak proof container that ensures either no exposure to contact with stormwater or no discharge from contact with stormwater. Although it was included in the submittal that the contractor is responsible for any contaminated soil permits, please be advised that NC DOT is the permittee as pertains to the construction stormwater permit, ROW owner, and NCS000250 permit and therefore will be viewed as the responsible party by DWR should there be an illicit discharge of petroleum contaminated water to Mill Creek. 1 I am more than happy to spend any extra time required to aid DOT in site compliance regarding this site. Concerning the Johnstown Road bridge replacement, there will be at least one other agency involved—NC Division of Waste Management-Underground Storage Tank Section. They are in charge of underground petroleum contamination. I have not had a chance to talk with them in depth yet, so I would ask that you give me that chance before moving forward. I am on vacation today through next Tuesday, a staff meeting in Raleigh on next Wednesday, and return to the office next Thursday. The issues at this site could be several: source of the contaminated soil, removing contaminated soil, proper disposal of the soil, and pumping (and subsequent treatment and disposal) of any contaminated groundwater from the bridge installation. At this point, in my profession experience, the hardest problem to address is the potentially contaminated groundwater which cannot be discharged to the stream—unless a huge problem is unearthed as the source. Let me know if you need any other clarification. I will get back to you next Thursday. When you get a chance could you send me an email reiterating the problem and what other agencies might be involved in dealing with contaminated water being pumped out while constructing the bridge supports?
