The Division of Water Resources (DWR) received a draft Mitigation Plan (Plan) from Environmental
Banc & Exchange, LLC (EBX), for the Pantera Mitigation Site in 2023. Appendix A of the Plan was
the Nutrient Offset & Buffer Mitigation Plan (Buffer Plan) submitted to DWR for review and
approval under 15A NCAC 02B .0295 and 15A NCAC 02B .0703 to be used as buffer mitigation and
nutrient offset projects, respectively, under the terms and conditions of the Pantera Mitigation
Banking Instrument for Nutrient Offset and Riparian Buffer Credits (MBI). Effective February 26,
2024, the MBI was made and entered into by EBX acting as the Bank Sponsor, and the DWR. Katie
Merritt, with DWR, reviewed the draft Buffer Plan and MBI documents and provided comments and
recommendations. DWR received a revised Buffer Plan and MBI that addressed all comments and
recommendations. The table below summarizes the timeline of the Buffer Plan and MBI
