In response to your letter concerning the referenced facility,we have decided that the chronic
toxicity test performed by the facility in September 1989 at a concentration of 7% should be
accepted as a good faith effort by the facility to continue monitoring by the administrative letter in
effect prior to issuance of the permit. We agree that the first testing required by the permit should
be performed in December 1989.
To answer you specific questions on this matter, the following is offered:
Q-1. Given the above, was the permittee in error for conducting the test at an effluent
concentration of 7%
A-1. Ideally this should have been performed at the correct IWC of 4.7% although the facility
has the right to perform any additional monitoring not required by the permit.
Q-2. Should a second (consecutive) failure precipitate an NOV."
A-2. As we are accepting this as part of the administrative letter monitoring requirement
information, essentially before the presence of a pen -nit imitation, no. Should the test have been
performed correctly, under permit requirements, a second failure should instigate an NOV. If we
were to accept this test as submittal under permit limitation, it would have received a "bad test"
letter and required retesting within 30 days.
Q-3. Should the failure precipitate monthly monitoring?
A-3. As the September test is being accepted as an administrative letter data point we don't feel
that it should instigate required monthly testing, essentially prior to the existence of a permit
requirement
Q-4. If so, prior to December 1959?
A-4. See 3.
With regard to your comment on making a coordination in testing months on transition from a
letter requirement to a permit requirement or from quarterly to monthly, it is agreed that this
would be a helpful practice. I intend to discuss this with Tom Stockton to see if a logical way of

In accordance with your request for permit modification, the Division of Environmental
Management is forwarding herewith a modification to the subject permit. This modification is to
require monthly instead of weekly monitoring requirements for total chromium, sulfides, and
ammonia as nitrogen.
A revised effluent sheet is attached and should be inserted into your permit. The old
effluent sheet should be discarded.
All other terms and conditions contained in the original permit remain unchanged and in full
effect. This modification is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated December 6, 1983. This permit modification becomes
effective immediately.
If this decision is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be in the
form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North
Carolina, 27604. Unless such a demand is made, this decision shall be final and binding.

All stream samples shall be grab samples.
Daily stream sampling frequency may. be reduced at each sampling station to one time per week except during the
months of June, July, August, and September when the frequency must be no less that three times per week at each
sampling station.
** Daily means every day on which a wastewater discharge occurs except Saturdays, Sundays, and legal holidays.
*** The temperature of the effluent shall be such as not to cause an increase in the temperature of the receiving
stream of more that 2.8 Degrees C and in no case cause the ambient water temperature to exceed 32 Degrees C.

Dear Mr. Griggs:
I am writing in response to your letter of August 31 concern-
ing the NPDES permit monitoring frequencies for phenols, chromium,
sulfides, ammonia, total phosphorus, and total nitrogen. The data
you submitted indicate that the monitoring frequency for chromium,
sulfides, and ammonia can be reduced to monthly. However, the
monitoring frequency for phenols will remain as weekly. The
phenols data submitted for March, 1988 and July, 1989 indicated
concentrations of 30 ug/1 and 21 ug/1 respectively which are at or
above the permitted level of 21 ug/l.
The total nitrogen and total phosphorus monitoring require-
ments will remain as monthly. 15 NCAC 2B.0508(d)2(B) requires all
facilities in the Catawba River Basin which have a design capacity
greater than 1 mgd to monitor for these parameters monthly. In
addition, the receiving stream, South Fork of the Catawba River,
flows into Lake Wylie which the Division of Environmental Manage-
ment is currently monitoring for nutrient sensitivity. Therefore,
I will not reduce these monitoring requirements at this time.

Dear Mr. Wilms:
As expressed in your transmittal letter for the above referenced permit, I
am requsting a waiver or modification to the monitoring requirements. I am
enclosing a summary of data for each of the parameters from August 1987 thru
July 1989.
Specifically I request that analyses for phenols, chromium, sulfides and
ammonia - nitrogen be reduced from weekly to monthly. I also request that
total nitrogen and total phosphorous analyses be reduced from monthly to
quarterly.
If the analyses for any of these parameters should show a significant in-
crease we would increase the frequency of the analyses. My contention is
not to continue to look for low level values when history has shown them
not to be a problem.

Dear Mr. Griggs:
I am writing in response to your letter of July 6 concerning
your draft NPDES permit. Your comments are addressed by item as
follows:
(1) Monitoring Frequency
The instream conductivity monitoring requirement will
remain in the permit. Conductivity values help the State
evaluate the level of pollution instream. The sulfide, phe-
nols, chromium, and ammonia monitoring frequencies were det-
ermined from standard procedure for pollutants not listed in
the monitoring regulations. The company may request the
Division of Environmental Management (DEM) to reevaluate the
weekly monitoring frequency after one year of data have been
submitted. The State will consider changing the monitoring
frequency provided the data indicate that low levels of the
pollutants exist.
The total nitrogen and total phosphorus monitoring
requirements are needed per 15.NCAC 2B.0508 which requires
facilities in the Catawba River Basin to monitor these
nutrients monthly. Your particular receiving stream flows
into Lake Wylie which DEM is currently studying for its sen-
sitivity to nutrient inputs. Therefore, I will not modify
this requirement at this time.

Priority pollutant analyses must be performed annually
per DEM's administrative procedure that is applied to all
major NPDES permits.
(2) Phenols Limit
Per 15 NCAC 2B.0206, the flow used to set limits for
parameters which have a water quality standard is the 7Q10.

please contact Trevor Clements or Dale Overcash of my staff at

Dear Mr. Mouberry:
We have received and reviewed the draft permit for the Cramerton Plant of
JPS Automotive Products Corp. Several comments need to be made.
1. I have previously written Ms. Lulu Harris concerning the frequency of
sampling (copy attached) and again request that the original sampling
frequency be maintained and that conductivity be deleted. The requested
changes in the sampling frequencies are:

greater and a lessor harm would come to the stream.

I am enclosing the results of the priority pollutant analyses to complete the
NPDES application for the Cramerton plant.
The frequency of sampling in the draft permit for the Cramerton plant has

Enclosed are the results from the JPS Autoproducts, Cramerton Plant for your
requested parameters. Although we were to identify and quantify ten significant peaks
using a GC/MS library search, page five of the attached results lists only six compounds.
All of the tentatively identified compounds (TIC) reported are less than 10% of the nearest
internal standard. Therefore they do not qualify as TIC compounds by CLP requirements.
Quantitative analyses cannot be performed due to the trace levels of these compounds
which would give values of less than 4 ppb on all six compounds.
I am happy to inform you that I am serving as your Project Manager as of today. It is
