Brent, In your request to rescind those two NPDES permits, you cited 15A NCAC 02T .0113 Permitting by Regulation. Here is what is specified in T15A NCAC 02T .0113 (a)(18) Permitting By Regulation: (18) discharges to the land surface of less than 5,000 gallons per week of backwash water from greensand filters at potable water wells, not including conventional filters, reverse osmosis, and ion exchange filters, provided ponding or runoff does not occur and the backwash does not exceed the Maximum Contaminant Level (MCL) for radionuclides or arsenic; The flow from DMRs from the two facilities were 0.002 MGD (Heather Glen) and 0.003 MGD (Woodtrace), which were 2000 gallons/day and 3000 gallons/day, respectively. How often are the filters backwashed? Daily? If so, the volume of backwash water might exceed the 5000 gallons per week threshold, which means the above cited regulation does not apply to the two facilities. Would you please provide average weekly effluent flow data from the two facilities? Any data for radionuclides or arsenic?
