Mr. Brown,
On January 4, 2024, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on-hold until all of the following information is received:
1. The project plans depict a temporary stream crossing proposed for this project. The project site has an existing
permanent culvert crossing that will remain in place during and after this project’s completion. Projects are
required to avoid and minimize impacts in order to ensure remaining surface waters continue to support
existing uses during and after project completion. Please explain why the existing culvert crossing cannot be

used for construction access and why a temporary stream crossing is necessary. Please take into consideration
that ford crossings have the potential to introduce turbidity into the stream from equipment and earth moving
activities. Peckerwood Branch is classified C; Trout and has a turbidity standard of 10 NTUs. [15A NCAC 02H

The existing piped stream crossing at the site is not adequate for use by heavy equipment and vehicles
hauling material. The crossing is not wide enough and cannot withstand the expected weight of
equipment and loaded vehicles without causing damaging to the crossing structure. Also, clearance for
equipment and vehicles around the existing structures on the west side of the project area is limited.
2. The project plans indicate that one of the temporary pump around system intake hoses will be positioned
immediately downstream of the temporary ford crossing. Ford crossings have the potential to introduce
turbidity into the stream from equipment and earth moving activities. Please explain the measures that will be
taken to ensure any turbidity caused by the temporary ford crossing will not be carried downstream by the
temporary pump around system. Please also consider whether the temporary ford crossing can be relocated to
the dewatered area. Peckerwood Branch is classified C; Trout and has a turbidity standard of 10 NTUs. [15A

The location of the temporary pump around system intake hose will be moved upstream of the
temporary ford crossing in order to avoid and minimize turbidity impacts from the crossing.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by March 22, 2024. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
