Good Morning Charles,
I went out to this property and have spoken with Ms. Altman about her system. As far as I am concerned she no longer
needs a permit from us. It appears the system was never constructed to discharge. This is another property from
a single development in the 80's where several of the permitted systems were never actually installed. I've also
contacted the local health department to let them know this system does not discharge and I believe Ms. Altman was
also going to speak to them about having the system permitted with the county.

Linda — this site is at 45 Mockingbird Ln in Maggie Valley.
The property was previously owned by Tom Gregory, who sold it to Susan Altman in 2001. The change in ownership was
never documented in BIMS.
Meredith Wojcik, one of our tireless new hires, tracked down the deed for me. I issued a CoC renewal to Mrs. Altman on
November 2"d
Mrs. Altman called today. She had Larry Worrell's septic service inspect her system and pump out the tank. Sorrell told
her that the system was in great shape, but was NOT a discharging system. It's not even on the creek -facing side of the
property. Sorrell told her it was a traditional septic system with a drainfield.
Can I rescind this one? It sounds like the system originally permitted was not what was installed. Mrs. Altman lost her
husband a few weeks ago, and I'd like to make this a painless fix for her if that's possible.
Let me know, and thanks for your help.

CoC is issued pursuant to the requirements of North Carolina General Statue 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
October 15, 2007 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed).
If the subject discharge has been terminated, please complete the enclosed rescission request form. Mailing
instructions are listed on the bottom of the rescission request form. You will be notified when the rescission
process has been completed.

A letter of request for Authorization to Construct was received April 10,
1985, by the Division and final plans and specifications for the subject project
have been reviewed and found to be satisfactory. Authorization is hereby granted
for the construction of a 300 GPD wastewater treatment facility consistingof
a 1,000 gallon septic, tank, a flow distribution box and a standard subsurface
sandfilter measuring 6 feet by 43 feet with a discharge to Mine Branch.
This Authorization to Construct is issued in accordance with Part III para-
graph C of NPDES Permit No. NC006218 issued September 1, 1986 and shall be
subject to revocation unless the wastewater treatment facilities are constructed
in accordance with the conditions and limitations specified in Pennit No. NC0062618
The sludge generated from these treatment facilities must be disposed of
in accordance with G.S. 143.215.1 and in a manner approvable by the North Carolina
Division of Environmental Management.
The Asheville Regional office, telephone number 704/253-3341 shall be
notified at least twenty-four (24) hours in advance of backfilling of the in-
stalled sub -surface filter system so that an in -place inspection can be made
of said system prior to backfilling. Such notification to the Regional Supervisor
shall be made during the nornal office hours f= 8:00 a.m. until 5:00 p.m.
on Monday through Friday, excluding State Holidays.
In event the facilities fail to perform satisfactorily in meeting its
NPDES permit effluent limits, Mr. Ray Heussner shall take such immediate
corrective action as may be required by this Division, including the construction
of additional wastewater treatment and disposal facilities.

The sand media of the sub -surface filter must comply with the Division's
sand specifications and must be analyzed and approved by this Division either
by direct sampling or by acquisition of filter sand from a dealer who is
currently certified by the Division as an acceptable source.
