Dear Mr. Garner:
On October 22, 2007, the Division of Water Quality (DWQ) received your application dated
October 23, 2007 to impact 2,901 square feet of Zone 1 protected riparian buffers and 3,407
square feet of Zone 2 protected riparian buffers to construct the proposed development at the
subject property. On November 2, 2007, the DWQ sent a letter to your attention requesting the
additional information below:
1. Diffuse flow is a requirement within the Neuse River Basin. Please provide diffuse flow
provisions at the outlets of your dry basins on your revised plan sheets.
2. Since this submittal was made after October 1, 2007, the use of the new BMP
Supplement Form is required. Please provide a separate BMP Supplement Form for each
proposed level spreader (or other diffuse flow device). The worksheet must be submitted
(Design Summary and Required Items Checklist) along with all the required items. The
new BMP Supplement Forms are available at:
http://h20.enr.state.nc.us/su/bmp-forms.htm.
3. Please provide the new form for the Operation and Maintenance of BMPs. This is also
available at the above web site.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package.
