Department of Public Safety would like to request the rescission of NPDES Permits NC0027685 Avery Correctional Center,
Newland, Avery County, and NC0030180 Blanch Youth Center, Blanch, Caswell County. Avery CC has been closed since
October 1999 and Blanch YC has been closed since September 1999. The waste treatment systems have been
inactive since the units were shut down. There are no plans to reopen these facilities in the foreseeable future.
Can you please let me know what steps are required to close out these two inactive NPDES permits? If you need this
request in writing signed by Mr. Stovall, the Permittee signatory authority, please advise and that will be provided.
Your guidance in this matter is very much appreciated.

A Permit Application package for an Authorization to Construct (ATC) Permit was
received November 6, 2013, by the Division of Water Resources (Division).
This Authorization to Construct Permit is issued based solely upon the North
Carolina Licensed Professional Engineer's certification and the Applicant's certification of
the ATC Permit Application package. The Division has waived the technical review of the
plans, specifications, calculations and other supporting documentation included in the
subject ATC Permit Application package. Note that the ATC Permit Application package
may be subject to a Division audit.
This ATC results in no increase in design or permitted capacity of the existing 0.12 MGD
Odom Correctional Institute WWTP and is hereby issued for the construction of the following
specific modifications:
Installation of one (1) 22 ft diameter secondary clarifier with one (1) 35 gpm
submersible scum pump and controls, one (1) RAS/WAS pumping station with two
(2) 97 gpm submersible pumps and controls, one (1) influent distribution box;
installation of one (1) influent pump station with two (2) 211 gpm submersible
influent pumps and controls; installation of one (1) influent comminutor with 5 ft

open channel; in conformity with the project plans, specifications, and other
supporting documentation comprising the ATC Permit Application package.
This ATC is issued in accordance with Part III, Paragraph A of NPDES Permit No.
NCO027642 issued July 1, 2012, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in
Permit No. NC0027642.
It is the Owner's responsibility to ensure that the as -constructed project meets the
requirements of all applicable regulations and statutes, the ATC Permit Application package, and
all of the requirements contained herein. Failure to comply may result in penalties in accordance
with North Carolina General Statute § 143-215.6A through § 143-215.6C.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the Division.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by the Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Washington Regional Office, telephone number [phone], shall be notified at
.least forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a Professional Engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit and the ATC Permit Application
package. Mail the Certification to: NPDES Unit, DWR/DENR, 1617 Mail Service Center,
Raleigh, NC 27699-1617.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned, to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.

A copy of the project plans and specifications shall be maintained on file by the
.Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the Permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Prior to entering into any contract(s) for construction, the recipient must have obtained all
applicable permits from the State.
The issuance of this ATC does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

Attached is the most recent facility info cover page.
Here's what I would suggest for the draft permit:
Supplement to permit cover page: (see attachment)
1. Continue to operate:
Change to: 0.0206 MGD WWTP with influent bar screen, aerated flow equalization basin;
aeration basin with dual blowers providing diffused air; hoppered clarifier with skimmer
and sludge returns; tablet chlorinator; chlorine contact chamber; tablet dechlorinator;
post aeration tank; and broad crested rectangular weir discharge.
I talked to Kenneth G. Hart, NCDOC Facility Engineering Specialist, today about the Sludge
Management Plan. I made corrections in the cover page regarding disposal.
Everything else looks good.
ARO recommends renewal of this permit.

I recieved the NPDES permits to review on October 12, 2001. One was reviewed
in September 2001, I don't know what happened there, but I just redated it
with an old date.
I have forwarded those back to Raeigh on Monday 15 October, But the Secretary
did not send them out until the 17th. I hope that helps everyone.

In accordance with your application for discharge permit received on July 2, 1996 by the Division, we are
forwarding herewith the subject permit to discharge under the subject state - NPDES permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983 and
as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and
binding.
Please take notice that this permit is not transferable except after notice to the Division of Water Quality.
Part H, EA. addresses the requirements to be followed in case of change in ownership or control of this
discharge. The Division of Water Quality may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

A letter of request for an Authorization to Construct was received March 25, 1994 by the Division
and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of a dechlorinator and basin and demolition of the
existing polishing pond with discharge of treated wastewater into Three Mile Creek.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NCO027685 issued August 13, 1993, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0.027685.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate convective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Asheville Regional Office, telephone number 704/251-6208, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and
specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC
27626-0535.
Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The

Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

Dear Mr. Korstian:
The final plans and specifications for the subject project have been reviewed
and found to be satisfactory. Authorization is hereby granted for the construction
of improvements to an existing 17,500 GPD wastewater treatment facility consisting
of an aerated surge tank with dual grinder pumps, a chlorine contact chamber with
tablet chlorinator, a 0.05 MG effluent polishing pond, a post aeration tank with
diffused air and all related piping valves and appurtenances to serve the Avery
County Subsidiary of the Department of Corrections.
This Authorization to Construct is issued in accordance with Part III para-
graph C of NPDES Permit No. NCO027685 issued June 30, 1982, and shall be subject
to revocation unless the wastewater treatment facilities are constructed in accor-
dance with the conditions and limitations specified in Permit No. NCO027685. The
Permittee must employ a certified wastewater operator in accordance with Part III
paragraph D of the referenced Permit.
The sludge generated from these treatment facilities must be disposed of in
accordance with G. S. 143-215.1 and in a manner approvable by the North Carolina
Division of Environmental Management.
One (1) set of approved plans and specification is being forwarded to you.

Dear Mr. Fleming:
The N. C. Department of Correction is anticipating an increase in the population
of the Avery County Subsidiary, which could result in a discharge flow increase
from the permitted 17,500 GPD to 20,600 GPD.
At the present time, we would like to request discharge limitations for a
20,600 GPD flow for design purposes. However, we would like to continue to
operate under the present permit limitations until the plant is complete and
the flow has been increased.
