Potential jurisdictional areas were delineated from May through July 2020. A Preliminary Jurisdictional Determination (PJD) package for the Trent River basin, including the area of this project, was submitted and assigned Action ID SAW-2020-02243. Project Purpose and Need The storm surge and flooding caused by Hurricane Florence in 2018 highlighted the need for effective drainage within the City while also causing significant damage to drainage infrastructure. The purpose of the proposed projects within the Trent River drainage basin is to repair and replace damaged drainage structures, repair slopes to stop ongoing erosion, and clear accumulated sediment and debris to facilitate drainage and reduce flooding hazards. Site -specific measures may include: • The repair of damaged structures and adjacent fill, The installation of inlet and outlet protection where necessary to maintain flow and reduce channel erosion immediately adjacent to vulnerable structures, Stabilization of eroding banks throughout the basin to stop continued erosion, Removal of bank materials, woody debris, trash, and accumulated sediment within the channels to facilitate water drainage. Sediment and debris will be transported to the Tuscarora landfill for disposal. The specific equipment used at each project site is reserved for the selected contractor to decide upon; however, it is anticipated that standard excavation equipment that is appropriately sized for site access, often in residential yards and on roadsides, will be utilized. Project Hi AM The proposed project is part of an extensive drainage network repair project in New Bern, NC. The purpose of the drainage network repair project is to repair damages incurred by Hurricane Florence in 2018 and return function to the drainage capability of the City's infrastructure of drainage features and structures. The City applied for assistance through the Federal Emergency Management Agency (FEMA) immediately in September 2018 under FEMA Disaster Declaration 4393DR-NC. The FEMA Public Assistance Program may award funds to the City for two types of work: emergency work in the form of 1) debris removal (including accumulated sediment, trash, white goods, construction debris, and vegetative debris from limbs and detritus to entire downed trees, and 2) permanent work, consisting of repairs to stream and ditch banks and damaged structures such as culverts and pipes. Emergency work in the form of non -regulated and exempt activities were separated from projects anticipated to require permitting and completed. FEMA has reviewed individual projects and has obligated funds for permanent work. The projects were reviewed by FEMA, the City, and project engineers then grouped into Project Sites. Activities that are subject to permitting requirements are provided in Table 1 below. Anticipated impacts to potential jurisdictional areas are provided in Table 2, and a summary of non -regulated activities is provided in Table 3. All activities proposed under NWP 3, Maintenance involve the repair and rehabilitation of previously authorized structures and fill, including maintenance and repair of constructed ditch banks. All changes to the original design of any structure or fill (where applicable) have been designed to minimize future damage and have been reduced to the minimum practicable extent. Some areas of hardened material are proposed for replacement on the banks of potential jurisdictional features; however, no new areas of hardened bank stabilization are proposed. No potential wetland impacts are anticipated. Two sites (Site 1-37C and 1-37D) occur within an NC Division of Coastal Management (NCDCM) Area of Environmental Concern (AEC). Following direct correspondence with the NCDCM, it was determined that project activities within these sites are considered general maintenance and repair within existing roadways and exempt from NCDCM jurisdiction. Therefore, no Coastal Area Management Act (LAMA) permit is required. The purpose of the drainage network repair project is to repair damage incurred by Hurricane Florence in 2018 and return function to the drainage capability of the City's infrastructure of drainage features and structures. The City applied for assistance through the Federal Emergency Management Agency (FEMA) immediately in September 2018 under FEMA Disaster Declaration 4393DR-NC. At a pre -application meeting in April 2020, it was agreed that the most effective means of grouping project repair sites was by drainage basin, resulting in 10 groups of projects. FEMA has reviewed individual projects and has obligated funds for permanent work. Project plans have been reviewed by FEMA, the City, and project engineers, and were grouped into 38 project sites within the Trent River drainage basin. Potential jurisdictional areas within the Trent River drainage basin were delineated from early June through mid -July 2020. NRCS WETS tables data indicates that precipitation was within or above normal for this time period. A Preliminary Jurisdictional Determination (PJD) package for the Trent River basin, including the area of this project, was submitted to US Army Corps of Engineers and NC Division of Water Resources personnel on February 05, 2021. As part of this process, Axiom would like to gain concurrence on the applicability of Neuse River Riparian Buffers to facilitate project permitting. Riparian buffers are applicable to all features depicted on either the USGS 7.5-minute quadrangle (and the USA National Map) or the Natural Resources Conservation Service Soil Survey of Craven County (1989) and identified as intermittent or perennial using the NC Department of Environmental Quality Stream Identification Form. Figures depicting all project sites on aerial photography, the USA National Map (used due to its superior resolution to the 7.5-minute topographic quadrangle), and the NRCS Soil Survey of Craven County are provided. The following table identifies the features within each project site, the flow regime (if applicable) identified in the field, and if they are approximately depicted on the USGS or NRCS mapping resources. E=Endangered, PE=Proposed Endangered, T=Threatened, TS/A=Threatened by Similarity of Appearance, Candidate, BGEPA= Bald and Golden Eagle Protection Act *Currently no survey protocol for monarch butterfly Based on a review of Site mapping and field reconnaissance, it has been determined the Site's potential for suitable habitat for the above species is limited to Northern long-eared bat, tricolored bat, monarch butterfly, and bald eagle. A brief discussion of habitat is included below along with the Biological Conclusion rendered based on characteristics within the Site. Northern long-eared bat Habitat Description: In North Carolina, the northern long-eared bat (NLEB) occurs primarily in the mountains, with scattered records in the Piedmont and Coastal Plain. NLEB primarily hibernate in caves and mines. During the summer, NLEB roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees (typically >3 inches dbh). Males and non -reproductive females may also roost in cooler places, like caves and mines. This bat has also been found, rarely, roosting in structures like barns and sheds, under eaves of buildings, behind window shutters, in bridges, and in bat houses. Foraging occurs on forested hillsides and ridges, and occasionally over forest clearings, over water, and along tree -lined corridors. Mature forests may be an important habitat type for foraging. Biological Conclusion: No hibernacula (caves or mines) are present within the site; however, potential roosting and foraging habitat occurs within the site. No known occurrences of this species, hibernacula, or maternity roosts are present within 1.0 mile of the Site per NC Natural Heritage Program (NCNHP) records. Project activities specify that tree removal will be reduced to the minimum necessary and mature trees will be avoided as best feasible. Project activities are unlikely to affect this species; however, it is recommended that no tree removal above three inches DBH (Diameter at Breast Height) should occur during the pup season (June 1 to July 31) or additional coordination with the USFWS be conducted prior to land -disturbing activities during this time. If necessary tree clearing occurs outside of the maternity period of June 1 through July 31, this project May Affect but is Not Likely to Adversely Affect the NLEB. If tree clearing during the bat maternity period must occur, additional coordination with the USFWS, and potential species -specific surveys during construction will be required. Tricolored bat Habitat Description: During spring, summer, and fall, tricolored bats primarily roost among live and dead leaf clusters of live or recently dead deciduous hardwood trees. Tricolored bats have been observed roosting during summer among pines (Pinus sp.) and eastern red cedar (Juniperus virginiana) as well as structures such as buildings and bridges. During the winter, tricolored bats hibernate in caves and mines; although, in the southern United States, where caves are sparse, tricolored bats often hibernate in road -associated culverts and occasionally in tree cavities and abandoned water wells. Biological Conclusion: The USFWS has identified tricolored bat as a Proposed Endangered species. Proposed Endangered species are not protected by the Endangered Species Act (ESA) until the rule to list is finalized (anticipated to be fall of 2023); however, under section 7(a)(4) of the ESA, federal agencies must confer with the USFWS if their action will jeopardize the continued existence of a proposed species. Suitable habitat for tricolored bat is present within the Site. Project activities specify that tree removal will be reduced to the minimum necessary and mature trees will be avoided as best feasible. A January 26, 2024 review of the NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. Project activities are unlikely to affect this species; however, it is recommended that no tree removal above three inches DBH (Diameter at Breast Height) should occur during the pup season (June 1 to July 31) or additional coordination with the USFWS be conducted prior to land -disturbing activities during this time. If necessary tree clearing occurs outside of the maternity period of Junel through July 31, this project is Not Likely to Jeopardize the Continued Existence of this Species. Monarch butterfly Habitat Description: Habitat for monarch butterfly consists of rocky, open, upland woods on basic, well -drained sands or sandy loam soils, particularly where disturbance (such as mowing, grazing, clearing, or periodic fire) maintains an open habitat. Biological Conclusion: The USFWS has identified monarch butterfly as a Proposed Endangered species. Neither section 7 of the Endangered Species Act nor the implementing regulations for section 7 contain requirements for federal agencies with respect to candidate species. When working with other agencies, USFWS Ecological Services field offices will recommend ways to reduce adverse effects and/or request studies as appropriate. A January 26, 2024 review of the NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. As a Candidate species, a Biological Conclusion is not required; however, it is anticipated that this project will have No Effect on monarch butterfly. Bald Eagle • Habitat Description: Habitat for bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large, dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. Biological Conclusion: A review of aerial photography reveals abundant open waters and mature forest within 1.0 mile of the Site that may be large enough and sufficiently open to be considered potential feeding and roosting habitat; however, no areas within Site limits support eagle nesting or foraging and no trees suitable for potential nesting will be affected by the proposed project. A January 26, 2024 review of the NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. This project will therefore have No Effect on bald eagle. As I mentioned, Axiom is assisting the City of New Bern in their effort to repair damages to drainage infrastructure from Hurricane Florence in 2018. The City applied for assistance through the Federal Emergency Management Agency (FEMA) immediately in September 2018 under FEMA Disaster Declaration 4393DR-NC. Activities are most commonly damaged culvert replacements and ditch/streambank repairs. Project sites have been grouped by drainage basins and the repair plans have been developed with input and approval from FEMA. Two of these drainage basins, Rennys Creek and Trent River are nearing the permitting stage. I have attached figures depicting the relevant jurisdictional features from the USACE Preliminary Jurisdictional Determination (PJD) package, and repair plans for three sites understood to be under DCM jurisdiction. The limits of DCM jurisdiction were identified during a site visit with Brad Conell on August 11, 2020. The Trent River drainage basin includes many sites and the majority are outside DCM jurisdiction. The locations of all sites are depicted on the second sheet of the Trent River Repair Plans pdf. The PJD packages for both basins are quite large, so only the relevant portions are attached. If you are interested in seeing the complete set of construction plans or PJD figures, we can send you a link to access those files. • The Rennys Creek Drainage Basin includes one site and consists of backfilling a small sinkhole above a culvert on the east side of Oaks Road (35.130349,-77.066198). c The project is located within the NCDOT right-of-way along Oaks Road. a There will be no excavation or addition of hardened material. o No waters will be impacted, only repair work within the buffer. • The Trent River Drainage Basin has two sites (37-C and 37-D) consisting of bank repairs along an access road to the City of New Bern Yard Waste Facility between US 70 and Country Club Road (35.098387,-77.056211). a Both sites are located on City of New Bern -owned roadway along Pembroke Avenue. o There will be no excavation or addition of new hardened material. o No waters will be impacted, only repair work within the buffer.
