Facility is located at: North Buncombe High School 890 Clarks Chapel Road Weaverville, NC 28787 Justification for Recession: The BOE elected to fund a significant project/permit for land application of the wastewater under current NCDEHNR regulations due to continued problems associated with Chronic Toxicity at the existing plant. Engineering and permitting for this project, OWPB Project # 2013-17 Buncombe County, NC had been approved, constructed and completed this fiscal year. Inspection approval correspondence on file. Chronic Toxicity Pass/Fail Permit Limit (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase H Chronic Whole Effluent Toxicity Test Procedurd" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted f1pal effluent discharge below all treatment processes. _ _ If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. I just had the opportunity to speak with Matt about this. He felt certain the situation goes back to the old ammonia/toxicity option given to the schools many years ago. However, he also saw the situation as pretty cut and dry. With an unresolved and undiagnosed toxicity problem, we cannot remove the testing and the limit from the permit. Maybe if they can be more definitive in the future about the cause, and they appear to be able to address it, we could revisit the issue. With the boss thinking that way, I'm just going to prepare a final permit with the requirements as were stated in the draft, and I'll explain the reasoning from over here. If they want to contest the permit, we can revisit the matter then (but I don't think that's likely). If a facility has less than 0.1mgd flow and is only a domestic discharge then toxicity would normally not be in the permit unless there is something else going on with the facility. They let me work an odd schedule over here, and I had left just before your reply came through. I looked over the flow data from the facility (the RIMS report function still appears to be down). Since the beginning of 2009, their average flow is 10,000 gallons per day. Looking through the file, I can't see anything that would deem this one as having a complex waste stream. The discharge at one time did receive flow from the commercial style washing machines operated by the athletic department. Their use is said to have been discontinued following a TA visit by Don Price in 2009. They've inventoried cleaning products and looked at maintenance processes to try to reduce potential toxic effects. In October 2008, they say they took an influent sample that yielded BOD of 1830 mg/L and TSS of 1160 mg/L. Don't know what that is all about but they seem to link it to a toxic substance introduced to the system. It certainly doesn't sound like what we'd expect from domestic and cafeteria waste. Buncombe HS and their same old issue. They'd like to "exchange" their toxicity limit for ammonia limits. However, we were disinclined to go that route because they weren't definitive about the cause of the toxicity, even If ammonia was suspected. Even Jeff noted earlier in this thread that there was no obvious cause. We sent them a draft permit in September. They responded with a request to modify the terms. I don't believe we're eager to change the terms, but Jeff P. is not 100%a against it, if it isn't contrary to policies. What do you think? If they have a history of tox violations and we can't explicitly tie ammonia to the violations, would it be right to remove the tox requirement, even while adding an ammonia limit? I guess we could add ammonia limits and keep a testing only requirement without a limit, but I don't think the facility would buy that because cost seems to be a motivating factor. I think the school has chosen to go with the tox test instead of having an ammonia limit imposed. It looks like the receiving stream is deemed to be zero flow at the discharge point. If we were to assign limits, this facility would get a monthly average of 2.0 mg/Lin the summer and 4.0 in the winter (with corresponding daily max limits of 10 and 20). Just quickly eyeballing their recent data, it looks like compliance with those limits would be inconsistent at best. BOD = 11 mg/L, Eff. TSS = 6.2 mg/L, and Eff. Alkalinity = 140 mg/L. The results of these samples confirm the facility is being well operated and maintained. Review of past monitoring data indicate Toxicity problems began around August and September of 2008. There was a noticeable spike in the effluent Ammonia concentraion during this same time period. Effluent Ammonia concentrations jumped from 0.3 mg/L to 8.4 mg/L. This is a 196% increase in the Ammonia concentration of the discharge. Further review of operation and the influent contribution to the system indicate the School has a "Commercial' laundry on -site. The commercial washing machines are constructed to conserve water. This type of machine will "Concentrate" any surfactant (soap), disinfectant or germicide, and any other constitutent used to clean the garments. This concentration will then be discharged to the treatment system where it will disrupt the biological activity causing compliance limitation issues. It is suggested the facility discontinue the use of these commercial machines or strictly limit and supervise their use. I think they could go ahead and ask for the switch, but this one gets a little more problematic because we know they have a toxicity problem, and while we suspect ammonia, we're not sure if that's really the problem. It would seem to make us more reluctant to let go of the tox test. As I recall, they probably don't have a viable option other than discharge at this point in time. Is ammonia not the prime suspect in this matter? Have they performed any studies that may point to another 3 cause (or is the cause unknown because they haven't looked very hard to find it)? We'll get it worked out. Technical assistance has been performed at the WWTP and cleaning products have been inventoried. The permit requires ammonia monitoring, but the permit has no ammonia limit. The permit writer should examine ammonia data in relation to tox test failures to see if there is any obvious connection. Dechlor chemical concentrations may also be a suspect in toxicity matters. ATU has not specifically weighed in on this situation. If chlorination/dechlorination appears to be a problem, the facility may be encouraged to go to a UV system for disinfection. Additionally, increasing the ammonia monitoring frequency from 2/month to weekly may be advisable. At a minimum, the cover letter should include language pointing out the toxicity issues. The tests will be performed during the months of January, April, July and October. North Carolina uses two instream criteria adopted from EPA research: • Summer instream criteria-- 1.0 mg/L ell • Winter instream criteria = 1.8 mg/L -- (Note: These are called "criteria" because standards have not been formally adopted for non -trout classified waters in North Carolina.) In order to evaluate whether the discharge has the potential to cause instream toxicity, the allowable effluent concentrations of ammonia (summer and winter) are calculated with the mass balance equation (using the IWC Excel Spreadsheet in Appendix A). Both summer 7Q10 and winter 7Q10 are used in the equation. Ammonia is the only toxicant that is limited differently for summer and winter seasons. An upstream concentration of 0.22 mg/L is assumed. If the allowable concentration is greater than 35 mg/L, no limit should be imposed. If the allowable concentration is less than 35 mg/L, potential toxicity may be occurring. If there was already an existing ammonia limit based on oxygen -consumption, the more stringent ammonia limit should be placed in the permit. If the mass balance calculation indicates the need for ammonia limits, it is Division policy to set limits no more stringent than 2 mg/L (summer) and 4 mg/L (winter) for small discharges (those less than 1.0 MGD). This is based on the Division's determination of BAT (best -available technology) for these types of facilities. Therefore, even if the calculation for a winter ammonia limit yields a 3.5 mg/L result, a 4 mg/L limit would be given. For any new or expanded flow, an ammonia limit should be given. However, for existing flows where potential toxicity may be occurring, the permit holder should be given the option to have the ammonia limit(s) placed in their permit or to have a quarterly chronic, WET test, pass/fail at the instream waste concentration using Ceriodaphnia as the test organism. Many times the facility will need a compliance schedule to be placed in the permit in order for renovations to be made at the site. Such schedules should be coordinated with the regional office and the permit holder but should not exceed three years. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. In the last decade, EPA assessed the potential adverse effects of chlorine to the aquatic environment and has taken steps to reduce the impacts through the development of federal criteria. In 1986, EPA recommended that all states have a chlorine standard by their next triennial review of water quality standards. In revising its water quality standards in 1989, North Carolina developed an action level for chlorine of 17 ug/1 (freshwater classes only). In addition, the fecal coliform limit was reduced from 1000 colonies/100 ml to 200 colonies/ 100 ml. Under a new DEM procedure, dechlorination and chlorine limits are now recommended for all new or expanding dischargers proposing the use of chlorine for effluent disinfection. The Division is reviewing chlorine levels from all existing dischargers as part of their NPDES permit renewal process. Our records indicate that chlorine from your facility's effluent discharge is considered toxic to the receiving stream under low flow conditions, i.e., the amount of chlorine discharged causes a violation of the instream action level for chlorine (17 ug/1) under 7Q10 conditions (the average flow for seven (7) consecutive days during a ten (10) year period). Action should be taken to reduce the effluent concentration of chlorine to an acceptable level. Based on your facility's instream waste concentration of 100%, an acceptable level of chlorine in your effluent is 17 ug/l. If this level is not feasible, you should consider dechlorination or alternate methods of disinfection for your facility to ensure that both chlorine and bacterial limits are met. In addition, if your facility plans to undertake any phase of construction, dechlorination or alternate disinfection should be included.
