Subject: FINAL NOTICE - Renewal of NPDES Permit No. NCG550726
Buncombe County
Dear Permittee:
Adft
IDEHNF1
April 15, 1997
The subject permit expires on July 31, 1997. North Carolina General Statute 143.215.1(c) requires that an application for
permit renewal be filed in a timely manner. A prior notice of renewal was sent for this site on February 7, 1997. To date,
no response has been received by the Division. If continuation of the permit is desired, submit the following information
prior to May 31, 1997:
1. A letter requesting the renewal.
2. The completed invoice form (copy attached).
3. A renewal fee of $240. The check should be made payable to the North Carolina Department of Environment,
Health, and Natural Resources which may be abbreviated as NCDEHNR.
Failure to request renewal or permit rescission prior to May 31, 1997 will result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending upon the delinquency of the request.
If operation of a discharge or waste treatment facility is to occur after the expiration date of the permit, or if
continuation of the permit is desired, it must not be allowed to expire. Operation of the waste treatment works or
continuation of a discharge after the expiration date would constitute a violation of NCGS 143-215.1 and could result in
assessment of civil penalties up to $10,000 per day.
If there are questions regarding the permit renewal procedure, please contact Max Haner of the Asheville Regional
Office at telephone number (704) 251-6208.

A. Purpose of Proposal.
The purpose of this proposal is to review and evaluate several
wastewater disposal options available to the above project. The most
desirable option by all parties would be to dispose of the domestic
wastewater into a gravity sewer line located on Hazel Mill Rd. or Emma
Road. However, at this time that option cannot be considered for 3-5
years, per the Buncombe County Manager.
The North Carolina Department of Enviroment, Health and Natural
Resources requires that this report evaluate the economic and
enviromental aspects of various alternatives to the handling of this
project's wastewater
B. Location of Project.
The proposed project is located at 537 Hazel Mill Rd. in the Emma
Section of Asheville near Smith Mill Creek.
C. Description of Project.
The scope of the proposed project is how to effectively (economically &
environmentally) handle the domestic waste from approximately 35
production and administrative employees at present with the option of
75-100 employees in 5 years. The waste requirements will be (15
gal/person/day) 375 gpd now, growing to approximately 1500 gpd by 1999.
D. Disposal Alternatives.
There are three ( 3 ) options of wastewater disposal that have been
considered for this project:
B
1) Gravity Sewer
a. This alternative would be to connect to an existing MSD
gravity sewer line running along North Louisiana Avenue. This would be
a new line located in the valley between Emma Road and the -railroad
track. It would involve construction of an 8" sewer line approximately
2100 ft. long and obtaining 7 or 8 easements from adjoining property
owners. Several of the property owners have expressed an interest in
tapping into the new line, but not sharing in the construction cost.
2) Pump Station and Force Main
a. This alternative would be to install approximately 3000
linear feet of force main line with a pump station. This 4" diameter
line would run along Emma Road connecting to the Buncombe County sewer
line at North Louisiana Avenue. There are at least eight (8) property
owners that would need to be consulted about easements.
3) Existing Sand Filter System
a. This alternative would be to revitalize the existing sand
filter system by replacing the filter media and installing two pumps
and a recirculating system before the effluent would enter the existing
and revitalized chlorine contact chamber. The effluent would then
enter the dechlorination chamber and discharge into Smith Mill
Creek.
b. A Pump and Haul Permit will be requested and applied for to
handle the project's wastewater until the revitalization of the
existing sand filter system can be completed.
A cost analysis for each of the three alternatives follows.
COST ANALYSIS
OF
GRAVITY SEWER `
Mobilization ---------------------------------- $ 2,000.00
Railroad Crossing (1)------------------------- 25,000.00

$89,261.00
Several land owners were contacted concerning providing easements for
crossing their property with the gravity sewer. They expressed an
interest in being able to connect to this line and would grant an
easement at no cost. Therefore no costs were included in the estimate
for easement acquisition.

$17,880.00
E. Evaluation and Recommendations. 1
On the basis of the aforementioned analyses, it is our opinion that the
most feasible option at this time is to revitalize the existing sand
filter system. Obviously, the owner would prefer to have the
building's wastewater system connected to a gravity sewer line
maintained by MSD. There is some discussion of other industry in the
area inquiring about the availablity of a gravity sewer and perhaps a
cost sharing project with Buncombe County would be feasible within the
next 5 years.

HI Charles,
Each year we go through a task for Vanessa trying to track down built/not built facilities.
In 2014 Janet went through the task of verifying that the subject system is on the sewer
system. I have attached her email corresponding with MSD the sewer district.
Fees have never been paid on this system, we doubt it was ever even built.
It should be rescinded or made inactive. Can you take care of this for us?

General Permit NCG550000
Certificate of Coverage NCG550726
Buncombe County
You are receiving this notice because you currently own a property that was previously covered
under the subject General Permit for the discharge of domestic wastewater. The Certificate of
Coverage (CoC) specific to your property [the warehouse facility at 537 Hazel Mill Road in the
Emma section of Asheville] has expired and is in the name of the previous owner.
The Division needs information from you to determine if coverage under NCG550000 is still necessary.
➢ If your property still has a wastewater system like the ones described in the enclosed Technical
Bulletin, you must renew the subject CoC. Complete the enclosed form and submit it to the address
on the form.
➢ If you are not sure what type of system your property has, contact Larry Frost in the NC DENR
Asheville Regional Office at (828) 296-4500. He can help you determine if you should renew
coverage under the General Permit.
➢ If you know that your property no longer discharges wastewater to a waterbody, contact me at the
address or phone number listed below to request rescission of the CoC.
If you have any questions concerning this matter, please contact me at the telephone number
or e-mail address listed below.
Sincerely,
Charles H. Weaver, Jr.

When she sent me the fax, I discovered that the CoC should not have

Ms. Broach works at Just Ducky Originals, located at 1575 Jenkins

Neither Ms. Broach's home address [116 Glen Falls Drive / Asheville]

currently
requires coverage under NCG550000.
The original location covered by NCG550726 is 537 Hazel Mill Road in
Asheville. Max Haner's 1994 staff report locates the facility

I'm sending a letter to Ms. Broach rescinding coverage under
NCG550000.
However, if you have info that suggests she's wrong about needing
coverage at her hoem or workplace, let me know. Those locations
would
have to apply for new NCG550000 CoCs; NCG550726 remains tied to the
Hazel Mill Road site.
If you have any new info on the current owner [and discharge status

the Hazel Mill Road site, I'd be grateful for it.
Thanks for all your help hunting down these expired CoCs.

Dear Ms. Branch:
In accordance with your application for a Certificate of Coverage [received on January 10, 2005], the Division is
forwarding herewith Certificate of Coverage NCG550726 to discharge under NCG550000. Your property was previously
assigned this CoC number in 1993. The previous owner allowed the CoC to expire. Thus your application is being treated
as a renewal of an existing CoC, rather than a new discharge application. This permit is issued pursuant to the requirements

Environmental Protection agency dated May 9, 1994 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit are unacceptable
to you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division of
Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal
or Local governmental permit that may be required.
If you have any questions concerning this permit, please contact Charles H. Weaver, Jr. at telephone number 919
