PROJECT DESCRIPTION: The project site is located at 226 Southwest 151h street, adjacent to Davis Canal, in Oak Island NC, Brunswick County. The site is approximately 0.23 acres, and is vegetated primarily with manicured lawn grass. There is an existing single --family residence on the parcel site; and an existing bulkhead (no permit history was located for the bulkhead). The project site has approximately 68 ft. of shoreline frontage along the canal, according to the applicant. There is a thin strip of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) located waterward of the existing bulkhead (approximately 16' out from the bulkhead) extending across the width of the property. There is currently a two --slip docking facility on site, which consists of a fixed pier (15.5' x 6') that extends from the bulkhead to the south. The fixed pier terminates in a T-head fixed covered platform (16' x 16'). From the end of the platform, a gangway extends to the south to a floating dock (16' x 8'), of which the waterward edge serves as an existing slip. To the east of the existing floating dock, an existing boat lift serves as slip 42 (12' x 12'). No permit history was located for the docking facility, but it appears in aerial photos dating back to 1999.1. The property is bordered by residential single-family homes to the west and east, S W 15th street to the north and Davis Canal to the south. The waters of the AIWW are classified SA by the Division of Water Resources. This area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and it is CLOSED to the harvest of shellfish. PROPOSED PROJECT: 9. The applicant proposes to reconfigure an existing docking facility, and install one additional six pile boat lift, increasing from two (2) existing slips to a total of three (3) proposed slips along Davis Canal in Oak Island. The applicant is proposing to move the existing boat lift (12' x 12') to the western side of the riparian corridor, greater than 15' away from the riparian corridor line shared with the western adjacent riparian property owner, according to the application materials (See Isenhour Dock Site Plan, Page 1 of 3, dated 2/l/2024). The applicant is proposing to shift the existing floating dock two feet to the east. The applicant is proposing to construct a new six pile boat lift (16' x 16'), to the immediate east side of the existing (and relocated) floating dock. According to the application, the relocated boat lift would be located in water depths ranging from 0' on the landward side to -4.5' on the waterward side, and the proposed new boatlift would be located in water depths ranging from approximately 0.5' on the landward side to -4.5'@ NLW on the waterward side, within the canal. DCM site visit confirmed water depth figures supplied by applicant, except that staff observed slightly deeper (margin of inches) water depths on the landward side of the project area than stated in the application. According to the work plan drawings, the applicant's proposal is Iocated within their riparian corridor, would meet the existing pier headline, and would be located Iandward of the '/4 of the width of the waterbody, which measures approximately 135' across. The proposed boat lift would encroach into the eastern adjacent riparian corridor setback, but the appropriate waiver has been obtained. 10. ANTICIPATED IMPACTS The proposed boat lift would incorporate an additional 256 sq. ft. of Estuarine Waters and Public Trust Area. Currently, the existing facility incorporates 621 SF of Estuarine Waters and Public Trust Area. The proposed boatlift would be consistent with the pierhead line and landward of the '/4 width. This area is designated as Primary Nursery Area, and the proposed new and relocated boatlifts would be located in water depths of approximately 0' to -4.5' @ NLW according to the applicant. Minor increases in turbidity should be expected during construction. The property has a shoreline of 68.54 linear ft. The project requires the 15' riparian setback back to waived by the property to east, 211 SW 15th Street. In order to install the proposed boat lift I will need to remove the existing 12x12 boat lift (slip #1) and shift the 8'x 16' float dock (slip #2) to the east 2'. The existing 12x12' boat lift (slip #1) will be reinstalled on the west side of the floating dock. The new 16'x16' boat lift (proposed slip #3) will be installed on the east side of the floating dock. The water depths at the project site range from +0.5' to over -4' at low water. The new boat lift and existing boat lift will have limit switches preventing boat lift cradles from touching the mudline. Construction will take place on the water by barge. It was received as complete on February 12, 2024, and appears to be adequate for processing at this time. The projected deadline for making a decision is April 27, 2024. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from February 12, 2024, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property, or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
