Proposed Activity Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used: We have a 10' x 12' storage shed in our back yard which has limited space. The shed has to be within the 50' buffer of the 760' contour line based on the available space in our yard and the home/ windows. This does not require the removal of trees or other vegetation. It would will remain behind the setback of the house. and the closest corner is well clear of the seawall and should be approximately 35' from the 760 contour. Currently the shed is placed approximately 5' interior of the seawall but it was brought to our attention we need to move it outside of 30 feet of the 760 contour. It is a 10' x 12' (120 sq ft) standard storage shed. We had a reputable builder do the job which believed this was placed in an area without restrictions. We were recently informed it is within a buffered area and needs to be moved. In order to keep this in our back yard and stay within our HOA rules/regulation it does need to stay within the 50' buffer of the 760' contour. We can have it moved further from the lake if this is necessary. Placing it 5 foot inside of the fence will permit a 35' foot buffer from the 760'. It is also well clear of the FEMA flood line. It should essentially be even with house. It will not require removing or altering any vegetation ro disturbing any soil. This will permit drainage under and around with minimal restriction. I have attached survey with red markings of shed and plans. Thank you, Philip Jones D. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project. This will not require any modification of vegetation nor any grading of land. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. this is a standard storage shed sat on leveling blocks. E. Diffuse Flow Plan la. What type of SCM are you providing?* Level Spreader Vegetated Conveyance (lower SHWT) Wetland Swale (higher SHWT) Proposed project will not create concentrated stormwater flow through the buffer Other SCM that removed minimum of 30% nitrogen 1 c. Does the project involve an expenditure of public (federal/state/local) funds or the use of public (federal/state) land? Yes No Violations 2a. Is the site in violation of DWR Wetland Rules (15A NCAC 02H .0500), Isolated Wetland Rules (15A NCAC 02H .1300), DWR Surface Water or Wetland Standards, or Riparian Buffer Rules (15A NCAC 02B .0200)? 2b. Is this an after -the -fact buffer authorization application? 2c. If you answered "yes" to one or both of the above questions, provide an explanation of the violation(s): My wife and I placed a 10' x 12' storage shed in our back yard. We have a seawall and it is sitting on leveling blocks inside of the seawall within the back yard. We had a reputable builder in the area contracted through Lowe's home improvement that built it on site and they were not aware of any restrictions regarding sheds of this size in this zone. It was brought to our attention recently that this is a protected area. G. Additional Information Please upload any additional information you would like the Division to consider during application review. Additional Attachments: Click the upload button or drag and drop files here to attach document PDF only Additional Comments: As stated above, this is a small storage shed that has minimal environmental impact. Unfortunately we do not have many options to place this due to vegetation and the slope of the land, fencing, and HOA regulations. This is a very necessary structure for my wife and I and our growing family. Thank you for your time. I do apologize for any information I could no answer.
