The Division's Mooresville Regional Office concludes that the City of Monroe violated Permit Condition I (2) of Permit No. WQCS00026 by failing to effectively manage, maintain, and operate their collection system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143-215.1. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. This office requests that you respond to this Notice, in writing,within 10 business days of its receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other actions taken to prevent the recurrence of similar situations. The response to this correspondence will be considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Pitner Assistant Regional Supervisor Water Quality Regional Operations Section NCDEQ Mooresville Regional Office 610 East Center Avenue, Suite 301 Mooresville,NC 28115 • Subject: Response to Notice of Violation Tracking#NOV-2023-DV-0110 Sanitary Sewer Overflow- January 2023 Collection System Permit No. WQCS00026 Monroe Collection System Union County Dear Mr. Pitner, This letter is in response to the NC Department of Environmental Quality(NCDEQ)Notice of Violation /Notice of Intent to Enforce, the letter dated February 23, 2023 and received by City of Monroe Water Resources on February 27th, 2023. NCDEQ identified the following Sanitary Sewer Overflow(SSO) on January 25th, 2023 as ineffectively managing, and maintaining the collections system. In response the City of Monroe is providing the following evidence that the SSO was unintentional and that the overflow was beyond our reasonable control of our operations and that compliance with our collections system permit remains our utmost responsibility. Incident#202300131 was during a severe natural condition in which we received over three inches (3") of rain from January 23rd through January 26th. The ground was overly saturated and was no longer able to absorb the rain water into the soil. The ten-day forecast called for four tenths of an inch(.4") of rain. Over the course of 25 days leading to this we received an amount of five(5") inches and three tenths of an inch(5.3") of rain fall at the waste water treatment plant (WWTP). Upon identifying the area and checking an elevated upstream manhole that was surcharged it was determined, that the spill was a result of the severe natural condition. A City of Monroe Water Resources representative was stationed onsite during the duration of the spill to monitor any changes and when the spill stopped. Once the spill was stopped,the affected area was treated with lime as stated in the BIMS report. The City of Monroe Water Resources Engineering staff and Maintenance Staff are currently working on a plan to prevent and mitigate spills in the area. The City of Monroe Water Resources will be utilizing new technologies in the attempt to mitigate issues in the subject area. SMART Covers which help to analyze the area for surcharge and flow changes will be utilized in this area to monitor any changes or suspected SSO's within in the line. The SSO was not within reasonable control of the permittee; the SSO could not have been prevented by the exercise of reasonable control, such as proper management,preventive maintenance. The permittee followed all City of Monroe Sanitary Sewer Overflow Response Plan(SSOP)procedures. The City of Monroe meets and exceeds the 10% cleaning goal each year with various methods including pipe bursting, CIPP,basin cleaning, and CCTV inspection. The City of Monroe has staff available 24 hours a day 7 days per week with anticipated response time of less the 45 minutes to respond to any given call. This helps to reduce the impact and duration of sewer spills. In addition, contacts are utilized with construction companies for emergency situations. The City of Monroe Water Resources is respectively requesting that civil penalties not be applied to the above SSO that occurred during the month of November, due to the above factors being satisfied and evidence showing that the overflow was not expected to occur.
