Attn: Mr. Ian Eckardt 1430 South Mint Street, Suite 104 Charlotte, NC 28203 Delivered via email to: ieckardt@wildlandseng.com Subject: REQUEST FOR ADDITIONAL INFORMATION Worthdale Park Stream Restoration and Stormwater Control Measure (SCM) Retrofit Dear Mr. Eckhardt: On January 8, 2024, the Division of Water Resources (Division) received your application requesting a 401 Individual Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Tree planting should be conducted in the appropriate tree planting season to ensure survival of planted stems. DWR would appreciate confirmation on when planting will occur. 2. DWR requests that you consider including additional canopy species in the upper wetland area. 3. The application identifies SCM grading within the riparian buffer as "temporary" impacts. All aspects of the SCM must be identified as permanent SCM impacts, including the graded fill slopes that will be vegetated. Please update the plans and table of impacts accordingly. Comments Specific to Plan Sheets: 4. Depict wetlands on the Stream Plan and Profile sheets. Include the greenway stream crossing on the stream plans and planting plans as well. 5. DWR requests that the wattle spec be updated to include staples in order to be effective. 6. On Plan Sheet 1.4.1 there is a note for temporary gravel area for sewer line construction. Please provide information on what the sewer construction entails such as timing of construction, is it a replacement or is a new line being installed? Please also clarify whether this construction activity will take place at the same time as the stream construction activities and whether the gravel will be removed and if so, what measures will be taken to ensure any compaction of the area is addressed to improve permeability and future vegetation growth. Additional Review Items to consider that do not need responses: 7. These are deep floodplain depressions. In some areas they are being excavated by 5-7 ft. Is there a reason for this depth? DWR is concerned that wetland vegetation will not establish in the depths proposed in this plan and recommends limiting pools to 18" or reclassifying areas as open water. 8. Is it necessary to have a rock lined "enhanced wetland outlet" or rip -rap channels connecting wetlands to streams? Could this be achieved with a vegetated swale? Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
