A review has been conducted of the self-reported Sanitary Sewer Overflows (SSO's) 5-Day Report/s submitted by
Town of Taylorsville. The Division's Mooresville Regional Office concludes that the Town of Taylorsville violated
Permit Condition I (2) of Permit No. WQCS00135 by failing to effectively manage, maintain, and operate their
collection system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO
constituted making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is
required by G.S. 143-215.1.
The Mooresville Regional Office is providing the Town of Taylorsville an opportunity to provide evidence and
justification as to why the Town of Taylorsville should not be assessed a civil penalty for the violation(s) that are
summarized below:

This Notice of Violation / Notice of Intent to Enforce (NOV/NOI) is being issued for the noted violation. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing,within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance.

Notice of Violation Response

The incident occurring on March the 2nd 2023 was a case of bad toilet paper. Our
County Schools Maintenance Department earlier this year ordered their supply of toilet
paper and as the toilet paper was dispersed throughout the county schools they started
to see a rise in sewer backups. Their crews were having to go to several schools a day
to unclog sewer lines. Come to find out the toilet paper that they had been using in the
school was missing an ingredient. The company making the toilet paper failed to add
the biodegrading agent in the toilet paper that breaks the toilet paper down. The result
was basically a roll of paper towels disguised as toilet paper. Most of the sewer
blockages occurred on the school side and had not made it to the city's responsibility.
That was not the case on this particular day. The SSO occurred along our ROW, two
manholes away from the High School. We stopped the SSO as soon as possible. After
the SSO was stopped, town crews applied lime to the affected area. Since this time the
County Schools Maintenance Department has removed all bad toilet paper that they
know of, and have sent back unused orders with the batch numbers associated with the
bad toilet paper. Other remedial actions taken, town crews have cleaned out the
downstream pump station to remove any debris that could cause a future blockage
before it makes it to the WWTP.

name and number to confirm these findings.

Notice of Violation Response

This SSO occurred at the NC Department of Adult Corrections prison pump station. The
pump station is owned by the NC DAC but the Town of Taylorsville looks after it and it is
covered under our collection permit.
The Towns Collection ORC received a high wetwell call from SCADA. Upon arriving at
the pump station water was coming out of the wet well. The ORC checked both pumps
to make sure they were working properly and they were, the ORC even checked the
forcemain discharge pipe to make sure everything was pumping and that was properly
working as well. We then took action to start pumping and hauling so we could relieve
the SSO and in the meantime find out what exactly was happening. Shortly after
checking all the listed items above, a prison crew came to the pump station to inform us
that the morning of SSO the prison maintenance staff shut down the 900 unit cell block
to fix several water leaks. When the water was restored to the unit it sent a surge of
water to the lift station because of all the fixtures being turned on at once. The prison's
pump station was unable to overcome such an influx of water. As time passed the flow
did not let up as much as expected. The ORC made a call to the Prisons Maintenance
Director and he assured that the problem was resolved and the flow should be let up
soon. As several minutes passed by the flow was still steady. The ORC then made
another call to the director and he informed, that when they restored the water back to
the unit that the flush valves stayed open on the toilets so the 900 cell housing unit was
running clean water directly to the pump station. The prison crew worked hard to get the
housing unit back in operation, during that time period town crews pumped and hauled
till the entire unit was fixed. After the spill, we removed all trash from around the spill
and applied lime to the affected area.
Please note the Town was given no prior information of the prison's plan to fix water
leaks. Since that time we have tried to establish a better line of communication with the
Prison so the Town is made aware of things that might disrupt the pump station so we
can better prepare.
