Dear Mr. Harrold:
This letter is in response to the Pre -Construction Notification (PCN) you submitted to
the Wilmington District, Asheville Regulatory Field Office on December 21, 2023, for a
Department of the Army Nationwide permit (NWP) verification. This project has been
assigned the file number SAW-2021-00704 and is known as Veterans Park Streambank
Restoration. This file number should be referenced in all correspondence concerning
this project.
A review of the information provided indicates that the proposed work would include
the discharge of fill material impacting 635 linear feet of stream associated with stream
restoration activities. The project/review area is located on the N side of Interstate 40,
adjacent to Veterans Park, at Latitude 35.608464 and Longitude-82.335777; in Black
Mountain, Buncombe County, North Carolina.
We have determined that the proposed work is authorized by Nationwide Permit 27
pursuant to authorities under Section 404 of the Clean Water Act (33 U.S.C. § 1344).
The proposed work must be accomplished in strict accordance with the general permit
conditions, special conditions, any regional conditions, the application materials, and the
enclosed plans Titled Veterans Park Streambank Restoration, figures 1 through 4, and
sheets 1.0 through 8.0. If the extent of the project area and/or nature of the authorized
impacts to waters are modified, a revised PCN must be submitted to this office for
written approval before work is initiated. Any violation of permit conditions or deviation
from your submitted plans may subject the permittee to enforcement action.
This verification is valid until March 14, 2026, unless prior to this date the subject
NWP(s) is suspended, revoked, or is modified such that the activity no longer complies
with the terms and conditions of this NWP. If you commence or are under contract to
commence this activity before the date that the relevant NWP is modified or revoked,
you will have 12 months from the date of the modification or revocation of the NWP to
complete the activity under the present terms and conditions of this NWP.
SPECIAL CONDITIONS:
1. Wild rainbow trout are found in the project vicinity. In order to protect downstream
uses for trout, a requirement of this Permit is that any work conducted within the
stream may not occur between the dates of January 1 through April 15.
This NWP verification does not preclude the necessity to obtain any other Federal,
State, or local permits, licenses, and/or certifications, which may be required.

SUBSURFACE:

SUBSURFACE INVESTIGATIONS AS THEY RELATE TO THIS

SITE/EASEMENT:
THE CONTRACTOR SHALL BE RESPONSIBLE FOR
REPAIRING ANY DAMAGED ITEMS DURING CONSTRUCTION
INCLUDING, BUT NOT LIMITED TO, EXISTING ROADS,
FENCES, SIDEWALKS, LANDSCAPING, CURB AND GUTTER,
SEWER LINES, MANHOLES, ETC.
ANY DRAINAGE TO PUBLIC INFRASTRUCTURE IN THE
VICINITY OF THE TEMPORARY CONSTRUCTION
ENTRANCE/EXIT SHALL BE REPAIRED TO THE
SATISFACTION OF THE OWNER. THE TEMPORARY
CONSTRUCTION ENTRANCE/EXIT SHALL BE REMOVED
AND RETURNED TO THE ORIGINAL CONDITION OR BETTER
AT THE END OF USE.
STAGING, STOCKPILES AND HAUL ROAD AREAS:
SPECIFIED AREAS SHOWN ON THE PLANS HAVE BEEN
ESTABLISHED AS ACCESS AND STAGING AREAS. THE
CONTRACTOR SHALL ESTABLISH STOCKPILE AREAS
ALONG THE PROJECT, AS NECESSARY, TO CARRY OUT
THE WORK. ALL STOCKPILE AREAS MUST BE INSIDE
THE LIMITS OF CONSTRUCTION AND APPROVED BY THE
DESIGNER. ADDITIONAL STOCKPILE AREAS SHOULD NOT
BE LOCATED WITHIN FORESTED AREAS. SILT FENCE
SHALL BE REQUIRED IN AREAS WHERE LOOSE SOIL HAS
BEEN PLACED IN THE STAGING AND STOCKPILING
AREAS.
TREE PROTECTION:
CONTRACTOR SHALL PREVENT DAMAGE TO TREES TO
REMAIN. IN THE EVENT OF DAMAGE, REPAIR ANY
DAMAGE TO THE CROWN, TRUNK, OR ROOT SYSTEM
IMMEDIATELY.
• REPAIR ROOTS BY CUTTING OFF DAMAGED
AREAS AND PAINTING THEM WITH TREE PAINT.
SPREAD PEAT MOSS OR MOIST TOPSOIL OVER
EXPOSED ROOTS.
• REPAIR DAMAGE TO BARK BY TRIMMING AROUND
DAMAGED AREA, TAPER THE CUT TO PROVIDE
DRAINAGE, AND PAINT WITH TREE PAINT.
• CUT OFF ALL DAMAGED TREE LIMBS ABOVE THE
TREE COLLAR AT THE TRUNK OR MAIN BRANCH.
USE A SEPARATE CUT TO AVOID PEELING BARK
FROM HEALTHY AREAS OF THE TREE.
• REFER TO THE NCDEQ EROSION CONTROL
MANUAL FOR MORE INFORMATION.
TRAFFIC CONTROL:
ALL TRAFFIC CONTROL SHALL BE IN ACCORDANCE WITH
THE LATEST EDITION OF THE WORK AREA TRAFFIC
CONTROL HANDBOOK (WATCH. WORK IN THE
RIGHT—OF—WAY OR STATE SYSTEM STREETS MAY
REQUIRE ADDITIONAL TRAFFIC CONTROL PROVISIONS.
REFER TO NCDOT WORK ZONE TRAFFIC CONTROL
PROGRAM, MUTCD AND NCDOT STANDARD DRAWINGS.
UTILITIES:
THE CONTRACTOR SHALL FIELD LOCATE ALL UTILITIES
INSIDE THE CONSTRUCTION CORRIDOR.
UTILITIES TO BE TRAVERSED BY CONSTRUCTION
EQUIPMENT SHALL BE APPROPRIATELY PROTECTED OR
BRIDGED TO PREVENT DAMAGE. THE CONTRACTOR
SHALL FURNISH ALL PROTECTION CROSSINGS REQUIRED
FOR ALL UTILITY CROSSINGS. PROTECTION CROSSINGS
SHALL BE INSTALLED AS REQUIRED TO PROTECT
EXISTING UTILITIES.
THE CONTRACTOR SHALL BE RESPONSIBLE FOR ANY
DAMAGE INCURRED TO ANY UTILITY LINES DURING THE
CONSTRUCTION PROCESS.
THE CONTRACTOR SHALL FOLLOW OSHA GUIDELINES
AND UTILITY OWNER GUIDELINES WHEN WORKING NEAR
UTILITIES.
THE CONTRACTOR SHALL CALL THE "CONTACT
ONE —CALL CENTER" BY DIALING 811 OR
1-800-632-4949 BEFORE DIGGING.
CONSTRUCTION SEQUENCE:
Mobilization
1. Mobilize equipment and materials to the site
and locate LOD.
2. Install the construction entrance/exit as
shown on the plans. Use the existing cleared
path on the right descending floodplain as
the primary access to the work areas. Add
crushed stone as needed to fill ponded areas
and protect the culvert crossing at
Tomahawk Branch.
3. Hardwood trees that require removal per the
plans shall be salvaged for on —site use.
4. Limit stripping to those areas that will be
graded within 3 days in order to minimize
subgrade softening.
5. The stems and root masses of exotic
invasive species (multi —flora rose, Japanese
honeysuckle, Chinese privet, etc.) generated
during grading operations shall be burned
on —site or disposed in approved off —site
locations. A permit from WNC Regional Air
Quality Agency (828.250.6777) is not
required, but burning must comply with
agency regulations.
6. Any stockpiled materials not used for backfill
within 7 days of excavation shall be
stabilized with temporary seed and straw
mulch.
Demobilization
7. Rip, seed and mulch haul roads and staging
areas.
8. Remove trash and debris and restore
disturbed areas to their pre —construction
conditions.
9. Remove construction entrance/exit.
Planting
10. Container/bare root plants and live stakes
shall be installed during the dormant season,
generally December through March.
