improvements to NC 115 in Wilkes County, North Carolina, Division 11, WBS 44691.1.1, TIP
R-5759 — State Funded
Dear Lori,
The North Carolina Department of Transportation (NCDOT) proposes to widen NC 115
(Statesville Road) from US 421 to 2nd Street in Wilkesboro, Wilkes County, North Carolina
(STIP No. R-5759). The project is approximately 3 miles in length, and proposes to construct a
median -divided roadway, maintaining the two existing lanes of traffic and adding protected left
turns lanes, 4-foot bike lanes, and a 5-foot sidewalk along the south side of the facility within the
North Wilkesboro municipal limits. Some intersections (N=4) will be upgraded to roundabouts to
improve traffic flow.
Protected Species/Section 7
As of 1/22/24, USFWS IPaC lists the following species (no critical habitats in the area):
Gray Bat, Northern Long-eared Bat (NLEB), Tricolored Bat (the latter is proposed, but not
currently listed). We are proposing a "May Affect, Not Likely to Adversely Affect" for all three
species.
Information related to Dotential effects to bats include:
- no caves or mines within the area.
- the project will involve tree clearing (approx. 16 acres of trees), but the majority do not provide
suitable summertime roosting habitat for bats (many < 3 inch DBH, and/or smooth bark species),
and much of the project area is best described as "Urban".
- any trees that could potential provide summertime habitat will only be removed during the
inactive bat season (Oct 15' to April 1).
- both temporary artificial lighting and night work will likely occur, for safety/traffic purposes,
but no new permanent lighting will be added as part of this project.
- percussion activities may include temporary use of mechanized hammers, and possibly blasting.
-work will involve lengthening, enlarging, and adding several culverts that could provide new
suitable habitat for a variety of bat species.

Bog turtle
The bog turtle is listed as Threatened due to Similarity of Appearance and is not afforded
protection under Section 7 of the ESA. Regardless, the wetlands within the study area are small,
and unlikely to provide habitat for bog turtles. As a result, the project should have "No Effect" on
Bog Turtles. A review of NHP records, updated October 2023, indicates no known occurrences
within 1.0 mile of the study area.

Temporary impacts to streams: 220'
Permanent impacts to wetlands: 0.04 acres (all permanent fill)
Potential mitigation needs for Streams: 285' at 2:1 = 570' and 83' at 1:1 = 83'. Total = 653'
Potential mitigation needs for Wetlands: 0.04 acres at 2:1 = 0.08 acres.
Mitigation — Mitigation is required for this project, but has not yet been obtained. Above, is a
current tally of impacts and initial mitigation estimate. Once USACE determines the mitigation
needed, NCDOT will immediately acquire it.

SUMMARY OF HISTORIC ARCHITECTURE AND LANDSCAPES REVIEW
Description of review activities, results, and conclusions:
Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was
undertaken on February 20, 2019. Based on this review, there are documented and
undocumented properties over fifty years of age within the Area of Potential Effects, which
follows the boundary of the Study Area. An Historic Architecture Survey was required and
performed Summer and Fall of 2020. The State Historic Preservation Office reviewed the
findings and offered comments on the eligibility report on March 19, 2021. Four properties are
determined eligible for National Register listing, and all other properties over fifty years of age
were determined not eligible for NR listing. There are two properties, the Wilkesboro Livestock

Description of review activities, results, and conclusions:
Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was
undertaken on February 20, 2019. Based on this review, there are documented and
undocumented properties over fifty years of age within the Area of Potential Effects, which
follows the boundary of the Study Area. An Historic Architecture Survey was required and
performed Summer and Fall of 2020. The State Historic Preservation Office reviewed the
findings and offered comments on the eligibility report on March 19, 2021. Four properties are
determined eligible for National Register listing, and all other properties over fifty years of age
were determined no eligible or no requiring further evaluation. The four properties that will
require an assessment of effects are attached.

the recommended boundaries depicted on page 6-12, which should in -chide the 1975 cattle sheds to the
north of the Li--enwk Market_ The cutoff date for the proposed Period of Significance is 1970,
corresponding with the fbunder's death and change in management. Howc%Tf, the property is not
considered eligible under Criterion B, which would male 19-0 an appropriate end to the POS. That
management changed and continued to use the facility for its original purpose, indicates a continuation of
the property's historic associations and suggests that a more appropriate aunff date would be at least 1971.

Because the sheds were constructed in 1975, and because that's only four years past the flow-50-year cutoff
date of 1971, mean that it is reasonable to include the livestock sheds as contributing stnictuies on the site
without having to claim Criteria Consideration G for exceptional significance. We recommend revising the
PDS to 1947-1975, when the last major resources related to livestock production were built. While there
appear to be other secondary- structures on the morthem parcel that contains the 1975 lh estock sheds,
insufficient data on these resources (whose W,.ely ephemeral nature may make construction dates difficalt
to •detenume) mearus they can be excliWed front the National Register boundaries, which are sholam on the

We do not emm with the consultant's assessment that the Carolina Motor Court and Cafe are ineligible
far listing in the National Register. While the 1925 cafe has lost integrity and the altered 1970 ranch house
has only a loose association with the complex due to temporal distance from the 1938 cottages, a closer
analysis ofthe property is vs-arranted. Tourist camps and couits from the 1920s through the 1960s are
considered eligible under Criterion A in the area of eIILerta u nmVrecreation, rather than Criterion C: for
architectural sigriifuance. Such tourwt camps and courts ;{sere very common across westem Notth Carolina,
with k-wer-rema� as the decades pass. With the rise in popularity of tourist camps in the 1930s, the
193 S construction of the C:arolum Motor Court is unsurprising- especially- in the mountainous -western
region where outdoor recreation "-as popular. Givan the nuinImi of cabins built and the popularity of these
places during the second quarter of the 20th century, the clientele likely included a mix of patrons over the
years. Although five of the two -unit cottages ha,�T been altered to serve as single -unit dwellings, five two -
unit cottages ha-,,.e their original plans and four original four -unit cottages remain extant. The cottages retain
their overall form and exterior matey at s, including original a ndonw-, and exposed rafter tails below front -
gabled roofs. The recommended boundary is set at the tax parcel line to incorporate as a contributing
feature the m-erall site, .vhich includes the circulationpatterns and access from Statewille Road.
WKM507 (Thomas Beckley James House) is eligible for listing inthe National Register ofIlistoric Places
under Cnter-ion C for its airhitectural significance.

Project Description:
Widen NC 115 from US 421 to 2nd Street in Wilkesboro in Wilkes County. Area of Potential
Effects (A.P.E.) is approximately 5 kilometers (3.1 miles) long and 122 meters (400 ft.) wide. No
design plans provided. The project is State -funded, and will require Federal permits. Easements
will be required.
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
The review included an examination of a topographic map, an aerial photograph, and listings of
previously recorded sites, previous archaeological surveys, and previous environmental reviews at
the Office of State Archaeology (O.S.A.). NC 115 is oriented northwest to southeast, but is
considered north -south for this review.
The topographic maps (Wilkesboro/Roaring River) show the A.P.E. is located on a ridge system.
It crosses a creek near the south end, and crosses the Yadkin River at the north end. The landforms
in the A.P.E. are mostly ridge tops and side slopes. The A.P.E. at the north end includes level
flooplain along the Yadkin River. There are many structures shown along the road.
The aerial photograph shows the landuse in the A.P.E. is a mix of wooded land, cleared land, and
developed land. There are many houses along the road. The Yadkin River floodplain at the north
end is densely developed.
A review of information at the O.S.A. shows there are no previously recorded sites within the
A.P.E. The south and north ends of the A.P.E. are within areas that have been previously surveyed
for archaeological sites. Hopkins (1990) conducted a survey for proposed improvements to US
421 that included the south end of the A.P.E. Reid (1999) conducted a survey for the proposed
Frontier Energy gas line that included the north end of the A.P.E. along the west side of the Yadkin
River. There are several projects in the A.P.E. that have been reviewed by the State Historic
Preservation Office (HPO) (see topographic map below).

Most of the landforms in A.P.E. have a low to moderate potential for prehistoric archaeological

the north end of the A.P.E. This area has been disturbed by dense development.

Project Location: N.C. 115 (Statesville Road) in Wilkes County
Project Description: The North Carolina Department of Transportation (NCDOT) is
proposing to upgrade the existing NC 115 (Statesville Road) from US 421 to NC 18 (2nd
Street) in North Wilkesboro, Wilkes County (see enclosed Vicinity Map). The project is
approximately 3 miles in length. An Environmental Features Map is also enclosed.
The project proposes to construct a median -divided roadway, maintaining the two
existing lanes of traffic and adding protected left turns lanes, 4-foot bike lanes, and a
5-foot sidewalk along the south side of the facility within the North Wilkesboro
municipal limits. Some intersections will be upgraded to roundabouts to improve traffic
flow. In some areas, a 16-foot left turn lane will be provided. The proposed
improvements include 4-foot bike lanes. The proposed improvements vary along NC 115,
depending on roadway segment.
The proposed project is included in the 2018-2027 State Transportation Improvement
Program (STIP). Right of way acquisition and construction are scheduled for state fiscal
years 2019 and 2021, respectively.
The project needs are to improve the alignment of intersections, improve sight distances,
address traffic queuing at C.C. Wright Elementary School during drop-off and pickup,
and provide shoulders to allow stalled vehicles to safely pull over.
Anticipated Permit or Consultation Requirements: An Individual Permit for linear
transportation projects may be required for impacts to Waters of the U.S. resulting from
this project. The U.S. Army Corps of Engineers (USACE) holds the final discretion as to
what permit will be required to authorize project construction. It is anticipated that
impacts will be reduced during final design development. Anticipated impacts to streams
will also require a Section 401 Water Quality General Certification.

Question 9: Endangered Species. The USACE has developed a Standard Local
Operating Procedure for Endangered Species (SLOPES) to address Northern Log -eared
Bat (NLEB), Myotis septentrionalis, when they are the lead agency, which NCDOT will
follow for this project. This procedure applies to projects in NCDOT Divisions 9-14. The
requirements of the SLOPES for NLEB, in addition to the already completed structure
assessment, will be completed prior to Let and will be submitted to USACE. The
Biological Conclusion will remain as "Unresolved' until this additional information is
available.
Question 10: Stream and Wetland Impacts. Based on current conceptual design slope
stake limits for the preferred alternative, buffered by 25 feet, the proposed project would
impact 0.1 acre of wetlands and 1,240 feet of stream. Impacts by stream and wetland are
shown in Table 2. Stream impacts are reported to the nearest 10 feet, wetland and buffer
impacts to the nearesttenth of an acre.

1.0 INTRODUCTION
The North Carolina Department of Transportation (NCDOT) proposes to widen NC 115
(Statesville Road) from US 421 to 2nd Street in Wilkesboro, Wilkes County, North
Carolina (STIP No. R-5759; Figures 1-2). The following Natural Resources Technical
Report (NRTR) has been prepared to assist in the preparation of a state -funded State
Minimum Criteria Determination Checklist (MCDC), which will be prepared in
accordance with the State Environmental Policy Act (SEPA).
2.0 METHODOLOGY
All work was conducted in accordance with the NCDOT Environmental Coordination
and Permitting's (ECAP) Preparing Natural Resources Technical Reports Procedure and
the latest NRTR Template (November 2017). Field work was conducted on January 8,
2019. Potential jurisdictional areas identified in the study area are expected to be verified
by the United States Army Corps of Engineers (USACE) and the North Carolina Division
of Water Resources (NCDWR). It is anticipated that the USACE will cover the potential
features associated with this project under a Preliminary Jurisdictional Determination
(PJD). The principal personnel contributing to the field work and document are provided
in Appendix B.
3.0 TERRESTRIAL COMMUNITIES
Six terrestrial communities were identified in the study area. Figure 4 shows the location
and extent of these terrestrial communities. Terrestrial community data are presented in
the context of total coverage of each type within the study area (Table 1).

4.0 PROTECTED SPECIES
4.1 Endangered Species Act Protected Species
As of June 27, 2018, the United States Fish and Wildlife (USFWS) lists three federally
protected species, under the Endangered Species Act (ESA), for Wilkes County (Table
2). For each species, a discussion of the presence or absence of habitat is included below
along with the Biological Conclusion rendered based on survey results in the study area.

June 15 (optimal for breeding/nesting); May 1-June 30 (trapping surveys)
Biological Conclusion: Not Required
Species listed as threatened due to similarity of appearance do not require Section
7 consultation with the USFWS. Moreover, suitable habitat (open, spring -fed,
emergent wetlands) is not present within the study area. A review of the April
2019 North Carolina Natural Heritage Program (NCNHP) database indicates no
known bog turtle occurrences within 1.0 mile of the study area.
Northern long-eared bat (NLEB)
USFWS Optimal Survey Window: June 1 — August 15
Biological Conclusion: May Affect, Not Likely to Adversely Affect
Habitat for NLEB is present within the project study area. Since this project is
state -funded, the USACE will act as the lead agency for issues related to NLEB.
The USACE has developed a Standard Local Operating Procedure for
Endangered Species (SLOPES) to address NLEB when they are the lead agency,
which NCDOT will follow for this project. The requirements of the SLOPES for
NLEB will be completed prior to Let and will be submitted to USACE.
Information related to this species will be provided by the NCDOT — Biological
Surveys Group (BSG). A review of the April 2019 NCNHP database indicates no
known NLEB occurrences within 1.0 mile of the study area.
Rusty -patched bumble bee
USFWS Recommended Survey Window: early -June — mid -August
Biological Conclusion: N/A
The USFWS lists RPBB as a historic record for Wilkes County. Additionally, the
USFWS does not and will not require surveys for RPBB in North Carolina
because USFWS assumes the state is unoccupied by RPBB. Therefore, surveys
for this species are not needed. A review of the April 2019 NCNHP database
indicates no known occurrences within 1.0 mile of the study area.
4.2 Bald and Golden Eagle Protection Act
The bald eagle is protected under the Bald and Golden Eagle Protection Act and enforced
by the USFWS. Habitat for the bald eagle primarily consists of mature forests in
proximity to large bodies of open water for foraging. Large dominant trees are utilized
for nesting sites, typically within 1.0 mile of open water.
A desktop-GIS assessment of the study area, as well as the area within a 1.0-mile radius
of the project limits, was performed on January 7, 2019, using the most currently -
available orthoimagery. Water bodies large and sufficiently open enough to be

considered potential feeding sources were identified. Since foraging habitat was present
within the review area, a survey of the study area and the area within 660 feet of the
project limits was conducted on January 8, 2019 by Three Oaks staff. No bald eagles or
nests were observed. A review of the April 2019 NCNHP database revealed no known
occurrences of bald eagle within 1.0 mile of the study area. Due to the lack of
individuals, nests, or known occurrences, it has been determined that this project will not
impact this species.
5.0 WATER RESOURCES
The study area is part of the Yadkin — Pee Dee River Basin (United States Geological
Survey [USGS] Hydrologic Unit [HUC] 03040101). Nine potential streams were
identified in the study area (Table 3). The location of each stream is shown on Figures 2
— 4.

downstream of the study area. There are no NCDWR-designated trout waters within the
study area or within 1.0 mile downstream of the study area and the project is not within a
USACE-designated trout watershed. Additionally, the North Carolina Wildlife
Resources Commission (NCWRC) does not list any trout waters within or within 1.0 mile
downstream of the project. The North Carolina 2016 Final 303(d) list of impaired waters
identifies the Yadkin River within the study area as an impaired water. The Yadkin River
(Assessment Unit No. 12-[38]b) is listed as impaired due to Copper.

6.0 REGULATORY CONSIDERATIONS
6.1 Clean Water Act Waters of the U.S.
Nine potential jurisdictional streams were identified in the study area (Table 5). The
locations of these streams are shown on Figures 2 — 4. NCDWR Stream Identification
Forms are included in a separate PJD Package. All potential jurisdictional streams in the
study area have been designated as cool water streams for the purposes of stream
mitigation.

6.2 Construction Moratoria
No designated trout waters are located within the study area or within 1.0 mile
downstream of the study area. Therefore, no in -water moratoria are anticipated at this
time. Additionally, bat -related moratoria are also not anticipated for this project.
6.3 N.C. River Basin Buffer Rules
This project is located in the Yadkin — Pee Dee River Basin (USGS HUC 03040101).
Therefore, potential jurisdictional features within the study area are not subject to
streamside riparian zones protected under provisions administered by the North Carolina
Department of Environmental Quality (NCDEQ).
6.4 Rivers and Harbors Act Section 10 Navigable Waters
The USACE has not designated any waters in the study area as Navigable Waters under
Section 10 of the Rivers and Harbors Act.

SUBJECT: Section 7 survey results for the gray bat (Myotis grisescens, MYGR), northern
long-eared bat (Myotis septentrionalis, MYSE), tricolored bat (Perimyotis
subflavus, PESO, and little brown bat (Myotis lucifugus, MYLO, associated with
the widening of NC 115 from SR 1522 to US 421 to Second Street in Wilkes
County, TIP No. R-5759.
The North Carolina Department of Transportation (NCDOT, Division 11) proposes to widen NC
115 from US 421 to Second Street in Wilkes County, TIP No. R-5759. Bridge No. 960048 and
Bridge No. 960052 occur in the project footprint. Four culverts meeting NCDOT's Standard
Operating Procedures for Preliminary Bat Habitat Assessments were identified meeting the
criteria of greater than 3 feet wide and 60 feet in length during this site visit. None of the
structures are slated for replacement.
On July 20, 2023, RK&K biologists assessed all of the structures in the project study area.
Potential roosting habitat is present on both bridges in the form of crevices. Potential roosting
habitat is present within all culverts in the form of rough surfaces or crevices. See Table 1 for
detailed information on all the structures. Trees greater than 3" dbh are present in the project
area. There are no known caves or mines within one half mile of the project footprint and no
caves or mines were observed during the field visit. Large, continuous forests are present in the
project vicinity, providing potential foraging and commuting habitat.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be" waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following

X There are waters, including wetlands, on the above described property/project area, that may be subject
to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and
Harbors Act (RHA) (33 USC § 403). The waters, including wetlands, have been delineated, and the
delineation has been verified by the Corps to be sufficiently accurate and reliable. Therefore this
preliminary jurisdiction determination may be used in the permit evaluation process, including
determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation
requirements, and other resource protection measures, a permit decision made on the basis of a
preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted
activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not
an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR
Part 331). However, you may request an approved JD, which is an appealable action, by contacting the
Corps district for further instruction.
_ There are waters, including wetlands, on the above described property/project area, that may be subject to
Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act
(RHA) (33 USC § 403). However, since the waters, including wetlands, have not been properly delineated, this
preliminary jurisdiction determination may not be used in the permit evaluation process. Without a verified
wetland delineation, this preliminary determination is merely an effective presumption of CWA/RHA
jurisdiction over all of the waters, including wetlands, on the property/project area, which is not sufficiently
accurate and reliable to support an enforceable permit decision. We recommend that you have the waters,
including wetlands, on the property/project area delineated. As the Corps may not be able to accomplish this
wetland delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can
be verified by the Corps.
B. Approved Determination
There are Navigable Waters of the United States within the above described property/project area that are
subject to the permit requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and
Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in law or our published
regulations, this determination may be relied upon for a period not to exceed five years from the date of this
notification.
_ There are waters of the U.S., including wetlands, in the above described property/project area, that are subject
to the permit requirements of Section 404 of the Clean Water Act (CWA) (33 USC § 1344). Unless there is a

there is no change in the law or our published regulations, may be relied upon for a period not to exceed five

This letter only addresses the features specifically marked on the maps provided and does not apply to other
drainage features further downstream from NCDOT's project area, or to any other drainage features in the vicinity.
This letter only addresses the applicability to the Mitigation Rule and does not approve any activity within Waters of
the United States, or Waters of the State. Any impacts to wetlands and streams must comply with 404/401
regulations, water supply regulations (I 5A NCAC 2B .0216), and any other required federal, state and local
regulations.
The owner (or future owners) or permittee should notify NCDWR (and other relevant agencies) of this
determination in any future correspondences concerning this property and/or project. This determination shall
expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by NCDWR or Delegated Local Authority that a
surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A
request for a determination by the Director shall be referred to the Director in writing c/o Amy Chapman, NCDWR
Wetlands/401 Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.

Individuals that dispute a determination by NCDWR or Delegated Local Authority that "exempts" a surface water
from the mitigation rules may ask for an adjudicatory hearing. You may obtain the petition form from the office of
Administrative hearings. You must file the petition with the office of Administrative Hearings within sixty (60)
days of receipt of this notice and the date the affected party (including downstream and adjacent landowners) is
notified of this decision. A petition is considered filed when it is received in the office of Administrative Hearings
during normal office hours. The Office of Administrative Hearings accepts filings Monday through Friday between
the hours of 8:00am and 5:OOpm, except for official state holidays. The original and one (1) copy of the petition
must be filed with the Office of Administrative Hearings.
The petition may be faxed -provided that the original and one copy of the document is received by the Office of
Administrative Hearings within five (5) business days following the faxed transmission.
