Subject: Notice of Violation and Assessment of Civil Penalty for Violations of the
NC General Statute 143-215.1(a)(6) and NPDES Permit # NCO069523
Tallwood Estates WWTP

To Wastewater Branch:
Please find enclosed a check from the City of Charlotte in the amount of $496.97 that has been
assessed to Union Count Public Works (UCPW) for violations that occurred at the above
referenced facility.
Please note that this facility, while owned by UCPW, has been operated and maintained by
Charlotte Water per an inter -local agreement between the two agencies as of June 1, 2014.
Charlotte Water is paying the civil penalties for these violations.
Earlier this year, UCPW and Charlotte Water submitted a joint letter asking for remission of the
NOV and any potential civil penalties due to the fact that Charlotte Water was not aware. of the
higher organic loadings that were coming into the plant and was not able to adjust the plant to
prevent the permit limit excursion.
While we are paying the civil penalty as directed and we are not choosing to ask for further
remission, we still affirm that the civil penalty may not be warranted as this facility has been in
full compliance with rigorous sampling and analytical protocols since this time.
