I may be missing something with the additional information you sent for Town Center Apartments, but I just wanted to make sure that a couple of things are understood. The 401 Water Quality Certification that corresponds to NWP 29 requires structural stormwater BMP's for developments that exceed 24% impervious. The application indicates that Town Center Apartments is 30% impervious. Here's a link to the 401 language: 1 illy: The engineer for this project can't determine that structural stormwater BMP's aren't needed. The only scenario whereby stormwater BMP's would not be incorporated into a project such as this one is if the City of Raleigh had a local ordinance that superseded the 401 stormwater requirement. The only time I've seen this come into play is when a development is adjacent to a 100 year floodplain, and it looks like that could be the case with this development. If this development is associated with a 100 year floodplain, and Raleigh won't allow stormwater detention, then the project will still need to comply with diffuse flow requirements since it's in the Neuse River Basin. Again, please let me know if I've failed to communicate clearly or if I'm missing something with this project. Thank you.
