Description of projects area and activity: This verification authorizes the use of Nationwide Permit 29 to permanently impact 0.062 acre of wetland for the purpose of accessing developable portions of Everwood Subdivision Phase II.The impacts would occur in three locations.Impact 1 would permanently fill 0.035 acre of Wetland G to accommodate culvert and road fill for the construction of Street A.Impact 2 would permanently fill 0.014 acre of Wetland G to accommodate culvert and fill to construct a residential driveway to access Lot 52.Impact 3 would permanently fill 0.013 acre of Wetland E to accommodate culvert and fill to construct a residential driveway to access Lot 84.No stream,open water,or other wetland impact is authorized. No impacts to wetland,stream,or open water resources is authorized to construct subsurface waste disposal systems.Per the attached report from Southeastern Soil&Environmental Associates,Inc,directional bores would be utilized to connect Lots 44,54,55,70,75,76,81,82,and 84 to septic and/or repair areas. Applicable Law(s): ❑X Section 404(Clean Water Act,33 USC 1344) ❑Section 10(Rivers and Harbors Act,33 USC 403) Authorization: NWP 29.Residential Developments SPECIAL CONDITIONS The following deed notification shall be included in the recorded restrictive covenants for the subdivision before property containing wetlands(Lots 28-33,35-39,43-49,52-56,59,60,66-77,81-85,and 93s)is conveyed.Any alteration to this language must be approved before incorporation. "A portion of subdivision has been determined to meet the requirements for designation as a wetland.Any subsequent fill or alteration of this area shall conform to the requirements of the federal rules addressing wetland impact noted in the Code of Federal Regulations at the time of the proposed alteration. The intent of this provision is to prevent additional wetland and stream impact,so the property owner should not assume that a future application for filling or alteration would be approved. The property owner shall report the name of the subdivision in any application pertaining to said rules.This covenant is to run with the land and shall be binding on all parties and all persons claiming under them." Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order,a restoration order,a Class I administrative penalty,and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended,revoked,or is modified,such that the activity would no longer comply with the terms and conditions of the nationwide permit,activities which have commenced(i.e.,are under construction) or are under contract to commence in reliance upon the nationwide permit,will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration,modification or revocation,unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.
