Dear Permittee:
Enclosed is a copy of the Pretreatment Compliance Inspection (PCI) Report for the inspection of the City of
Whiteville's Industrial Pretreatment Program on February 14, 2024, by Helen Perez of this Office. This Office would
like to thank all staff for their cooperation and assistance provided throughout the inspection.
This report is being issued as a Notice of Violation (NOV) due to the City's failures to properly implement the Division -
approved Industrial Pretreatment Program. Specially, the City failed to do the following:
- Properly renew the Industrial User Permits (IUP) for HERR (Terra Nova) prior to the expiration date;
- Submit the draft IUP for Columbus Regional Healthcare to the Division for review 30 days prior to the effective
date;
These failures are violations of North Carolina General Statute (G.S.) 143-215.1, 15A North Carolina Administrative
Code (NCAC) 2H .0900 and subject NPDES Permit. Please be advised that in accordance with G.S. 143-215.6A, a
civil penalty assessment of not more than twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars
($25,000.00) per day when the violation is of a continuing nature, may be assessed against any person who violates
or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-
215.1.
It is requested that the City issue a new IUP to HERR (Terra Nova) and submit the new IUP to the Division for review
30 days prior to the effective date of the permit by March 31, 2024. In addition, please submit an electronic copy
of the new permit to Helen Perez.
