Box 1006 Liberty,NC 27298 Subject: Return of Check# 50856 Town of Liberty Civil Penalty & SOC Annual Fee Payments Permit Numbers: WQ0003090& WQCS00280 1 SOC Number: S19-001, Ad. 1 Randolph County Dear Ms. Bond: Per your request as communicated to me in our February 20, 2024 email exchange,please find attached the Town of Liberty's check number 50856, in the amount of$2,750.00. The check had been submitted to serve as payment for civil penalty assessments and a Special Order by Consent(SOC) annual fee for 2024. As DWR staff worked to process the check, errors were discovered within the text of the civil penalty assessment documents that had been sent to the Town. These errors hindered the Town's ability to prepare a check that would accurately address the civil penalty and fee payment obligations. After consultation with you, return of the initial payment was determined to be best way to proceed until matters associated with the documents were resolved and a precise amount of outstanding civil penalties was tallied and communicated to the Town. We regret the inconvenience this has caused and hope to have these matters resolved in short order. It is my understanding that the Winston-Salem Regional Office has prepared and sent to you corrected documents in the matters of DWR civil penalty assessment cases DV-2023-0030, DV-2024-0010 and SP-2024-0005. Attached with this letter, please find a copy of the Division's January 23, 2024 letter to the Town, calling for payment of the $500.00 annual fee associated with the Special Order by Consent (SOC)the Town has entered into with the North Carolina Environmental Management Commission. It is requested that payment tendered by the Town to address or satisfy fee payments and penalties be made via two separate checks. While we understand this may be a further inconvenience to the Town, it will be very helpful to us. Processing of fee payments and penalties are managed by different areas within our operation and the ultimate destinations of the funds will be in different accounts. Separate payments will help to ensure efficient processing.
