Ly,nc_L Printed Name 0"U":5�),r'A N�a Cer' 0g'L Title NARRATIVE SUMMARY GENERAL INFORMATION: GENERAL PROGRAM INFORMATION: During this reporting period, the City did modify the Headworks Analysis by updating the removal rate for Total Phosphorus and Total Nitrogen. The revised HWA was submitted to the State on January 3, 2023. The POTW did not modify any of the other Pretreatment Program Elements. The POTW reviewed the "Pretreatment Program Info Database"sheet. A copy of the "Pretreatment Program Info Database" is attached with noted corrections. GENERAL PERMIT INFORMATION: Effective June 27, 2022, the City of Mount Holly and American & Efird (A&E) entered into a Consent Agreement with relaxed limits for BOD, COD, Total Nitrogen, and Total Phosphorus. The Agreement allowed A&E time to determine the appropriate pretreatment system to install and met the IUP limits. The Consent Agreement was revised during this reporting period to adjust the milestone dates. A copy of the "First Amendment" Constent Agreement is attached. The POTW reissued industrial user permits to all SIUs with an effective date of January 1, 2023. The City received a written letter in December 2022 from both Daimler and A&E requesting an adjudicatory hearing. Both SIUs are adjudicating various permit limitations. The limitations were developed based on the City of Mount Holly discharging to Charolette Water sometime in 2024. The SIU Permits were sent to the State on December 1, 2022. The State was informed of the SIU Permit adjudications in January, 2023. During the adjudication period of January 1, 2023 through December 31, 2023, the POTW revereted to the expired permit for compliance judgement. During this reporting period, the Permit Adjudication for A&E and Daimler was resolved. After several meetings and discussion the adjudication was resolved by negogiation and settled without a formal hearing. The Total Nitrogen and Total Phosphorus limit was increased in the IUP for Diamler. The Mercury limit was increased in the IUP for A&E. The Industrial User Permits were issued to both SIUs with an effective date of January 1, 2024. The revised Permits were sent to the State and approved by letter dated November 14, 2023. SIU INFORMATION: 1. American & Efird (A&E), IUP#1157 SIGNIFICANT NONCOMPLIANCE (SNC) INFORMATION: None. OTHER INFORMATION: The City of Mount Holly and American & Efird (A&E) entered into a Consent Agreement with increased limits for BOD, COD, Total Nitrogen, and Total Phosphorus. The Agreement became effective on June 27, 2022. The Agreement allowed A&E time to determine the appropriate pretreatment system to install and meet the IUP limits. The Permit Adjudication was resolved in October, 2023 and the Consent Agreement was revised with an effective date of November 27, 2023. As of date of this report, A & E has meet the milestone dates in the Agreement. During the reporting period, A & E exceeded the permit limit for Flow and the Consent Agreement limitation for Total Nitrogen. A & E attributed the Nitrogen violation to the manufacturing process chemicals they are using. A&E was sent a Notice of Violation in accordance with the City's Enforcement Response Plan and Consent Agreement. A & E was assessed penalties in accordance with the Consent Agreement in the amount of$1,000.00. The POTW completed the sampling and monitoring as required by the Permit. Also, an on-site inspection was completed by the POTW. 2. Clariant Corporation, IUP#1158 SIGNIFICANT NONCOMPLIANCE (SNC) INFORMATION: No SNC Events. OTHER INFORMATION: During the first compliance period, Clariant exceeded the daily maximum permit limitation for Total Phosphorus. A Notice of Violation was sent in accordance with the City's Enforcement Response Plan. The POTW completed the sampling and monitoring as required by the Permit. Also, an on-site inspection was completed by the POTW. 3. Daimler Trucks North America, IUP#1163 SIGNIFICANT NONCOMPLIANCE (SNC) INFORMATION: No SNC Events. OTHER INFORMATION: During the first and second compliance period, Daimler exceeded the daily maximum Permit limit for Total Nitrogen. A Notice of Violation was sent for each violation and penalties assessed in the amount of $4,000.00 of which payment was submitted in 2024. This penalty collection amount will be captured in the 2024 Pretreatment Annual Report. The POTW completed the sampling and monitoring as required by the Permit. Also, an on-site inspection was completed by the POTW. The COMPANY operates a textile manufacturing operation at 20 American Street, Mount Holly, Gaston County,North Carolina(the"FACI.LITY"). B. The COMPANY currently operates the FACILITY under Industrial User Pretreatment Permit No. 1157 for the discharge of wastewater into the City of i Mount Holly Wastewater'rreatment Plant(the"W WTP"),signed on June 30,2020 ! with an effective date of August 1, 2020 (the "PERMIT"). C. Nonetheless, the CITY determined that the COMPANY is in Significant Non-Compliance("SNC") for priorBOD violations as documented in a Penalty Assessment issued by the City dated January 28, 2022, and the FACILITY has received Notice of Violations ("NOVs") for various exceedances of the above-referenced parameters. F. The COMPANY has determined that,given the approaching July 1,2022 reduction in the parameter limits (among other reasons), designing and implementing pretreatment is most likely needed to achieve consistent and continuous compliance with the PERMIT and the associated parameter limits. G. The PARTIES desire to resolve any outstanding compliance and enforcement actions and provide an opportunity to the COMPANY to conduct a treatability study, procure and install pretreatment equipment and implement pretreatment processes in order for the FACILITY to achieve consistent and continuous compliance with the PERMIT. H. The COMPANY desires a temporary increase of the permit limit for BOD,CBOD, Total Nitrogen and Total Phosphorus while determining treatment alternatives to meet the final permit limits. THEREFORE, in consideration of the foregoing, the PARTIES desiring to resolve and settle the matters described above,have agreed to enter into this AGREEMENT with the following terms and conditions: II. The COMPANY hereby agrees to undertake and perform the following: A. By no later than five (5) months following date of installation of the pretreatment system at the FACILITY (as reported by the COMPANY as required below), complete a pretreatment system Performance Evaluation and submit to the CITY; (i) a written engineering report documenting the Performance Evaluation; and (ii) an Operating & Maintenance Plan including operational strategies, chemical dosage rates, schedule of PPAB 6927328v2 3 Document Number: Page 4 oversight, typical daily work tasks and schedules for operators, process control tests and procedures, and maintenance requirements and schedule; 6. By no later than seven (7) months following date of installation of the pretreatment system at the FACILITY, comply with all applicable and effective parameter limits in the PERMIT; 7. By no later than nine (9)months following installation of the pretreatment I system at the FACILITY, submit to the CITY a signed roster of the I operators which were provided operating training on the operation and !. maintenance of the pretreatment system; 8. Within 7 days of final completion of the project the COMPANY shall send the CITY a certified letter of final completion, including submittal of a signed roster of operators per Section II.C.7 above. The final Completion 1 letterwill complete this agreement and Final Effluent Limitations will be in full effect. The COMPANY shall notify the CITY by email within three (3)business days of t completion of eadh milestone set forth in this Section II.0 of the AGREEMENT.If the COMPANY fails to meet a milestone date, a detailed written report shall be submitted to the CITY within seven(7)business days following the milestone date, including a statement explaining the cause ofthe failure,any remedial actions taken by the COMPANY to prevent or minimize the event or delay, and the schedule by which those measures will be implemented, The CITY may send the COMPANY notice of violation and an assessment of the associated stipulated penalty pursuant to Section III below within 30 days of the date for which a milestone must have i been achieved. D. The PARTIES agree that: 1. The COMPANY shall perform each of the activities set forth in Section II.B. and Section II.0 of this AGREEMENT on or before the dates set forth therein unless such dates are extended by agreement between the PARTIES for good cause, and the CITY will not unreasonably withhold its consent to such extensions. Any request for extension must be submitted to the CITY in writing at least thirty(30)days prior to such date,or as soon as practicable for unanticipated delays. Upon the CITY's review of an agreement to the extension request, this AGREEMENT will be revised accordingly and signed by both PARTIES. 2. The COMPANY's obligation to comply with the requirements set forth in this AGREEMENT also may be delayed or excused to the extent that noncompliance is caused by circumstances beyond the reasonable control of the COMPANY including, without limitation, extraordinary shipping delays or supply chain disruptions that cannot be reasonably avoided or sufficiently minimized by the COMPANY. Failure to obtain funding will not be considered events beyond the COMPANY's reasonable control. If any such delaying event occurs, the COMPANY shall notify the CITY in PPAB 6927328v2 4 Document Number: Page 5 writing within fourteen (14) days of encountering or discovering the delaying event, describing in detail the event or delay, the precise cause(s) of the event or delay, the measure(s) taken and to be taken by the COMPANY to prevent or in inim ize the event or delay,and the schedule by which those measures will be implemented. The COMPANY agrees to source possible alternatives to minimize delays where applicable. If non- compliance with this AGREEMENT was caused by circumstances beyond the reasonable control of the COMPANY,the PARTIES shall stipulate and agree to a written modification of this AGREEMENT. I1I. The COMPANY agrees that, unless performance is excused or extended in accordance with the terms of this AGREEMENT, the COMPANY shall pay stipulated penalties according to the following schedule: Violation of interim effluent limits $250 for each violation for Total Phosphorus, Copper, Zinc, CBOD, and Total Nitrogen Violation for failure to monitor* $250 per day for missed sample Failure to meet the deadlines set forth $1,000 for the missed deadline, in Section H.B. and Section H.C.1., .3, with an additional $500/week for .4, .5 acid/or .7 contained herein. each week beyond the deadline until the milestone is achieved. Failure to achieve final compliance $15,000 per month with all applicable and effective parameter limits in the PERMIT as set forth in Section II.C.6.** * Should the failure to monitor result from a laboratory accident/error, the COMPANY must provide the CITY with a written explanation including a letter from the laboratory stating the cause of the accident and corrective actions. The explanation must be included with the monthly Industrial A&E Report for the month that the violation occurred. Upon review of the explanation, the CITY may waive the penalty. After the COMPANY demonstrates and notified the CITY of compliance with all applicable and effective parameter limits in the PERMIT as set forth in Section II.C.6, but before the AGREEMENT is terminated when the COMPANY submits a signed roster of operators to the CITY pursuant to Section X, exceedances of the parameter limits in the PERMIT may incur penalties pursuant to the City of Mount Bolly Sewer Use Ordinance, but shall not incur the$15,000 penalty set forth in this schedule. The PARTIES agree that exclusive jurisdiction and venue for any action involving the interpretation,enforcement,or breach of this AGREEMENT shall be heard before the State or Federal Courts sitting in North Carolina. VI. Should any provision of this AGREEMENT be declared by a court of competent jurisdiction to be inconsistent with Federal or State law and therefore unenforceable,the remaining provisions hereof shall remain in full force and effect. VII. Except as otherwise set forth herein,this AGREEMENT is not and shall not be interpreted to be a permit or modification of an existing permit under Federal, State, or local law, and shall not be construed to waive or relieve the COMPANY of its obligations to comply in the fiture with any permit. VIII. The PARTIES may jointly stipulate and agree to modify this AGREEMENT at any time by written agreement signed by both PARTIES. IX. The CITY reserves the right to modify this AGREEMENT should the wastewater discharge from the FACILITY cause interference, pass through or upsets at the WWTP. X. This FIRST AMENDMENT to the AGREEMENT is effective upon execution by the CITY and the COMPANY (the "EFFECTIVE DATE") and shall terminate when the COMPANY satisfies its obligations in accordance with Section II.C.8 of this AGREEMENT to submit assigned roster of operators and an Operating & Maintenance Plan to the CITY.
