Enclosed please find two copies of the Town of Burgaw, WQCS00150 Pretreatment Annual
Report for the year 2023.

2023 Pretreatment Annual Report Narrative
A. General Program Information:
1. The Collection Systems permit, WQCS00150 remains effective June 28, 2018,
through February 28, 2026.
2. A Pretreatment Program Information Data Sheet was provided by the Municipal Unit,
and it can be found following this narrative. There was one correction to the PPID; the
last program audit was July 12, 2022, as listed in red text on the document.
3. There were no new SIUs in 2023.
4. LTMP pollutants of concern for the receiving POTW, Town of Wallace, were
included in the first half of 2023 semi-annual monitoring for all industries. A second
set of LTMP data was performed for two of the three industries during the second half
of 2023. The data are reported with IUP parameters on the IDSF sheets for each
industry.
5. The town was placed under a IUP by the Town of Wallace, IUP # TOW-002.
• The permit became effective August 1, 2023.
• The Town of Burgaw has continued to conduct its monthly monitoring and
reporting as required under TOW-002.
B. Industrial Users and Compliance Information:
1. American Skin Food Group, LLC (IUP # 0004)
• This SIU was inspected once and sampled twice by the POTW during this PAR
year.
• This SIU performed all monitoring and reporting as required.
• The industry had two months during the first half of 2023 in which the monthly
average of TSS exceeded the permit limit, and both times in violation of the
technical review criteria.
o The exceedances occurred in February and April of 2023.
o Due to this, the industry was in SNC for the first half of 2023, which has
been included in the publication to the local newspaper.
o The industry identified both issues, stemming from errors in the operation
of the pretreatment equipment at the facility.
o The industry received notices of violation for both exceedances.
o The industry has corrected the operations and conducted re-training with
personnel.
o The industry returned to compliance for the remainder of 2023.
• There were no significant changes to the process during 2023.
• The industry permit remains in effect until December 31", 2026.
• The industry provided a reviewed/updated Spill and Slug Control Plan and Sludge
Management Plan on May 25 h, 2023. These have been reviewed by the POTW
and added to the file.

2. LL Building Products, Inc. (IUP # 0006)
• This CIU was inspected once and sampled twice by the POTW.
• This CIU performed all monitoring and reporting as required, was compliant, and
received no violations for this PAR year.
• In July of 2023, the industry notified the POTW that it planned to add a new
manufactured part and the part would be painted via the permitted portion of the
plant. The impact to the flow and pollutant loads was expected to be minimal. The
POTW approved the addition of the part to the process.
• The industry permit remains in effect until December 31', 2026.
• The industry provided an updated Spill and Slug Control Plan to the POTW on
January 5, 2023. This has been reviewed and added to the file.
3. Cardinal Foods, LLC. (IUP # 0007)
• This SIU was inspected once and sampled once by the POTW. The second
sampling event was scheduled for November of 2023. However, due to the
industry being placed under a cease discharge order for all process flow on
August 28, 2023, the POTW was unable to perform a second sampling event.
• The industry was in SNC for BOD and TSS for the first half of 2023 and failed to
provide data for Oil and Grease for the third week in June. The industry was in
SNC for BOD, TSS, pH and Oil and Grease for the second half of 2023 and failed
to provide data for pH and temperature for the third week in August. Notices of
violation and civil penalties were issued. The SNC has been published.
• The industry was operating under a renewed permit (October of 2022) which
allowed only cleanup and chiller water to be discharged to the POTW. All process
water was required to be pumped and hauled.
• On August 25t', 2023, heavy grease was found in the collection system and lift
station serving Cardinal Foods. The Town of Wallace was notified. On August
28t', after finding more grease in the system and identifying the industry as the
source of the heavy grease, Wallace was again notified. Additional samples were
collected at the lift station that discharges to Wallace and were found to be high in
BOD, TSS and Oil and Grease. It was later determined that the industry began
cooking sweet potatoes on site earlier in the month. This process was not
permitted, and wastewater from the cooking should not have been discharged to
the POTW. As a result of this, and continuing non-compliance, a Cease Discharge
order was issued to the industry. The order disallowed all wastewater from the
facility with the exception of domestic, and required the industry to remain on
pump -and -haul for all process wastewater, cleanup water and chiller water. The
notice required the industry to utilize pretreatment equipment and provide data to
the POTW demonstrating compliance before the Town would lift the order.
• Copies of the notices of violation and the Cease Discharge order are included in
this report.

Public Notice
The Town of Burgaw, in accordance with Federal and State Regulations, is hereby giving
public notice. Listed below are Significant Industrial Users of the Town of Burgaw
Publicly Owned Treatment Works (POTW) that were in Significant Non -Compliance
with national pretreatment regulations 40 CFR Part 403, state pretreatment regulations 15
NCAC 2H .0900, or local pretreatment regulations at any time during the 2023 calendar
year.
Cardinal Foods of Burgaw was in Significant Non -Compliance for exceedance of BOD
and TSS limits for the first semi-annual period of 2023 and for exceedance of BOD, TSS,
Oil and Grease, and pH limits for the second semi-annual period of 2023. The industry
was issued Notices of Violation and civil penalties per the Town's Enforcement
Response Plan.
American Skin Food Group of Burgaw was in Significant Non -Compliance for
exceedance of TSS for the first semi-annual period of 2023. The industry was issued
Notices of Violation and civil penalties per the Town's Enforcement Response Plan. The
industry identified the cause of the exceedances and has returned to full compliance.

NOTICE OF VIOLATION
The following findings are made, and notice issued pursuant to the authority vested in the
Director of Public Works for the Town of Burgaw, under Division 1 of the Town's Sewer Use
Ordinance. This order is based upon findings of violation in the conditions of the wastewater
discharge permit number 0004, issued to American Skin Food Group, LLC, 140 Industrial Drive,
Burgaw, NC 28425.
1. The Town of Burgaw is charged with construction, maintenance, and control of the
sewer system.

automatic $1000.00 civil penalty.
The industry is also found in violation of administrative requirements of the permit. The August

ORDER TO CEASE DISCHARGE
Pursuant to provisions of the Sewer User Ordinance, Section 8.1 (d), and the Enforcement
Response Plan of the Town of Burgaw, Cardinal Foods, LLC., Significant Industrial User Permit
0007, herein after referred to as 'User', is hereby ordered to cease discharge of all non -domestic
sources of wastewater, pretreated or otherwise, to the Town of Burgaw Collection System
immediately and until further notice.
The following reasons are cited in reference to this order to cease discharge:
1. User holds Town of Burgaw Industrial User Permit (IUP) #0007 for the operations of
existing pretreatment units and discharges from said treatment works into the Town's
collection system which expires October 10, 2027.
2. User has been unable to meet the permit limitations for BOD, TSS and pH set forth in its
Industrial User Permit while discharging only chiller water and clean-up water from its
permitted process.
3. User believes there is an existing bypass in the piping going to the pretreatment system.
4. On Friday, August 25, 2023, user discharged an unknown large volume of grease to the
Burgaw sanitary sewer system from a process or clean-up of a process not permitted under
IUP 0007. The grease entered several of the Town's lift stations and had to be pumped out
by Town staff. As of Monday, August 28, 2023, more grease has entered the sewer system,
and Town staff has pumped out additional lift stations.
5. A large volume of grease that went through the Town of Burgaw sewer system has reached
the Town of Wallace wastewater treatment plant as of the morning of August 28, 2023.
This notice bars SIU 0007 from discharging any wastewater, other than domestic from sinks and
toilets to the Burgaw Collection System until further notice:
1. There shall be no discharge of process water, clean-up water or chiller water until such
time as the suspect bypass has been located and blocked or repaired, and the on -site DAF
unit is installed, test runs have been performed (using pump and haul for all wastewater in
the test runs) and data have been provided to the Town of Burgaw demonstrating that the
industry can meet its permit limits.
2. Authorization to Construct for the DAF unit will be provided separately.
3. The Town of Burgaw is also directing the industry to install an appropriate sample port
ahead of the point at which the domestic wastewater is discharged to the sanitary sewer.
The sampling location must be accessible to the Town and to any contract laboratory for
sampling and testing of the wastewater. User must provide information on the proposed
sampling location to the Town for approval prior to use.
