Director Division of Water Quality March 23, 2005 DWQ Project # 04-1111 Wake County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Rhein Brightleaf, LLC Attn: Mr. Richard Westmoreland 4000 Westchase Blvd., Suite 310 Raleigh, NC 27607 Subject Property: Brightleaf at the Park Lick Creek [03-04-01, 27-11-(0.5), WS-IV, NSW (nutrient sensitive)] *303(d) REQUEST FOR MORE INFORMATION Dear Mr. Westmoreland: On September 13, 2004, October 15, 2004, January 31, 2005 and February 9, 2005, the Division of Water Quality (DWQ) received your revised applications dated September 10, 2004, October 15, 2004, January 28, 2005 and February 9, 2005 respectively to impact 0.7 acres of wetlands, 0.077 acres of isolated wetlands, 2,003 feet of streams, 197 feet of isolated streams and 188,687 square feet (ft2) of protected riparian buffers to construct the proposed Brightleaf at the Park Subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The most recent submittal of the Pre-Construction Notification Application (PCN) received on February 9, 2005 includes a lot of additional impacts and the elimination of several impacts that are very unclear. A meeting has been scheduled with Todd Preuninger of Soil & Environmental Consultants, PA on March 30, 2005 to review these discrepancies so a complete and valid PCN can be submitted to the DWQ for a final review. Please respond within three weeks of the date of this letter by sending this information to me in writing and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
