Charter Properties, Inc is the developer of this proposed site located oft Ridge Road, just east of Prosperity Village
Road in Charlotte, NC. Your department recently issued an "Approval of 401 Water Quality Certification with
Additional Conditions" for this property. One of the additional conditions required mitigation for the stream impacts
and we are in the process of making arrangements with the Ecosystem Enhancement Program to allow for the proper
payment to that program for the required mitigation.
Another condition i)f your certification approval (Condition # 7) was that we submit a "... Final, written storm watel-
management plan..." which is to include our project construction plans, specifications, BMP worksheets, associated
calculations and the project Operations .and Maintenance Agreement within 60 days of the issuance of the
certification, which was dated October 22, 2007. Because of the complexity of the overall project (which will
include three separate, public roads that must be built for the City of Charlotte and NCDOT) and the time needed to
obtain proper City and NCDOT plan approvals, it is not possible for the final plans and specifications to be available
within this requested time frame. We therefore request an extension of the deadline to submit the project storm
water management plan until approximately June. 15`x', of 2009. This extension would allow our land planners and
civil engineers to properly complete the full and detailed design of the required public roads and the proposed
apartment site, as well as obtain needed design input and approvals from the NCDOT, the City of Charlotte DOT,
and the City Planning and Engineering staffs for the roads and apartment site. This extension would help avoid
potential re-submittal(s) of future modifications to the stone water management plan which may result if our
management plan is submitted prior to review/approval by the City and/or NCDOT.
Please confirm your approval of this deadline extension request by signing and returning a copy of this letter to our
office.
