Director Chadwick Phillips CDP Farm 140 S Country Club Dr Kenansville, NC 28349 Dear Chadwick Phillips: NORTH CAROLINA Environmental Quality February 19, 2024 Subject: Additional Information Request Application No. ADS310557 CDP Farm Duplin County The Animal Feeding Operations Program of the Division of Water Resources (Division) has completed a preliminary review of the subject application received on November 22, 2023, for permit coverage under Swine Farm Digester Waste Management System General Permit AWG400000 to construct one new synthetically -lined digester to capture biogas as a part of the proposed farm digester system at the CDP Farm Additional information is required before we may continue our review. Please address and submit the following item(s) within 30 (thirty) days of receipt of this letter. ❑ Nutrient Management Plan (NMP) — The NMP submitted is dated 9-28-2018. The application form stated that the new NMP is pending by the owner. Per our conversation during the January 26, 2024 site visit, the new digester will be located in one of the current land application fields. The NMP shows that pulls 16-19 are leased; no lease agreement was included. o Please provide the updated NMP. o Please provide the updated irrigation map. o Please provide documentation of the lease agreement for pulls 16-19. ❑ Setbacks — Sheet C.2.4.3 shows that the location of the proposed digester does not meet the Siting Act requirements for: o distance from any occupied residence, which is 1,500 ft, G.S. § 106-803(a)(3). As shown, the digester top of embankment is approximately 600 feet from the residence of William and Connie Outlaw, Duplin PIN 24870018760 o distance from any property boundary which is 500 ft, G.S. § 106-803(a)(3). As shown, the digester top of embankment is approximately 400 feet from the residential property boundary of William and Connie Outlaw, Duplin PIN 24870018760. o The distance from the digester top of embankment to the property boundary with Benjamin and Michelle Grady, Duplin PIN 248700124471 is approximately 182 feet, which greater than the current setback of 78 feet from the lagoon to the property boundary. Please provide documentation of compliance with the Siting Act, either through additional setbacks or documentation of permission as described in G.S. §106-803(b). Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations.
