Attached are revised plans for the Hervey Dock Improvements project with updated Normal Low
Water (NLW) depths. I have verified with the project surveyor that the updated water depths have
been correctly converted to NLW.
The jet ski lift platform has been slightly reduced in size from 169 sf to 160 sf. The plans and permit
application continue to reflect that the platform will be constructed of flow -through material. The lift
is in the previously proposed location at the end of the dock and located where the jet skis can enter
and exit the platform from deeper water at the waterward end of the docking facility, thus avoiding
shallower water at the landward end of the proposed platform. The distance from the lift location to
deep water (-2.6' NLW) is approximately 10' as shown on the updated plans.
Also attached is the manufacturer's engineering sheet for the jet ski lift with a drawing of the
structure. The cradle beam measurement for the 7,000 lb. and 9,000 lb. models is 6" deep, per the
engineering sheet. According to the contractor, the platform will be 4" thick (deep).
The marine contractor tells me that the lift never touches or sits on the bottom. When not in use
(being lowered to enter or exit the lift), it is raised to at least 3' above the water. He typically installs
a limit switch to avoid damage to the equipment that could occur from contact with the bottom. The
limit switch can be set as needed.
I spoke with Jimmy Harrison at the Div. of Marine Fisheries this morning regarding the limit switch
depth. Based on the avoidance and minimization measures proposed, he is comfortable with
recommending that the limit switch be set as 6" as you also recommended.
Please let me know if this satisfies your requirement for removing this project from "hold" status or
if additional information is required.

Good afternoon,
On December 28, 2023, the Division of Water Resources (Division) received your CAMA
application requesting a 401 Water Quality Certification from the Division for the subject
project. The applicant proposes to add a lift platform for jet skis. The Division has determined
that your application is incomplete and cannot be processed. The current application is on -
hold until all the following information is received:
1. Please provide a detailed drawing of the lift and platform, and how you are planning to
not allow the platform to impact the bottom substrate.
2. Please provide water depths for the site at NLW.
Pursuant to Title 15A NCAC 02H .0502(e) the applicant shall furnish all the above requested
information for the proper consideration of the application. Please respond in writing within
30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested
information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC
27699-1617 OR by submitting all of the above requested information through this link:
https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested
on the link is referenced above).
If all the requested information is not received within 30 calendar days of receipt of this letter,
the DWR will move to deny your application as required by 15A NCAC 2H.0506. The denial of
this project will necessitate reapplication to the Division for approval, including a complete
application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act
this activity and any work done within waters of the state may be a violation of North Carolina
General Statutes and Administrative Code.
