Dear Mr. Greeley:
In Notice of Violation NOV-2022-LV-0247, dated June 10, 2022, you were notified of a limit exceedance violation
of total mercury annual load for the February 2022 reporting period. In a response letter dated June 23, 2022, you
informed this office that version 4.0 of the subject permit established an annual average limit for total mercury
rather than an annual load limit. To verify this information, Jesse Barnes of this office reviewed version 4.0 of the
subject permit, the February 2022 discharge monitoring report (DMR), and your response to the subject notice.
In reviewing the aforementioned permit, DMR, and response letter, this office has determined that the subject
facility was not in violation of the total mercury annual average limit of the subject permit for the February 2022
reporting period. Notice of Violation NOV-2022-LV-0247 is hereby retracted.
