February 19, 2023 Russell Fox Town of Burnsville Email: mayor@townofburnsville.org SUBJECT: NOTICE OF VIOLATION Burnsville WWTP Town of Burnsville Tracking Number: NOV-2024-PC-0120 Incident No. 202400445 Permit No. NCO020290 Unauthorized Bypass Dear Mr. Fox On the morning of February 9, 2024 at approximately 8:00 AM, the gate valve in the bottom of the Secondary Clarifier broke and closed, which halted the flow from the Aeration Basin to the Secondary Clarifier at the Burnsville WWTP. This caused an unauthorized bypass of partially treated sewage into the Cane River (C;Tr; 7-3- [13.7]) from the Burnsville WWTP. Paul Isenhour (ORC) contacted Daniel Boss (Asheville Regional Office, Division of Water Resources, Assistant Regional Supervisor) in the afternoon of February 9, 2024 to report the incident.
